SAN DIEGO (KGTV) - Monday afternoon, the San Diego County Sheriff’s Department tweeted that convicted sex offender Cary Jay Smith has left San Diego County. The tweet added, “It is always our goal to keep our communities safe.”Smith had been staying at a motel around the 78 corridor which caused concern for North County community leaders. “I just don't feel good about this situation,” said Melanie Burkholder, candidate for CA State Assembly's 76th District. “This is a very sick individual. He does not need to be roaming the streets,” she said Monday morning.The Orange County District Attorney's Office says Smith claims to have killed three boys and molested 200 others.San Diego County Undersheriff Mike Barnett spoke to ABC10 News on Sunday night. “He liked to be referred to while he was in the state mental hospital as Mr. RTK, which is rape, torture, kill,” he said.It was last Tuesday when he said the CA Department of State Hospitals released Smith from Coalinga psychiatric facility without any restrictions under Megan's law, meaning he is not required to register as a sex offender.Deputies say he's served his time and is free to go where he wants.Before arriving in San Diego, the 59-year-old went to Orange, Corona and Lake Elsinore which sparked outrage in Los Angeles. In an effort to avoid any violence, San Diego deputies did not share his exact location but offered reassurance he was under 24-7 monitoring.The Orange County District Attorney's Office said Monday that its waiting for answers from the Governor’s Office as to why the state released him from the hospital and why the CA Attorney General's Office reportedly revoked his sex offender registration requirement in 2005.Monday, the Attorney General's Office referred ABC10 News to the Department of State Hospitals which said that it couldn't release information because of patient privacy laws. 1889

SAN DIEGO (KGTV) — Months after pricey photography equipment disappeared during a car burglary in Pacific Beach, the victim made a stunning discovery at an estate sale right in his own neighborhood.Near Pacific Beach Drive and Ingraham Street in February, Danny Desanti came out and found all the doors of his hatchback open. Desanti, a professional photographer, had loaded up the night before for an early morning shoot in Santa Barbara."Didn't want to wake up my baby, so I loaded items the night before ... huge loss for me," said Desanti.The loss was dozens of items and more than ,000 worth of missing equipment, painful for a small business owner."Since then, I've been slowly buying the stuff back and renting the gear," said Desanti.Nine months later, Desanti saw a sign for an estate sale less than a block from his home. The sale was taking place at a house of an elderly man he had never met.He stopped by and after some browsing inside, something caught his eye. He looked around and saw a lighting clamp which looked very familiar. That's when he peered in for a closer look."My heart skipped a beat. Couldn't believe it. Absolutely shocked," said Desanti.Written on the clamp was his last name. The clamp was stolen during the car break-in. He says he continued to browse and found a handful of other items that were taken, including cables and reflectors."Got goosebumps. The hair on back of neck stood up," said Desanti.After he ran back home to get his police report, the company handling the estate sale let him have stuff back. Most of his stolen equipment has yet to be recovered. "Anybody would bought any lighting equipment at the estate sale, I would really appreciate it if you would get in touch with me," said Desanti.The questions linger. SAN DIEGO (KGTV) -- Opponents of  San Diego's new short-term rental regulations are accusing the city council of violating the Brown Act when it passed the new rules earlier this month. A letter drafted by an attorney on behalf of Air B and B, Home Away and Share San Diego was sent to the council Monday. It alleges the council violated the law when it made significant changes to the original proposal up for approval and then voted without allowing for more public comment. What they passed would essentially ban people from renting out anything other than their primary residence or a guesthouse on their property. The opponents are asking the council to hold another hearing. The city council is scheduled to hear a second reading of the short-term rental regulations Wednesday, August 1.  852

SAN DIEGO (KGTV) — One man is dead and three people have been detained for questioning after a reported shooting overnight in Paradise Hills.San Diego Police arrived at a home in the 6200 block of Childs Avenue just after 1 a.m. Saturday over reports of a shooting. Officers arrived to find a 20-year-old, later identified as Tyshawn Powell, lying in the driveway of the home and a family member performing CPR.Fire-Rescue arrived to continue life-saving measures, but the man was pronounced dead at the scene.Police said the man had been shot at least once. Neighbors were interviewed about the reported gunshots in the area and as a result, an adult male and female, and a juvenile male were detained. According to police, Angelo Roshon Richardson Jr., 19, and Mikayla Ann Castillo, 18, as well as a 17-year-old were detained. Richardson was booked into jail for murder and being a felon in possession of a firearm while Castillo was booked into jail for being an accessory to murder. SAN DIEGO (KGTV) - One CHP officer is dead, two were injured in a shootout in Riverside Monday and one CHP officer was injured in El Cajon by a hit-and-run drunk driver Tuesday night. CHP is now examining their protocols, seeing if there are lessons to be learned from Riverside.10News spoke with a veteran CHP officer to find out what protocol is in place to protect officers.Veteran CHP officer Phil Konstantin dedicated a decade to the force and has many stories to tell. "Crashed into by vehicles, I've had to jump out of the way of vehicles, and I've been shot at," he said.Around 10:30 p.m. Tuesday night a CHP officer was trying to remove debris from the 94 freeway when officers say a man drove into the center divide multiple times. The officer tried to wave the man down and was hit. The man drove away and was stopped a short time later.He was driving 13 mph in the shoulder with his hood obscuring the windshield. Our 10News Breaking News Tracker recorded the driver stumbling during his field sobriety test. The man was arrested for DUI.His girlfriend drove to the scene and was also arrested for DUI.Konstantin says a traffic stop is one of the most dangerous parts of their job.He said when they pull a car over, officers turn their wheels away from the shoulder so if their car is hit, it rolls into traffic instead of into the car the officer pulled over or the officer. He also said he kept a vigilant eye on the people in the car and on traffic."All of the sudden if I lose sight of you and you're jumping into the car very quickly, are you going for a gun like with what happened in Riverside?" He said being vigilant will save your life.In 1987 Konstantin's training was put to the test. "As soon as the car stopped moving someone got out of the passenger side and shot at us.'' He and his partner were working the graveyard shift and pulled over what they thought was a drunk driver. It turned out being a pair who had kidnapped a restaurant owner they robbed and they were trying to go to the man's home to ransack it."The guy aims at the car in general and then at someone who would've been standing by the driver's side door. Has I been standing at the driver's side door, I would've been hit by buckshot," he said staying in the car and ducking saved his life.He said any driver can help an officer by keeping their hands on the wheel, listening to an officer's directions, and telling an officer if they need to reach somewhere to get their license, so they don't think you will harm them. 2524
