SAN DIEGO (KGTV) - The federal watchdog agency that aims to protect consumers from unfair, deceptive, or abusive practices is suing a San Diego-based company.On Tuesday, the Consumer Financial Protection Bureau (CFPB) sued Encore Capital Group and its subsidiaries, claiming they violated the terms of a 2015 legal agreement.The CFPB claims, “Since September 2015, Encore and its subsidiaries violated the consent order by suing consumers without possessing required documentation, using law firms and an internal legal department to engage in collection efforts without providing required disclosures, and failing to provide consumers with required loan documentation after consumers requested it.”The lawsuit says after the effective date of the consent order, “Encore filed more than 100 lawsuits to collect consumer debts after the applicable statutes of limitations had expired."The lawsuit also claims Encore failed to disclose that consumers might incur international-transaction fees.In response to the lawsuit, the company's Executive Vice President, General Counsel, and Chief Administrative Officer Greg Call said Encore is built on a foundation of treating their consumers fairly and respectfully."We are disappointed that the CFPB has chosen to file this lawsuit on outdated issues, but we will continue to engage with the CFPB and work to ensure that we maintain policies and practices that fully comply with all applicable legal requirements. We believe that there will be no material operational impact as a result of the suit," said Call. SAN DIEGO (KGTV) - The final touches are going into Petco Park before Thursday's highly-anticipated opening day. But just a few blocks away from the stadium are the many faces of San Diego’s homeless crisis, where several resources and services are located. Homeless advocate Michael McConnell spends many early mornings on the streets of downtown, documenting police interactions with the homeless population. Since the Hepatitis A outbreak he’s seen the number of encampments go down, but say he's frustrated over the city’s response to fixing the problem. “I’m most frustrated that there's not a strategy that's solutions-focused, long term thinking about actually reducing homelessness versus reducing the visibility of homelessness," said McConnell. On Wednesday morning, one day before Padres Opening Day, McConnell captured several interactions with police and the homeless around Petco Park and East Village. He believes the enforcement is the city trying to push homeless people away from the stadium before thousands of people descend on downtown. “When we have to send out massive amounts of law enforcement to clear an area, to make things appear better, versus them actually being better, we know we failed," said McConnell.10News also spoke with several security guards in the area who say they witnessed more enforcement than usual. However, San Diego Police says the enforcement around East Village is unrelated to Opening Day and that no additional officers were sent to the area Wednesday morning. They say officers are in this area every day as it's one of their busiest sectors in the city. A representative tells 10News they respond to daily complaints from business and residents to address ongoing problems, including encampments, drug use, and other criminal activity.Since last summer they've responded to 5,000 of these complaints through the Get It Done app alone.The department says during each contact they always offer help to individuals. If assistance is denied they have a progressive enforcement model which begins with warnings. But McConnell says based on what he's witnessed day in and day out, he's not satisfied with this answer.“What we’ve done is we’ve moved a lot of people around, we don’t let encampments build up again, but the folks are still there, they haven’t disappeared," said McConnell. 10News reached out to the Mayor's Office and received this response: 2415

SAN DIEGO (KGTV) -- The journey has come to an end for hundreds of migrants seeking asylum in the U.S.A large caravan arrived in Tijuana within the last week and have waited until Sunday to cross the border into San Diego.Late Sunday afternoon, members of the caravan plan to turn themselves in to customs agents seeking asylum.Most of the roughly 400 migrants in the caravan are women and children who have been staying in shelters, seeking legal counsel before trying to cross the border.RELATED: Migrant caravan warned asylum may lead to separation from childrenBorder patrol agents released a statement Saturday saying several groups associated with the caravan have been illegally climbing a scrap metal border fence.The statement warned anyone with the caravan to “think before you act.” The Secretary of Homeland Security also said in a statement earlier this week that anyone seeking asylum “may be detained while their claims are adjudicated.”Protesters say the group is taking advantage of U.S. immigration laws. A group called San Diegans for Secure Borders plans to protest at Friendship Park.They say the migrants are unwelcome and that their claims for asylum are false. A protest was held on both sides of the border Sunday morning. SAN DIEGO (KGTV) — The county Medical Examiner has identified the second teenager killed after a car lost control on a Mission Valley freeway and crashed before bursting into flames last weekend.David Chavez, 15, was killed by blunt force trauma, thermal cause, and smoke inhalation according to the ME in the tragic crash on Jan. 18.Police say a car was speeding at about 3 a.m. on the westbound Interstate 8 ramp to southbound State Route 163 when the driver lost control and hit a guardrail, sending the car down an embankment where it a tree and caught fire.RELATED:Community helping family of teen killed in Mission Valley crashAt least 2 dead in fiery freeway crash in Mission ValleyAnother 15-year-old, identified as Gustavo Beltran, was also killed in the crash.The driver, a 17-year-old, was arrested by CHP on suspicion of DUI. SAN DIEGO (KGTV) -- The family of the man killed in a wrong-way crash on Interstate 5 Monday morning says the California Highway Patrol got it wrong. According to them, their brother - Justin Callahan - was a driver, but not the driver who caused the crash. RELATED: Driver killed, 2 hurt in wrong-way crash on I-5On Monday CHP told 10News the following: Just before 2 a.m. Monday, a Volkswagon Jetta was traveling eastbound in the westbound lanes of Inerstate 8 from Sunset Cliffs Boulevard. As CHP officers responded, the Jetta entered the northbound Interstate 5 transition ramp to the westbound I-8 in the wrong direction and collided head-on with a Toyota Camry.An SUV then crashed into the back of the Camry, the CHP said.The driver of the Jetta was 35-year-old Justin Callahan, who was declared dead at the scene. Justin's family says he usually drives home from work at the time and would have been traveling in the opposite direction - from Chula Vista to his home in Ocean Beach. Based on that information, they tell 10News the CHP's report just doesn't add up. "It doesn't make any sense," his brother, Tommy Villafranca, said.  "Why would he get back on the freeway and get back the opposite direction?"And if Callahan did turn around and got back on the freeway, the timing doesn't add up,  his brother said.  He says his work caught on security video leaving at 1:38 a.m. and the crash happened less than 20 minutes later."It takes 21 minutes just to get from his work to Sunset Cliffs Boulevard," Villafranca said.   "He’s still got to turn around go back, and that would take even more time, so the timeline is not working at all."The family has created a GoFundMe to help them pay for arrangements necessary to get Callahan back to Wheatland, California and arrange a funeral. "Justin was an artist and an inspiration to the people around him," James O'Callahan wrote on the GoFundMe page. "At this point I am too broken up inside to write anything worth reading. Please share a story you have about him in the comments."In the comments, Stevie Workman wrote: "Justin, was my neighboor down stairs while I was in college. We had great times!! Dressing up in suits to go to fancy dinners, Super Bowl parties and talking to him about aviation. He was an amazing guy!
