SAN DIEGO (KGTV) -- A tortoise no longer on the loose is still waiting for its rightful owner in East County.The tortoise, believed to be an older male, was found Thursday by Heartland Paramedics.It was roaming the streets of El Cajon and is now staying at the El Cajon Animal Shelter.Workers there say this is not a situation they often face.“Not in the City of El Cajon," said Shelter Manager Jill Jones. "Perhaps in outer-lying counties, they have a little more tortoise traffic, but we generally do not."A family who saw the original 10News story believed the tortoise was their beloved pet Frankie who went missing a week ago. However, upon arrival at the shelter, they quickly realized this tortoise was much larger.If you believe the tortoise is yours, you can go to the shelter during regular business hours. SAN DIEGO (KGTV) -- After years of setbacks and construction, part of One Paseo is getting ready to open its doors in Carmel Valley. The company behind the project plans to open the multi-concept development in phases, with the retail space scheduled to open first in the beginning of March. The residential area is set to open in the summer of 2019 with offices on the property following in 2020. The City Council approved the much larger original project in 2015, but it was overturned after opponents collected 60,000 signatures on a petition. Council members urged the project's developer, Kilroy Realty, and its opponents to reach a compromise.The downsized One Paseo project was approved by San Diego’s City Council 8-1 in mid 2016. She still has family trying to escape. She told 10News she understand that many will criticize U.S. military action. But she says - things have gotten so bad there, that they can't get much worse."I understand that there are many people who will be against it because fear of an attack on innocent people," she said. "But innocent people have been dying for the past eight years. So to us, especially the Kurds, this was a positive."Most of Salih's family has fled to Europe, trekking weeks at a time with little to eat."Everyday we're concerned that we're not going to hear from (my aunt) anymore, so every day that I hear her voice is a relief that they're still alive."Salih says she hopes her aunt will be able to come to the U.S. Someday.She also hopes that U.S. involvement will open the eyes of the rest of the world, making them realize that atrocities are happening in her home country. "I do appreciate being here," she said. "But I am concerned that a lot of people here don't know what's happening."Salih says she's studying political science in the U.S., hoping to one day make a political run and to work on issues like this. 1599

  

SAN DIEGO (KGTV) - A San Diego mother of four said she was fired from her job of nine years because she needed to keep working from home during the pandemic.According to a lawsuit filed by Taneasha Newsome, “Knowing Ms. Newsome required a work accommodation or a medical leave to care for a disabled child during the global pandemic that gripped the country in early 2020, Axos failed to attempt accommodating Ms. Newsome’s obvious need. Instead, Axos terminated her in order to rid itself of an employee who required accommodation.”The federal complaint filed last week against San Diego-based Axos Bank alleges associational disability discrimination and wrongful termination, failure to provide reasonable accommodations, and racial discrimination, among other things.Newsome said it was challenging before the pandemic to balance work and home obligations. She explained one of her children has attention deficit hyperactivity disorder and another is autistic.Newsome said when the stay at home order went into effect, schools closed, and she started working from home.“I was told basically, I’m supposed to use my breaks legally and my lunch to do what I need to do for the kids, which anyone who has kids knows that’s impossible,” she said. “You can’t put them on a schedule when they’re hungry or need to use the bathroom.”According to her lawsuit, in late March 2020, Axos began using a computer program to monitor its remote workforce.The lawsuit claims Axos knew the program “was unable to track certain aspects of employees’ workdays, which caused the system to erroneously underreport working hours for Ms. Newsome and others.” It stated Axos used the inaccurate reports, “to place Ms. Newsome and other employees on a performance improvement plan (PIP) on April 24, 2020 for lack of productivity, even though the reports did not accurately measure their full productivity.”“During that time, they say, ‘Hey the software isn’t properly tracking us, it’s not tracking our work,’” said Newsome’s attorney Alreen Haeggquist. “They ask questions to their managers of how does it track productive time and unproductive time. No answers are given.”According to the lawsuit, Axos demanded all teleworking employees return to full-time, in-office work on May 1, 2020. The lawsuit said employees that required a further teleworking arrangement were instructed to submit a formal request form that detailed their need for continued teleworking.“When Taneasha says, ‘Hey I need an accommodation. I need to keep working from home because of my children with special needs and what’s going on with them at home.’ They fire her based on those reports from over a month earlier,” Haeggquist said.According to the lawsuit, “Axos fired Ms. Newsome during a two-minute Zoom meeting with HR, claiming it was based on her lack of ‘productivity.’ Axos Bank fired Ms. Newsome, but not because of her performance. After interfering with Ms. Newsome’s right to take leave to care for her disabled family members, and otherwise failing to accommodate that need, Axos Bank fired Ms. Newsome because, as the mother of two disabled children, she needed to remain working from home, and the company thought she was too likely to be ‘distracted’ by the childcare obligations of her disabled children.”In a statement, a spokesperson for Axos Bank responded to the allegations writing, “Like most public companies, it is our policy not to comment on the specifics of pending litigation. With respect to this complaint, we can say the allegations are false and omit material facts, and we are confident we will prevail once these material facts are presented to the appropriate forum.”Newsome said things have been difficult since she lost her job.“We had to give up our apartment,” she said. “We now live with family, which I’ve never had to do. When I left home at 18, I stayed gone. So, this is my first time coming back home. It’s an adjustment for the kids, they’ve never not had their own.”Newsome’s lawsuit also alleges racial discrimination. It claims, “Axos discriminated against Ms. Newsome in compensation and in terms, conditions, and privileges of employment because of Ms. Newsome’s race. Based on information and belief, Axos paid Ms. Newsome less than her white counterparts, and the differential was not based on a bona fide factor, but rather, it was based on race.”As of this writing, the company has not yet responded to the allegations in court filings. 4461

  

SAN DIEGO (KGTV) -- A woman says she tried to save the life of a man found dead under a bridge this morning. He was released from the hospital just hours before police found his body in Hillcrest. There was something about a man at the hospital that stood out to Megen Murray. "For whatever reason, I don't know why he caught my eye," said Murray. "I just watched the orderly wheel him outside."He was discharged from Scripps Mercy Hospital Wednesday night. He was still wearing a hospital gown when he was found."It was just unnatural to see a man in a hospital gown, in a wheelchair, sitting on the street."Murray says she tried to get the hospital to help, but she says they wouldn't listen. "Yep, he's homeless, he has nowhere to go, we dismissed him, if he wants he can come back in and be seen again but that was it," said Murray.She then took it upon herself to make him comfortable. "I said, 'I have these blankets for you,' and he looked at me and gave me the biggest smile. And then I said, 'I only have  cash on me, so here's .' I told him to put it in his pocket and said 'I'm sorry I cant do more."'The hospital told 10News the man was healthy enough to be released and aware of his surroundings. Seven hours later he was found dead after tumbling from the Washington Street bridge. And it's not the first time a patient was discharged in hospital clothes. A video from Baltimore went viral in January that showed a woman, wobbling and confused, still wearing a gown and surgical mask. Homeless patients are often discharged after being treated with nowhere to go. A new California Senate?bill is trying to change that.?The bill would require hospitals to coordinate with shelters to make sure the patient is cared for after they're released. RELATED: New bill to end homeless "patient dumping""We need to be more compassionate," said Murray. "We have to see these people as people. They're people. It just ripped me to the core. I'm going through my mind with, "what we can do?" I'm glad to know that that bill is out there because it needs to be addressed.A spokesman couldn't comment on specifics for privacy reasons. They did say it's the hospital's practice to offer shelter and transportation resources to patients before they're released.  2331
