ENCINITAS, Calif. (KGTV) -- Video from a witness shows a driver slamming into a crowd outside an Encinitas bar early Sunday morning. In the video, a U-Haul van can be seen accelerating onto a sidewalk. Video shows pedestrians leaping out of the way before the vehicle crashes into the crowd. In a Monday news release, the San Diego County Sheriff's Department said one person is in an intensive care unit while another is undergoing surgery with serious injuries following the crash. The department says a 24-year-old victim is in an intensive care unit while a 25-year-old is in surgery with serious injuries. After complying with the request, deputies say Davis got into the van, intentionally driving it onto the sidewalk. Davis was later arrested and is being charged with three counts of attempted murder and one count of attempted escape with force. Davis is scheduled to be arraigned in Vista on March 3. (KGTV) - The Encinitas City Council hopes that a compromise on a controversial bike safety plan will be able to satisfy casual cyclists who feel Coast Highway is not safe, as well as sport cyclists who like being able to zip along current the bike lanes.The route through the Cardiff community between Encinitas and Solana Beach is believed to be the most frequently ridden corridor for bicyclists in San Diego County.The debate began when the city began looking at replacing the current bike lanes with "protected" bike lanes. These will use curbs and bollard posts to separate the lanes from vehicle traffic.City Councilmember Kellie Shay Hinze believes this plan will make the area safer for commuters, beach-goers, and families who would prefer a safe option to ride bikes over driving. Furthermore, she believes there will be environmental benefits, as well."If residents are able to access this beach on foot or by bike, then we free up parking spaces for people that might be coming from farther away and we reduce the congestion that we generate as a city on our roads," Hinze said.However, avid sport cyclists believe protected bike lanes are more dangerous."That is a trap to a cyclist going fast," said cyclist Karl Rudnick. "I would never ride in that."Rudnick explained that funneling all cyclists into lanes divided from the road by curbs and railings gives cyclists who are riding at high speeds nowhere to go when attempting to pass by slower riders. He was surprised to hear that there were safety concerns along that portion of Coast Highway."It was a real eye opener to realize that there's a lot of people who don't ride their bikes who find that stretch very dangerous- the very stretch that I consider the safest, most beautiful stretch in the county," said Rudnick.Rudnick and Hinze both support the compromise plan. While the city will move forward with the protected lanes, it will also paint "sharrows" in the #2 lane of the highway. These indicate to drivers that cyclists have equal right of way to use that lane of traffic. There will also be signage to let drivers know cyclists have legal access to the highway. (KGTV) -- The return to in-person instruction for some north county students appears to be in legal limbo.Friday, the California Teachers Association filed a legal petition on behalf of the union representing the teachers in the San Dieguito Union High School District. The union wants the district's reopening plan blocked, saying, among other things, it violates the state's public health rules concerning the pandemic.Last Tuesday, the school board voted to give students the option of returning to in-person instruction five days a week on January 27th. Previously, the board voted to return to campus one day a week beginning January 4th.Lori Laroque has two boys in eighth grade at Pacific Trails Middle School. She applauds the board's decision."I was elated, and this was something that should have happened a long time ago," said Laroque.Ann Cerny has been teaching U.S History at Earl Warren Middle School for twenty-seven years. She also has a high school daughter in the district.Cerny says she would love to see kids return to campus, but she says now is not the time."Yes, in-person learning is best, but it's not going to be that 2019 in-person situation, and people aren't seeming to accept that reality," said Cerny, who has been teaching remotely from her classroom.Union leaders estimate up to 20% of teachers won't return if the plan for five days a week in-person instruction goes through.Cerny says she has concerns about exposure to COVID-19, but that isn't her biggest fear."It's the academic chaos that we find ourselves heading towards. I'm just worried that it's not going to roll out well. I'm worried for equity for students. I'm worried for the many, many teachers going out on leave and having subs for classes," said Cerny.The school board president said the district is actively recruiting for teachers and substitutes.No one from the board was available to comment on camera, but President Maureen Muir sent 10News a lengthy statement explaining the reopening plan."The health and safety of our students and staff is the District's highest priority. The District's Safe Reopening Plan follows the guidance issued by the California Department of Public Health and includes detailed protocols for distancing and ventilation.Staff will be encouraged to maintain 6 feet of distancing, as practical, from one another at all times, and teacher desks will be at least six feet away from students. Students will maintain distancing as practicable and in compliance with guidance from CDPH, including arranging desks in a manner that minimizes face-to-face contact. We have evaluated all of our classroom spaces and planned to maximize distancing. We have also planned carefully to maximize distancing for students and staff outside of our classrooms, including before, after, and between classes.The District consulted with ventilation and filtration experts to determine the maximum efficiency our units can handle. MERV 8+ filters were installed in all of our units, which achieves MERV 11 efficiency. Additionally, we purchased and installed HEPA filters in our classrooms, common areas, and offices. We have CO2 sensors in our newer buildings that monitor indoor air quality and we are purchasing more for other spaces.To ensure the continuity of teaching and learning, the District is allowing teachers who are in a high-risk group, or who have a household member in a high-risk group, to teach from home for the remainder of the second quarter, which ends on January 22, 2021.We have also informed teachers who have childcare needs due to COVID-19 that they may also work from home during this same time period. The District has made every effort to work with our teachers to keep them safe and to address their concerns about returning to work. The District is continuing to evaluate potential staffing shortages and has been actively recruiting teachers and substitute teachers to address this issue.The District is aware that the San Dieguito Faculty Association filed a petition for a peremptory writ of mandate on Friday that seeks to prevent the District from providing in-person instruction to students in January. They bring their own equipment and clean the cleaning supplies when they're done.“As the team leaves the home, they take off the mask, they disinfect the kit before they put it in their vehicle to go to the next home, so they’re not taking contaminants into their vehicle and taking it to another customer,” said Wiersma.There are training videos, daily checklists, and they've even held meetings about how to take your gloves off.“It’s little things but in the same respect, it’s important things,” said Wiersma. “You take all these steps to be careful and precautious and at the very last step, if you don’t take your gloves off right you, might as well not have done the rest of them as far as keeping the team safe.”Angel Gatewood, 24, has been cleaning for Merry Maids for the past year. The hardest part for her, someone who loves customers and customer service, has been keeping her client relationships at a distance.“I still try to maintain that personal relationship with my customers which I think is important because I’m in their house every other week touching their things,” said Gatewood. “Your home is your personal bubble. When somebody enters it, you have to have that trust and I like to maintain that."She loves to connect with people and loves her detail-oriented job, but she has asthma and now has to be even more cautious than ever.“I personally take those extra steps,” she said. “I take my inhaler in every time. I wear two pairs of gloves. I also have eczema. It’s a double problem. I wear two pairs of gloves and the mask every time.”Wiersma says while COVID-19 has been challenging, it's about to get busier than ever as people realize health starts in the home."Merry Maids has been around for 40 years and Service Master for 90 years of cleaning and disinfecting, we'll stay who we are and that has helped us sustain through the crisis, but come out of it on a stronger footing." 3118
