SAN DIEGO (KGTV) - The federal watchdog agency that aims to protect consumers from unfair, deceptive, or abusive practices is suing a San Diego-based company.On Tuesday, the Consumer Financial Protection Bureau (CFPB) sued Encore Capital Group and its subsidiaries, claiming they violated the terms of a 2015 legal agreement.The CFPB claims, “Since September 2015, Encore and its subsidiaries violated the consent order by suing consumers without possessing required documentation, using law firms and an internal legal department to engage in collection efforts without providing required disclosures, and failing to provide consumers with required loan documentation after consumers requested it.”The lawsuit says after the effective date of the consent order, “Encore filed more than 100 lawsuits to collect consumer debts after the applicable statutes of limitations had expired."The lawsuit also claims Encore failed to disclose that consumers might incur international-transaction fees.In response to the lawsuit, the company's Executive Vice President, General Counsel, and Chief Administrative Officer Greg Call said Encore is built on a foundation of treating their consumers fairly and respectfully."We are disappointed that the CFPB has chosen to file this lawsuit on outdated issues, but we will continue to engage with the CFPB and work to ensure that we maintain policies and practices that fully comply with all applicable legal requirements. We believe that there will be no material operational impact as a result of the suit," said Call. SAN DIEGO (KGTV) — The July Fourth holiday weekend is expected to bring large crowds to San Diego's beaches.Los Angeles beaches will be closed this weekend, and that has some concerned that even more people will flock to San Diego's beaches.Debra Moore lives in Encinitas. She'd like the beaches closed indefinitely."I think they opened way too soon, and we all saw this coming. They told us it was going to come, and I'm sorry so many more people had to get sick," said Moore.She said young people in her neighborhood aren't taking the pandemic seriously."Nobody is wearing a mask, nobody is social distancing. People are walking around my neighborhood all the time, or on the beach, just like it's normal, and nothing is normal anymore," said Moore.Del Mar Councilman Dave Druker also has concerns."People are very worried about lifeguards being overwhelmed and the whole city being overwhelmed with visitors, cause there's nowhere else to go," said councilman Druker.Tuesday, San Diego county supervisor Nathan Fletcher said it's up to officials in coastal communities to decide whether beaches should close this weekend.Fletcher also said all of the coronavirus outbreaks have been linked to indoor settings. SAN DIEGO (KGTV) -- The Infinite Chemical Analysis Lab building in Miramar looks like any other chemical lab, but inside the products they are testing are all cannabis. InfiniteCal tests products for things like potency, pesticides, heavy metals and microbial analysis to make sure the products are safe for consumption and meet state standards. Josh Swider is the CEO and co-founder. Swider's company consists of roughly 45 employees, 30 of those are either chemists or biologists. The team tests products for licensed retailers to make sure their cannabis meets the standard for what is allowed by the state. When it comes to vaping, Swider says their analysis shows that what's making people sick is when the product is diluted, most recently with Vitamin E or Vitamin E acetate. According to the CDC, 33 people have died from lung related illnesses linked to e-ciggarettes or vaping products. Most of those samples tested by the FDA had THC. San Diego County has confirmed 22 vape related illnesses in the county. Although InfiniteCal doesn't just test products for vaping, Swider says the best thing a person can do is to do their research and make sure they are buying from a licensed retailer. He also recommends asking the business for their certificate of analysis to find out what's in the cannabis product they're consuming. InfiniteCal operates six days a week and also will tests an individual consumer's product if they show up to the lab. SAN DIEGO (KGTV) - The man who jumped on stage during a Taylor Swift concert and assaulted a security guard was charged Monday with a deadly beating in the Midway area, police said. Christian Ewing, 29, was charged for the death of 57-year-old Gregory Freeman, according to SDPD Homicide Lt. Anthony Dupree. Officers got a 911 call about an assault near the Interstate 5 overpass at 3900 Rosecrans St. the evening of Dec. 5. A witness said a victim was on the ground and another man was hitting him with an object, investigators reported. He died three days later of his injuries. The suspect fled the scene, police said.Ewing was arrested on Dec. 21 for a parole violation and rebooked Monday on suspicion of murder. In 2015, Ewing jumped on stage at Petco Park as Taylor Swift was performing. Swift’s personal security guard, David Durkin, told Ewing he was not allowed to be in the area. During a struggle, Ewing seriously injured Durkin. Prosecutors previously said Ewing had several arrests in multiple states, an active warrant for a theft-related offense out of Florida, and a felony conviction for transporting drugs from out-of-state. SAN DIEGO (KGTV) - The father accused of causing a condo fire in Rancho Bernardo that killed his two children appeared in court Tuesday afternoon for a preliminary hearing.Henry Lopez is accused of passing out drunk with a lit cigarette, setting his condo on fire last October.His children, 10-year-old Cristos and 7-year-old Isabella, were in the home at the time and suffered smoke inhalation. Both children died as a result of their injuries.Lopez was also burned in the fire and hospitalized for some time.One witness told the court Tuesday he heard a female screaming at the scene, but the screaming stopped.RELATED: Father charged after children killed in fireHenry Lopez' ex-wife Nikia Lopez testified the two were in the midst of a divorce. They shared joint custody of their children.  Lopez told the judge her former husband was an abusive alcoholic.She claims she had warned him previously not to smoke in the house around the children."He drank a lot. My goal was to keep it from the kids.  I would wake up in the middle of the night and throw away the bottles in the trash. I would pull him upstairs before the kids woke in the morning... sometimes I would have to clean up his throw up."  He’s not in custody because his defense attorney says he needs to be out to receive medical treatment for the burns he sustained during the fire.Prosecutors believe the fire started in his bed and ultimately spread to the rest of the home.  Investigators found discarded smoking materials and alcohol near the start of the fire.If there’s enough evidence against Lopez and the case goes to trial, he faces up to 14 years in prison for several felony counts including involuntary manslaughter and child endangerment.Lopez is not charged with intentionally starting the fire. 1809
