SAN DIEGO (KGTV) -- Following several years of record-breaking fires around California, the state’s department of insurance is letting residents know they have options if their insurance gets dropped. Under Proposition 103, a law approved by voters in 1988, insurers are required to file rate changes with the California Department of Insurance. Although the department doesn’t set rates, state law requires that insurers’ rates are based on a demonstrated risk of loss. New laws that both took effect in 2019 also offer some protection. One of the laws specifies that homeowners living in a declared wildfire disaster area or adjacent zip codes receive one year of protection from non-renewal. The state also extended protections against non-renewal for people who suffer a total loss during a fire to two automatic renewals or 24 months. If you find yourself in the middle of a non-renewal, the department lists specific rights California residents have: The notice of non-renewal must be sent at least 45 days prior to policy expiration. That notice of non-renewal must contain: (1) the reason or reasons for the non-renewal; (2) the telephone number of the insurer's representatives who handle consumer inquiries or complaints; and (3) a statement indicating that if the consumer has contacted the insurer to discuss the non-renewal and remains unsatisfied, the policyholder may have the matter reviewed by the Department. The insurance company must determine whether to renew or non-renew based upon its underwriting guidelines, which must be objective, have a substantial relationship to the risk of loss, and be applied consistently among insureds in the particular group being non-renewed.For anyone who can’t find insurance, the department has another option. SAN DIEGO (KGTV) — Fire crews continued mopping up what was left of the Willow Fire in Rancho San Diego Thursday, as they remain on high alert during this Red Flag Warning.One home was destroyed in the brush fire, while six others were damaged when the flames, pushed by wind quickly moved up a hillside to Willow Glen Drive Wednesday.The fire prompted evacuations. Neighbors told ABC 10News they were scrambling to get out in the middle of the night, unsure of what to grab."I happened to be on scene first with our fire chief and it was about five acres when I first got here and quickly grew, and was in the backyards of some of these homes in 5 to 10 minutes," said Andy Lawler, San Miguel Fire & Rescue Battalion Chief.Crews were able to quickly gain control of the flames, making airdrops when safe, and saving homes — despite the wind working against them.Over in San Marcos, the Sycamore Fire grew to three acres Thursday afternoon but firefighters were ready to attack it from all angles.Fire departments across San Diego County have upped their staffing and remain on high alert for the next few days."We have dedicated crews on these brush rigs so they have a quicker response throughout the city of San Diego," San Diego Fire-Rescue Battalion Chief R.J. SAN DIEGO (KGTV) - Hate crime charges were filed Monday against the Little Italy man accused of attacking three Muslim women wearing hijabs. Kyle Allen, 50, pleaded not guilty to battery in a San Diego courtroom following the Oct. 6 incident. The women were walking on Columbia Street when Allen approached them from the other direction. Witnesses said Allen lunged his shoulder into them, tried to remove one woman's hijab, then hit one of the women. RELATED: San Diego Police: Alleged attack on 3 women in hijabs a possible hate crime "As I got closer I heard him calling her names and telling them to go back to where they came from," a witness who only wanted to be identified as Amy told 10News. Passersby trailed Allen back to his high-rise apartment in Little Italy and called police. San Diego Police said Allen answered his front door while holding a handgun with a silencer. A total of 10 guns were found in Allen's home and seized, investigators said. Allen was arrested without incident.Protection orders are in place for the three women, keeping Allen from contacting them or coming within 100 yards.Allen will return to court Dec. 19 for a preliminary hearing.
