SAN DIEGO (CNS) - The California Supreme Court ruled this week that a San Diego court must re-examine its decision to allow a criminal defendant to subpoena Facebook to obtain private social media posts and messages he alleged would help him in his defense.The ruling issued Thursday laid out a series of factors for the trial court to consider when weighing whether to allow the defendant to gain access to his alleged victim's restricted posts and private messages.The ruling stems from the criminal case of Lance Touchstone, a Northern California man charged with attempted murder for allegedly shooting his sister's boyfriend in Ocean Beach in 2016.Touchstone sought to obtain information from the victim's Facebook posts that the defendant alleged would show his accuser was a violent person, bolstering a self-defense claim.A San Diego Superior Court judge ruled in Touchstone's favor and ordered Facebook to release the information, leading to subsequent appeals.In an opinion authored by Chief Justice Tani G. Cantil-Sakauye, she wrote that the trial court should consider a list of seven factors to consider when deciding whether good cause has been shown to grant the subpoena.These "Alhambra factors" include whether the defendant has shown a "plausible justification" for acquiring the information and whether acquiring the material violates a third party's confidentiality or privacy rights, among others.While the state Supreme Court declined to make its own determination on the subpoena's viability, it ruled for the trial court to re-examine the subpoena issue in light of these factors.Touchstone's attempted murder trial in San Diego remains pending for a date still to be determined, as courts remain closed to the public and jury trials have been delayed indefinitely due to the COVID-19 pandemic. 1826

SAN DIEGO (CNS) - Police Tuesday were searching for a man suspected of robbing a taco restaurant in the Mountain View area at gunpoint.It happened shortly before 8:50 p.m. Monday at an eatery on Ocean View Boulevard between South 36th and South 37th streets, San Diego police Officer John Buttle said.The thief walked up to the counter, pointed a black handgun at the clerk and demanded money from the register, Buttle said.The clerk complied. The gunman fled out the back door and continued running northbound on South 37th Street with an undisclosed amount of cash, he said.No injuries were reported.The bandit was described as a 5-foot-4 Hispanic man in his 20s with a thin build. He was last seen wearing a blue hooded windbreaker with a white collar.Robbery detectives were investigating the incident.v 815

SAN DIEGO (CNS) - San Diego County had the fourth-most homeless residents in the U.S. this year, according to a report released Monday by the U.S. Department of Housing and Urban Development. San Diego County's data was taken from the 2018 Point in Time Study, completed Jan. 26. The region had an official count of 8,576 homeless residents during the three-hour window in which the count took place, behind Seattle/King County in Washington, Los Angeles County and New York City, which topped the list with 78,676 homeless residents. According to the report, roughly 5,000 members of San Diego's homeless population are unsheltered, living on the street, in a vehicle or in a hand-built structure such as a tent. Another 3,500 homeless residents were sheltered at the time of the study, living in emergency shelters, safe havens and transitional housing. The county's count could be higher than 9,000 homeless residents, however, because the San Diego Regional Task Force on the Homeless did not count residents in recreational vehicles and some residents in shelters. County officials and homeless advocates believe the actual homeless population could total as high as 9,220, but the true count has remained opaque since the task force, which oversees the Point in Time County, announced the error May 31. Overall, California leads all other states with 129,972 homeless individuals, followed by New York at 91,897. At the time the counts were completed in January, California laid claim to 24 percent of the country's total homeless population. Combined with New York, Florida, Texas and Washington, roughly half of the country's homeless population was clustered in five states. Homelessness in California has declined in recent years despite the robust total. The state's homeless population fell by 1,560, or 1.2 percent, from 2017 to 2018 and 9,014, or 6.5 percent, from 2007 to 2018. New York and Massachusetts have seen the biggest increases from 2007 to 2018, adding 29,296 and 4,941 homeless residents to their counts, respectively. 2052

  

SAN DIEGO (CNS) - Pride Live, the online pride parade and festival, kicked off a day-long event today featuring elected officials, community organizations and businesses.Because of the pandemic, organizers took the historic Pride Parade march through Hillcrest online -- sdpride.org/live/ -- and began at 10 a.m. with a slide show of photos from 46 years of the parade, which started in 1974. The San Diego Women's Chorus followed with a virtual singing of the national anthem. An interfaith blessing, with clergy from various denominations, gave their blessings.In 1994, the San Diego Women Motorcycle Riders first appeared to officially kick off the parade, which usually had about 350,000 participants and 200 pride floats, along with 400 volunteers.This year, about 12 motorcycles from the group took off from the site of the Hillcrest pride flag at University Avenue and Normal Street. San Diego Mayor Kevin Faulkener gave a few opening remarks, saying, "We can work and lift each other up and get through this pandemic. We stand united in our battle against bigotry and hate. I wish all of you a happy virtual parade.''The winners of the 2020 Spirit of Stonewall Awards, announced at a rally Friday evening, were honored. Lee Hill, Jr.; and-- Inspirational Relationship: Joyce Marieb, Ph.D. and Linda Barufaldi, D.C., who were married in 2008 and are currently in their 48th year of relationship.The pride event is scheduled to include Adam Lambert, GiGi Goode and Margaret Cho to share messages of support. SAN DIEGO (CNS) - San Diego's Old Globe Theatre will present its 15th annual Globe Christmas Tree Lighting Ceremony virtually on its website and social media channels at 6 p.m. tonight to kick off the holiday season.The ceremony will feature songs, videos, and special hellos from some of the theater's favorite company members from the past 22 years, James Vasquez, director of the theater's production of ``"Dr. Seuss' How The Grinch Stole Christmas." The Grinch himself will present the final countdown to the lighting of the tree.Designed by Grinch scenic designer John Lee Beatty, the tree will be located in the center of the Globe's Copley Plaza and will remain through December 31. Holiday photos can be taken in front of the tree each evening.Social distancing and masks are strongly encouraged on the Globe's Copley Plaza.Modeled after Shakespeare's Old Globe in London, San Diego's Old Globe Theatre in Balboa Park was built in 1935 for the presentation of abridged versions of Shakespeare's plays as part of the California Pacific International Exposition.The Old Globe annually produces 15 productions, ranging from Shakespeare to an ongoing emphasis on the development and production of new works. 1219
