WASHINGTON — With a shift to the conservatives pending, the Supreme Court is opening a new term. That strengthened majority could roll back abortion rights, expand gun rights and shrink the power of government. Eight justices are getting back to work Monday less than a month before the presidential election. After their colleague Justice Ruth Bader Ginsburg died last month, the Senate could confirm President Donald Trump’s nominee for Ginsburg’s seat, Judge Amy Coney Barrett, before Election Day. They’re also working in the midst of a pandemic that has forced the court to meet by telephone. The Supreme Court will hear arguments by teleconference on two cases on Monday: Rutledge v. Pharmaceutical Care Management and Tanzin v. Tanvir. 750

WASHINGTON — President-elect Joe Biden's next pick for his cabinet could be the most consequential amid the COVID-19 pandemic — director of Health and Human Services. It's hard to imagine a more consequential pick. Biden is expected to announce his choice to head the Department of Health and Human Services next week.Rhode Island Democratic Gov. Gina Raimondo has emerged as a focus of attention for the job. Although Raimondo has been aggressive in confronting the virus, her state is facing a dangerous surge and struggling to flatten the curve.Businessman Jeff Zients is widely seen as the leading contender for a White House post coordinating the government's overall virus response. The Associated Press reports that one popular pick to lead the department has already turned down another job in the Biden administration — New Mexico Democratic Gov. Michelle Lujan Grisham has already declined to serve as interior secretary, according to a person close to the Biden transition team. The AP reports that Vivek Murthy, currently serving as co-chair of Biden's coronavirus task force, could be in the running as Surgeon General.Biden will also reportedly appoint a top-level White House adviser to coordinate the government's response to the virus. Whoever is nominated to the position would likely take the reigns in delivering vaccines that had been developed under the Trump administration — a massive undertaking as hundreds of millions of Americans awaiting inoculation. 1485

WASHINGTON — The U.S. government on Tuesday will start distributing 30,000 doses of an experimental monoclonal antibody drug to fight COVID-19, the one President Donald Trump received last month.Over the weekend, the Food and Drug Administration agreed to allow emergency use of the therapeutic, casirivimab and imdevimab, made by Regeneron Pharmaceuticals Inc., for people with mild-to-moderate symptoms who are at high risk of developing serious illness because of their age or other medical conditions. The treatment was not authorized for use in sicker, hospitalized patients or those who need extra oxygen.President Donald Trump was given the therapeutic treatment when he contracted coronavirus in October. The Department of Health and Human Services said the federal government announced funding over the summer to support large-scale manufacturing of casirivimab and imdevimab. The agency will allocate “these government-owned doses to state and territorial health departments which, in turn, will determine which healthcare facilities receive the infusion drug,” reads a statement from HHS.“Beginning immediately, weekly allocations to state and territorial health departments will be proportionally based on confirmed COVID-19 cases in each state and territory over the previous seven days, based on data hospitals and state health departments enter into the HHS Protect data collection platform,” reads the HHS statement.Antibodies bind to the virus and help the immune system eliminate it. The Regeneron drug is a combo of two antibodies that seemed to do this well in lab tests. The emergency use authorization allows limited use of a drug while studies continue to test its safety and effectiveness. Early results suggest it may reduce COVID-19-related hospitalization or emergency room visits. The drugs are given as a one-time treatment through an IV and takes about an hour.Under federal contracts, the drugs for now will be supplied for free, although patients may have to pay part of the cost of the IV treatment. 2036

VISTA (CNS and KGTV) - Prosecutors announced Friday they will seek a second trial against ex-NFL tight end Kellen Winslow II, who was convicted of forcible rape and misdemeanor counts of indecent exposure and lewd conduct earlier this week. Following about a week of deliberations, a Vista jury found Winslow guilty of raping a woman in Encinitas and exposing himself to two others, but deadlocked on eight other charges, including rape and kidnapping in connection with two other women. Jurors indicated that they were leaning toward guilty verdicts on each count, but were unable to reach a consensus, leading San Diego Superior Court Judge Blaine Bowman to declare a mistrial as to those counts Tuesday morning, and dismiss the jury. Prosecutors stated they will go forward with trying Winslow a second time. A judge set the trial date for Sept. 30 and denied bail, saying Winslow was a danger to the community.Winslow was convicted of last May's rape of a 58-year-old homeless woman -- Jane Doe 2 -- exposing himself to Jane Doe 3, who was gardening in her front yard in Cardiff last May, and touching himself in front of a 77-year-old woman -- Jane Doe 5 -- at a Carlsbad gym in February. The 35-year-old son of former San Diego Chargers legend Kellen Winslow was acquitted of committing lewd conduct in front of Jane Doe 5 on a separate occasion. WATCH FRIDAY'S COURT HEARING: 1390

WASHINGTON — As President Donald Trump continues to press his argument that the vote was rigged against him, the machinery of government and democracy is moving inexorably toward Joe Biden's presidency. As U.S. District Judge put it this week in throwing out a lawsuit challenging Biden's win in Michigan: "This ship has sailed."Trump has refused to recognize that fact and vows to press on with his challenges. On Wednesday, Trump tweeted a call to "#OVERTURN" the results of the election and has continuously tweeted baseless claims that he was the winner. But Biden is firmly on track to become president Jan. 20, after having won a decisive majority of the electoral vote.As of Tuesday, nearly every state has now certified the results of their elections, a process known as "safe harbor." With Biden's win certified, the electoral college will formally recognize Biden's win on Dec. 14.The Trump campaign and other Republicans continue to file lawsuits attempting to overturn election results on widespread fraud claims. But none of those lawsuits have proved any systematic fraud or consequential error in U.S. voting systems.Trump has also not been helped by the newly-conservative Supreme Court and the hundreds of federal judges that he's appointed. His repeated attempts to personally pressure election officials in Michigan and Georgia into delaying certification also amounted to nothing.Ultimately, Biden will be sworn in on Jan. 20 after receiving 306 electoral college votes — the amount of votes Trump won in his 2016 win over Hillary Clinton, which he has referred to as a landslide win. 1610
