To All Members of the U-M Ann Arbor Community:The University of Michigan has received and acted on allegations of sexual misconduct against Martin A. Philbert, provost and executive vice president for academic affairs. With the endorsement and full support of the U-M Board of Regents, I have placed Dr. Philbert on administrative leave, effective Jan. 21, 2020, pending the results of an investigation we began on Friday, Jan. 17.I will follow up in the coming days regarding the appointment of an acting provost and executive vice president for academic affairs.We take allegations of sexual misconduct very seriously, and our policy is clear: Sexual misconduct will not be tolerated in the University of Michigan community.I want to apprise everyone of what has happened over the last few days and the actions we have taken. On Thursday and Friday, Jan. 16-17, 2020, the university received several allegations of sexual misconduct by Dr. Philbert. We began an internal investigation Friday. Over the next three days, the university retained an outside law firm which immediately launched an investigation of the allegations, our Division of Public Safety and Security was engaged, and Dr. Philbert was directed not to report to work. I placed him on administrative leave Tuesday.The Office for Institutional Equity, who would normally handle such investigations, reports to the provost. Today, I have moved OIE’s reporting line for all matters related to this investigation to Associate Vice President for Human Resources Richard S. Holcomb.The U-M Board of Regents and I are committed to a full and thorough investigation, and we will continue to work to ensure the integrity of the process, following the same policy and practices that apply to all employees at U-M. It remains early in the investigation, and no findings or conclusions have been reached.We thank the individuals who have come forward with these allegations. We know that reporting requires courage. They have been in business since 1818, so you would think they would have weather prognostication down to a science. The folks at the Farmers' Almanac have issued their forecast for the upcoming winter, and for many, purchasing a snowblower might not be a bad investment. The Farmers Almanac predicts that the Central US, Midwest and Northeast will see a cold, brutal winter. For those who live in Montana, Wyoming and Colorado and to the east, the almanac calls for "teeth-chattering cold" and "plentiful snow." For those in the Midwest, expect "biting cold" and snow this winter. And those in the Northeast should expect a "cold and white" winter. The West Coast should see a more average winter, with greater than average rain in the Pacific Northwest. While it will remain cold in Texas, the Southeast should be closer to average, with above-average rainfall. If you are hoping for a more modest winter, you will like the forecast from the Old Farmers' Almanac. Old Farmers' Almanac is suggesting a mild winter for most of the United States, with the exception being in the Southwest. The Rockies, while still mild, should expect a snowy winter. How these publications come up with said forecasts are a bit of a mystery, much like KFC's secret recipe. "we derive our weather forecasts from a secret formula that was devised by the founder of this Almanac, Robert B. Thomas, in 1792. Thomas believed that weather on Earth was influenced by sunspots, which are magnetic storms on the surface of the Sun," the Old Farmers' Almanac says on its website.  1616

TRABUCO CANYON, Calif. (KGTV) – A large brush fire burning in the Cleveland National Forest’s Trabuco Canyon is spreading quickly Monday afternoon. The fire, dubbed the Holy Fire, was reported around 1:30 p.m. near Holy Jim Canyon and Trabuco Creek roads, according to KABC.The Orange County Fire Authority said the blaze grew quickly from between seven and 10 acres to at least 4,000 by 8 p.m. and is currently spreading at a moderate rate. The Holy Fire is zero percent contained.  511

Three Democratic senators on Monday filed a lawsuit challenging the appointment of acting Attorney General Matt Whitaker, ratcheting up the court effort to declare his placement atop the Justice Department as unconstitutional.Sens. Richard Blumenthal of Connecticut, Sheldon Whitehouse of Rhode Island and Mazie Hirono of Hawaii filed the suit in US District Court on Monday, represented by the groups Protect Democracy and the Constitutional Accountability Center.The lawsuit is only the latest challenge to Whitaker's appointment to replace Jeff Sessions after President Donald Trump fired his attorney general the day after the election.Whitaker was serving as Sessions' chief of staff, and has not gone through the Senate confirmation process in that role. His appointment leap-frogged Deputy Attorney General Rod Rosenstein, which also gave Whitaker control over special counsel Robert Mueller's investigation that had previously been supervised by Rosenstein.Whitaker's appointment has been criticized because of his vocal criticisms of the Mueller investigation, and Democrats have previously urged him to recuse himself from the probe in addition to questioning the constitutionality of his appointment.Last week, the Justice Department issued a memo defending Whitaker's appointment, concluding that it was legally justified under the Vacancies Reform Act.The Senate Democrats' lawsuit, however, argues that his appointment his unconstitutional under the Constitution's Appointments Clause requiring Senate confirmation of high-level federal appointees.In addition to the lawsuit filed Monday, Maryland's attorney general filed suit last week asking a federal judge to replace Whitaker with Rosenstein.The-CNN-Wire 1731

Today Prosecutor Worthy granted relief to Mr. Danny Burton based on the work of the WC Conviction Integrity Unit. This is based upon a finding of new evidence that undermines the reliability of Mr. Burton’s conviction. The Wayne County Prosecutor's Office will not be re-trying the case, and as a result Mr. Burton has been released from MDOC today. 357
