We’re humbled and gratified, but we have seen expressions of hatred towards Phoenix Rising, their head coach, Rick Schantz and their player, Junior Flemmings which have no place in our sport as well as our society. We do not want to see players and coaches that love the sport as much as we do bullied, and their reputations sullied, by unfortunate lapses of judgements when fueled by passion and competition. We do not endorse a player being terminated by the club, but rather given an opportunity to learn from their mistake through league punishment protocols and, most importantly, the support of their club. We believe in second chances and look forward to working with Phoneix Rising on productive ways we can forgive, educated, and grow from these moments.We support “We Will Speak. We Ill Act.” and we seek to Forgive, Educate and Inspire.The purpose of our stand was to raise awareness, spread love and eliminate hate in all forms. We ask those who support our stand to please be respectful with Junior Flemmings, Rich Schantz and the entire Phoenix Rising FC organization - threats of any nature are not the solution. We look forward to the implementation of these educational programs and hope that they can serve as a model for our league."SD Loyal players walked off the field at Torero Stadium at the start of the second half on Sept. 30 leading 3-1 and forfeited the game after midfielder Collin Martin, an openly gay player, was allegedly called a homophobic slur by Flemmings.Flemmings issued a statement on his since deleted Twitter account that same night calling the accusation false and writing that "my fellow teammates will support my claim." He also wrote that he was "mauled and ridiculed online" and "I stand in solidarity with the LGBTQ+ movement."USL Championship is conducting an investigation to determine the facts surrounding the incident. Rising is also conducting an investigation.The second-division men's professional soccer team also announced Thursday that Flemmings "will be taking an administrative leave so that he may focus fully on cooperating with the investigation."Shantz, the team's coach, will also be taking administrative leave, unrelated to the league's investigation, Rising announced.Flemmings is the league's leading goal scorer with 14.SD Loyal announced Sept. 25 it would forfeit the standings point from their 1-1 tie with Los Angeles Galaxy II Sept. 23 because of a racial slur directed as SD Loyal midfielder Elijah Martin, who is Black. However, the league's standings did not subtract the point.Galaxy II announced last Saturday they had "mutually agreed to part ways" with defender Omar Ontiveros, one day after he was suspended by USL Championship for six games because of the racial slur. 3945

SAN DIEGO (CNS) - Southwestern College President and Superintendent Kindred Murillo will retire at the end of this academic year after serving 24 years in the California Community College System, the college confirmed Wednesday.Beginning as an adjunct faculty member at Desert Community College District, Murillo has served in various roles. She spent 11 years as a chief business official and served her last nine years in the system as a college president, first at Lake Tahoe Community College District, and then at Southwestern College for more than four years."It is the commitment faculty, classified professionals and administrators have had to the success and achievement of our students that has made my career so rewarding," Murillo said. "Southwestern College has been the most remarkable community college I have had the privilege of serving during my entire academic career. We have worked together to establish a path of transformation for our students and our community."Murillo guided the college's accreditation status from warning to reaffirmation within her first year. According to a college statement, she also tackled a backlog of personnel investigations and complaints, increasing accountability at the district.Early in her tenure, she formed an Advisory Task Force on Inclusion & Race Relations that was intended to acknowledge a history of racism and inequity by design and to "develop transformative interventions designed to strengthen, enhance and support culture change," a college document said.Governing Board President Nora Vargas credits Murillo's commitment for positioning Southwestern College as a model of equity in the California Community College System."Murillo's transformative changes would have taken any other leader a decade to accomplish," Vargas said. "The work she has done will continue to benefit our students and our community for years to come. This will be her legacy."According to the college, some of her other accomplishments include:-- Implementing hiring practices, procedures and professional development that have resulted in the diversification of Southwestern College faculty, staff and administrators by almost 8%, and the leadership of the college by 14%, over a three-year span-- Moving from a 17% diverse executive leadership team to 75% diverse executive leadership-- Increasing graduation rates as measured by the College Scorecard by 10% in a little more than three years-- Entering into a partnership with San Diego State University to launch an SDSU Microsite at Southwestern College that will provide access to four-year degrees to Southwestern graduates on the Southwestern College Chula Vista campusMurillo said she is looking forward to retirement with her husband Michael and her son Vance. She lives in South San Diego County and plans on spending more time paddle boarding on the San Diego Bay and enjoying bike riding on the Bayshore Bikeway.The Southwestern College Governing Board will conduct a national search for her replacement that will include opportunity for community input. 3077

SAN DIEGO (CNS) - The California Supreme Court ruled this week that a San Diego court must re-examine its decision to allow a criminal defendant to subpoena Facebook to obtain private social media posts and messages he alleged would help him in his defense.The ruling issued Thursday laid out a series of factors for the trial court to consider when weighing whether to allow the defendant to gain access to his alleged victim's restricted posts and private messages.The ruling stems from the criminal case of Lance Touchstone, a Northern California man charged with attempted murder for allegedly shooting his sister's boyfriend in Ocean Beach in 2016.Touchstone sought to obtain information from the victim's Facebook posts that the defendant alleged would show his accuser was a violent person, bolstering a self-defense claim.A San Diego Superior Court judge ruled in Touchstone's favor and ordered Facebook to release the information, leading to subsequent appeals.In an opinion authored by Chief Justice Tani G. Cantil-Sakauye, she wrote that the trial court should consider a list of seven factors to consider when deciding whether good cause has been shown to grant the subpoena.These "Alhambra factors" include whether the defendant has shown a "plausible justification" for acquiring the information and whether acquiring the material violates a third party's confidentiality or privacy rights, among others.While the state Supreme Court declined to make its own determination on the subpoena's viability, it ruled for the trial court to re-examine the subpoena issue in light of these factors.Touchstone's attempted murder trial in San Diego remains pending for a date still to be determined, as courts remain closed to the public and jury trials have been delayed indefinitely due to the COVID-19 pandemic. 1826

  

SAN DIEGO (CNS) - SDCCU Stadium in Mission Valley was added to the 30th annual list of the top 10 endangered landmarks and cultural landscapes in San Diego released Tuesday by the Save Our Heritage Organisation.SOHO called the facility -- known until recently as Qualcomm Stadium -- "one of the few mid-century designed, multi-purpose stadiums" to remain standing in the United States."Innovative design features include the pre-cast concrete, pre-wired light towers and spiral concrete pedestrian ramps," according to SOHO. "The novel form of the stadium -- eight concentric circles -- provides excellent sight lines."While current proposals for the site include knocking the stadium down, SOHO urged city leaders to adapt the structure for future uses like college football or soccer games.SOHO, which advocates for maintaining San Diego's historical buildings and sites, as well as unique architectural styles, also criticized the city for continuing to ignore Presidio Park, which it described as "a decaying and unkempt embarrassment," and Balboa Park, where many of the major buildings are behind in their maintenance needs.Others on the list are: 1166

  

SAN DIEGO (CNS) - San Diego City Attorney Mara Elliott announced today that the city will use a 5,850 grant to fund a team of specialized prosecutors to handle cases involving drug-impaired drivers.The City Attorney's Office will use the renewed Drug DUI Prosecution Grant to handle cases of both drug-impaired and drug/alcohol-impaired driving, from arrest through conviction and sentencing. The state Office of Traffic Safety administers the grant from the National Highway Traffic Safety Administration."Driving under the influence of drugs can have devastating effects on San Diego drivers and their families," Elliott said. "Our city continues to see DUI cases involving the misuse of prescription drugs, marijuana and illegal drugs, often in combination with alcohol. This grant allows our highly specialized prosecution team to work closely with law enforcement to hold accountable those who endanger our community."Specialized prosecutors working under the previous grant from Oct. 1, 2017, to Sept. 30 of this year filed 228 misdemeanor cases of drug-impaired and drug/alcohol-impaired driving while the City Attorney's Office filed a total of 3,110 impaired driving cases during that time. The office has received grant funding for drug DUI prosecutions since the fall of 2014.Officials warn that use of prescription drugs and/or marijuana, especially in conjunction with alcohol use, can lead to a DUI arrest and conviction. San Diego County saw a total of 90 deaths and 2,364 serious injuries due to DUI crashes in 2015."Driving under the influence is a crime that will not be tolerated," said Office of Traffic Safety Director Rhonda Craft. "Funding the prosecution of individuals who put lives at risk is one of many ways we are working to educate the public on the dangers and consequences of driving under the influence." 1848
