SAN DIEGO, Calif. (KGTV) – A prominent harbor cruise company is continuing to operate despite being cited for violating a County health order. Tuesday afternoon, 10News took video of Flagship Cruises & Events taking passengers aboard for bay tours even after the company was cited by San Diego Harbor Police over the holiday weekend for violating the County's health order 14C which bans recreational boating unless all the passengers are from the same household. Tuesday, a company spokesperson sent the following statement to 10News.“We are part of the Passenger Vessel Association, not recreational boating. They are classifying us under a charter business which is still banned. We DO have a charter business but are not operating any charters at this time. Only public tours and maintaining all safety guidelines set by the city & CDC. We didn’t receive a cease & desist, and will continue to operate our harbor tours & patriot jet boat this week. We open up our dining cruises starting this Friday with Hops on the Harbor – pairing with local brewery, Pizza Port.”Monday night, the company told 10News it's part 14E of the County health order, not 14C. That section states in part, "other public or private outdoor recreational facilities (other than community pools per State order), including recreational equipment (such as bicycle, boat, kayak, equestrian and surfboard) rentals may be open for limited use."During Tuesday’s County press conference, Supervisor Nathan Fletcher told 10News, “The rental items that they're alluding [are for] individual use type things like a bicycle or a kayak or a surfboard and so they are not covered under the current public health order,” and added, “If they continue to operate, they are going to continue to be cited.”Harbor Police say the citation comes with a fine of up to ,000 and up to a year in jail. SAN DIEGO (KGTV) - A sailboat damaged the USS Midway Sunday.The mast of the sailboat collided with a safety net attachment on the front port-side ‘horn’ of the ship. The crash happened shortly after 2 p.m. according to Harbor Police.The mast of the sailboat snapped off. There was minor damage to the safety nets of the Midway.“I thought something fell off the flight line, I didn't think a boat would crash into the Midway,” said Craig Wiener, who was touring the Midway at the time of the crash. “We were looking out the little port windows, and you see the mast falling off into the water."Harbor patrol says no charges are expected and attributed the crash to inexperience on the part of the person steering the sailboat. Eight people were onboard the sailboat, and none of them were hurt.“He didn't realize how close he was and how tall his mast was and it was too late and the wind pulled him in,” Wiener said. 945

SAN FRANCISCO (AP) — A judge ordered California's attorney general to release police misconduct records predating Jan. 1, when new transparency legislation took effect.San Francisco Superior Court Judge Richard B. Ulmer, Jr. on Friday also rejected arguments by Attorney General Xavier Becerra that his office should not have to release records of local law enforcement.The legislation was designed to guarantee public access to disciplinary records involving investigations into officer shootings, use-of-force incidents and incidents involving officer misconduct.The tentative ruling was a win for the First Amendment Coalition and National Public Radio member KQED-FM, which sued Becerra's office for records under the legislation."Judge Ulmer's order sends the clear message that the Attorney General is not above California law," said David Snyder, the coalition's executive director.In response, Becerra's office said Friday it would release records from before 2019 but only those regarding Department of Justice officers. The office said in a statement that requiring the office to release records involving other departments "would result in duplication of efforts."The judge ordered the attorney general's office to meet with the coalition and KQED to work out the logistics of releasing records.Ulmer said the 1st District Court of Appeal had already decided that the law is retroactive. He also dismissed the argument that making the attorney general provide records of local law enforcement would be burdensome.Ulmer said lawmakers could not have been oblivious to the potential cost of carrying out the legislation, and "the people will likely be agnostic as to which tax-funded agency foots the bill." 1724
SAN DIEGO (KGTV) -- Thousands of refugees, immigrants and asylum seekers are finding a place to stay through the Safe Harbors Network, an organization which got its start at the Christ United Methodist Church in Normal Heights. Pastor Bill Jenkins began giving shelter to Haitian refugees back in 2009. And for quite a while the church was the only immigrant welcoming shelter in southern California. Eventually, the Safe Harbors Network was created. It's a growing collection of churches, organizations, and individuals that house refugees, immigrants and asylum seekers. Pastor Jenkins says he's seen an explosion of interest from people wanting to help in recent months after Trump's zero-tolerance immigration policy went into effect. Safe Harbors works in cooperation with ICE to give shelter to people awaiting their day in court. 886
SAN DIEGO, Calif. (KGTV) - A new rule from the California Air Resources Board could wind up costing San Diego MTS hundreds of millions of dollars.CARB announced a series of regulations last week, all aimed at making bus fleets more environmentally friendly.One rule says all buses need to be zero-emission by 2040.That could be costly.Right now, SDMTS uses Compressed Natural Gas in their buses, which they say burns much cleaner than diesel fuel.Those buses cost 7,000 each, and MTS buys about 50 new buses each year.New electric, zero-emission buses will cost about 2,000 each.Replacing the entire fleet with electric buses will cost 7.5 million more than CNG buses."The technology is relatively new, the costs are high right now," says MTS Spokesperson Rob Schupp. "I think CARB is looking into the future. As we encourage more and more manufacturers to build these buses, the costs will come down."San Diego MTS is already putting six electric buses in their fleet this summer as part of a pilot program.They'll use those to test how the electric buses operate across several terrains and distances in San Diego.They also received a grant to help buy 11 more for a South Bay Bus Rapid Transit line that will open in 3 years.Beyond that, MTS says they may use a combination of state funding, grants and possibly rate increases to pay for the new electric buses.Schupp says the state has plans to chip in about 0,000 per bus.The cost of new buses isn't the only concern about going electric.MTS says they need to look into how much electricity will cost compared to natural gas.They also may need to build and install charging stations around town, because the buses may not be able to go as far as they would using gas.Despite all that, Schupp says the MTS Board fully supports the change. 1812
