SAN DIEGO (KGTV) - Some in the legal community are raising concerns that in-person federal court cases are putting attorneys and their clients in unnecessary danger.A letter sent by the Federal Defenders of San Diego Executive Director Kathryn Nester to United States Senator Kamala Harris says since raising concerns back in March about COVID-19's impact on federal detainees and criminal cases, the risk to their clients and staff has increased.According to the letter, "The increased danger stems from escalating prosecutions and the reopening of in-person court proceedings in our district, despite escalating COVID-19 infections in local jails and communities. These prosecutions are occurring on an uneven playing field, as the pandemic is undermining our clients' constitutional rights to a speedy trial and to confidential communication with their lawyers."Nester claims the United States Attorney's Office has substantially increased new prosecutions over the past several weeks.In the letter she states, "The USAO is increasing prosecutions while simultaneously winding down its practice – instituted at the beginning of the pandemic – of issuing Notices to Appear instead of arresting and detaining many defendants. The result is a growing jail population, which increases the risk of COVID-19 transmission."Nester also cites concerns about the condition of local jails and what's described as lack of testing, reporting, and transparency at these facilities.She adds that the increasing prosecutions are against clients with reduced constitutional safeguards."Requiring detainees to quarantine for 14 days after each court appearance effectively precludes trials, because defendants cannot be brought to court on consecutive days. So the government will bring clients to court to plead guilty, but not to exercise their constitutional right to a speedy trial," Nester stated.The U.S. Attorney's Office said it has dramatically reduced the number of new criminal cases in response to the COVID-19 pandemic."The Southern District of California stakeholders – the District Court, the U.S. Attorney's Office, the defense bar, the U.S. Marshals Service, U.S. Pretrial Services, U.S. Probation and the Bureau of Prisons – have worked collaboratively over the past several months to adjust and deal with this unprecedented crisis," said U.S. Attorney Robert Brewer. "Ms. Nester's letter is an unfortunate and sad departure from that collaboration given that she omits key facts and presents an inaccurate, biased and incomplete picture of what's occurring in this district."In a written response to the Federal Defenders of San Diego, the United States Attorney wrote, "The assertion that the U.S. Attorney's Office has ‘reversed course’ and has ‘dramatically increased new prosecutions’ in July 2020 is incorrect. After the inmate was sentenced, we were informed that he had tested positive for the virus. Upon learning that information, our Court followed the recommended CDC guidelines for notifying all those who were present in the courtroom. It has now been several days since the incident and I am informed that no other person who was present and who was notified of the risk has experienced infection symptoms or has tested positive for COVID 19.”A spokesperson for Sen. Harris wrote, "The severe conditions that our incarcerated population have been facing during this pandemic are shocking, unacceptable, and must be addressed immediately. They say health concerns aside, the state has made getting into a field office to complete requirements impossible.Although many DMV tasks can be completed online, the agency requires an in-person visit for several types of service. Once drivers hit the age of 70, the DMV requires them to renew their licenses in-person to take vision and knowledge tests.The DMV has granted drivers aged 70 and up a four-month extension to renew licenses, but only for licenses that expire through July 31. But the DMV isn’t offering new appointments, as it works through the backlog of visits that were canceled during the months-long closure. The DMV is only accepting walk-ups for a handful for services, and not for seniors seeking license renewal.“It's ridiculous and I think the governor should do something,” she said.The agency has been opaque about when it will begin accepting new appointments. SAN DIEGO (KGTV) — Saturday, San Diego County reported a record 1,478 new coronavirus cases and six additional deaths, bringing the county's totals to 70,709 cases and 966 fatalities.Saturday's new cases yielded a 7% positivity rate out of 21,947 tests reported. The new daily case report marks the third time in a week that the county has reported more than 1,000 new cases. It was also the 11th-straight day the county reported at least 600 new cases.Eleven new community outbreaks were also confirmed on Friday: Three in business settings, three in faith-based settings, two in childcare settings, one in a TK-12 school setting, one in a restaurant/bar setting, and one in a gym setting. SAN DIEGO (KGTV) - Six people inside a minivan that drove down a flooded road near Fashion Valley mall were rescued Friday, according to a San Diego Fire-Rescue official. Avenida del Rio, a popular exit route for the mall south of Friars Road, was closed Thursday and Friday due to rising water levels in the San Diego River. A lifeguard river rescue crew was nearby, along with fire trucks. SAN DIEGO (KGTV) -- Steele Canyon High School is one of two evacuation sites run by the American Red Cross for people affected by the Valley Fire, but they're not housing people like they normally would. Instead, they're acting as a resource facility for families like the Roberts'."Mine was one of the only houses in the neighborhood that went up," Alana Roberts said. Her weekend was turned upside down when she got word of the Valley Fire, which went from 100 to more than 10,000 acres in less than 48 hours, claimed her home. "I was in Oceanside and we raced to get in and as soon as we were in our truck, cops said 'you need to go now'", Roberts recalled.She was able to gather just a few belongings. "It was me and my husband who went in and grabbed what we could and let animals free. I had chickens and I couldn’t get them all."And now, she's one of the dozens of people seeking relief and a place to sleep at one of American Red Cross' evacuation sites."Someone gave me dog food, food for the kids, and we have the restrooms so we can kind of wash up." These sites typically provide shelter for families seeking relief, this time around, they couldn't."Outdoor sheltering is basically what we’re doing, people are in the lots in their cars and are acquiring hotel vouchers to put people in lodging," said Earl Potts with the American Red Cross. So far, 60 people have received hotel vouchers but last night they ran out, forcing people like Roberts to hunker down in their cars, trailers, and RVs. "We figure the family will stay together, and hunker down together."The Red Cross said as the holiday weekend comes to an end, they're hoping to get at least 200 more rooms available. "We’re able to provide meals at certain times of day and a place to park and sleep which makes it less but more of a priority situation."Alana said she's just thankful her family is safe and is going to return to what's left of her home once they're given the go-ahead."I don’t know if its truly set in. This morning my husband made me coffee and I thought about my brand new coffee maker I got for Christmas. I get camping coffee to drink now, I don't think it's really set in." 2179
