SAN FRANCISCO (AP) — An appeals court has rejected a former Stanford University swimmer's bid for a new trial and upheld his sexual assault conviction.The three-judge panel of the 6th District Court of Appeal ruled unanimously Wednesday that Brock Turner received a fair trial.A San Jose jury in 2016 convicted Turner of sexually assaulting a young, intoxicated woman outside an on-campus fraternity party.Judge Aaron Persky rejected a prosecutor's demand for a lengthy prison term and instead sentenced him to six months in jail. Turner appealed the conviction, arguing he didn't receive a fair trial.Persky's sentence sparked nationwide outrage by those who felt it too lenient. (KGTV) - The warmest ocean temperatures on record are making things interesting for San Diego’s fishermen.Local fisherman say they are seeing more game fish closer to the coast than even before.“2018 is a season that has been off the charts,” said Frank Ursitti, the owner of H & M Landing.Scientists recorded ocean temperatures at more than 80 degrees last week.Ursitti says his tours are lining in more dorado, yellowtail, yellowfin and bluefin this time of year than usual. “Often time times anglers or recreational fisherman will have to venture 8 to 15 days at seas for certain kinds of fish,” said Ursitti, “but now some of anglers are venturing just 12 hours offshore for the fish of a lifetime.”Fisherman Magnum Scuro says they have all noticed the warmer waters, but he is curious for what may be it consequences next year.“There are some negative things that can happen with the warm water - it can kill the kelp,” said Scuro, “ (the) hot water is going to expose a lot of areas where there hasn’t been kelp so we can get to it, but there’s going to be be a lot of kelp that’s going to be gone.” 1151
SAN DIEGO, Calif. (KGTV) - It started as a thesis project and now is a tool for any musician in the world to use. Dr. Chris Warren is an Assistant Professor of Digital Composition and Sound Design at San Diego State University and said “Echo Thief” started about ten years ago and is a project he’s been growing ever since. He’s been traveling around North America and using an acoustic measurement tool to gather and capture sound in different types of acoustic environments. His personal addition to the recording field is creating a way to capture sound in noisy environments. Typically, the reverb of a space can only be captured when it’s silent, like in a church. However, he has created a way do it in a loud area, like capturing the sound of being under a bridge even if there are cars driving by. He’s been using the library and plug-in with his audio production students. Then Kayla Gautereaux, a former SDSU student who is now on the faculty at the New England Conservatory, came to him and asked the audio pro if there would be a way for musicians to use his tool for their practice. Warren then created an easy-to-use website for anyone to play music or sing, and have it sound like they’re in a variety of locations. “We were able to take the sounds from around North America, a bunch of fascinating acoustic spaces, and make reverberators out them so people can virtually perform in these spaces,” he said. Gautereaux said she can now sit in her living room and sing, but it sounds like she’s somewhere else. “It feels like you’re there not just because the app has a picture there, but because you can hear the response of your voice or whatever instrument you play into that space,” she said. She also added that the space a musician performs inside is just as important as an instrument or vocals, so this is a welcome addition to the music world. 1873
San Diego shipbuilder General Dynamics NASSCO has notified nearly 1,500 workers that they could be out of a job next month. The shipbuilder, however, says it anticipates letting go of closer to 350 workers. NASSCO says the layoffs are related to a dry dock accident in July that caused damaged to its facilities, although the workers union president says other factors are at play.“We are pursuing all available options to avoid or lessen the impact of these reductions and hope to increase our workforce as soon as possible to support work expected in 2019,” NASSCO president Kevin Graney said in a layoff notice to the state. Robert Godinez, who heads the Boilermakers Union Local 1998, said the number of potential layoffs is high because NASSCO uses an evaluation system to guide which workers it lays off. Those with the lowest evaluation are out first, and that can change with training.Godinez said he expects the layoffs to last about four to six months until NASSCO can fix its dry dock. "If they lay off 400, 500, 600, 700, that should cover that notification requirement," he said. The layoffs come after NASSCO held a large hiring fair in April, as it looked to add 800 to 1,000 new welders and shipbuilders.However, Godinez said the shipbuilder did not hire even close to that number. He said Navy repair work fizzled and that a construction project got set back. Additionally, a union newsletter mailed before the accident reported 48 workers had been laid off - a number too low to trigger a WARN public notice. “People weren't ready for this, they weren't ready for the layoff,” Godinez said. “They were walking into the shipyard, they were watching these humongous banners that they’re going to be hiring like crazy and everyone’s on the upswing, and all of a sudden the layoffs start.”At the time of the accident, the fire department said a barrier that keeps water from going into the ship collapsed, leading to a flood. No one was hurt. Godinez said 4 million gallons of water rushed in and hit a 70,000 ton ship. That damage is delaying the next order, leading to the potential layoffs.NASSCO spokesman Dennis DuBard pinned the layoffs to the July 11 incident, and said the company is working to remedy the situation. 10News has since inquired about issues related to the April hiring event. “We are working diligently so not all employees who were notified will be affected. We regret the impact this will have on employees and their families,” DuBard said. “The company has arranged a variety of programs and resources to assist those who will be affected.”Godinez said the union would be working to arrange for additional training for workers who could be laid off, so they can find new jobs. 3023
SAN DIEGO, Calif. — For months, we’ve seen face masks in places they shouldn’t be: storm drains, streets, beaches, and parks.Now, we’re learning just how many could be flooding our oceans.“Once plastic enters the marine environment, it’s very difficult to move," said Dr. Teale Phelps Bondaroff, director of research for OceansAsia. The marine conservation group has been tracking the number of face masks washing up on a remote island south of Hong Kong since the pandemic started. “About six weeks after COVID hit Hong Kong, so late February, we began finding masks, and lots of masks," said Bondaroff. “What’s remarkable is we weren’t finding face masks before COVID.”Masks are made with polypropylene, which Bondaroff describes as thin fibers of plastic."The fact that we are starting to find masks that are breaking up indicates that this is a real problem, that microplastics are being produced by masks," he said.These tiny pieces of plastic can remain in the ocean for hundreds of years, threatening fish and even polluting the air.“The question that we couldn’t answer was how many are entering our oceans? We just didn’t know," said Dr. Bondaroff. OceansAsia launched a study to find the answer and recently shared its findings. Of the estimated 52 billion masks manufactured globally in 2020, it's believed 1.56 billion will enter our oceans this year, resulting in an additional 4,680 to 6,240 metric tonnes of marine plastic pollutionBondaroff says the report used a conservative loss rate of 3 percent, and the average weight of 3 to 4 grams for a single-use polypropylene surgical face mask, to arrive at the estimate.“The 1.56 billion face masks that have entered our oceans in 2020 are there for the long run. They will remain in the ocean for 450 years or more, and they’ll break into smaller pieces.”The report notes global sales of face masks surged from around 0 million in 2019 to 6 billion in 2020.“That’s important, we need to keep people safe, but at the same time that has a lasting impact on our environment, and we’re seeing that on the beaches," said Bondaroff. And he says, unfortunately, this problem makes up only a small fraction of the plastic pollution invading our oceans.The report asks people to wear reusable masks whenever possible, dispose of masks responsibly and reduce their overall consumption of single-use plastic. It also calls on governments to:Implement policies designed to encourage the use of reusable masks, such as releasing guidelines regarding the proper manufacture and use of reusable masks.Foster innovation and the development of sustainable alternatives to single-use plastic masks.Discourage littering by increasing fines, and educate the public about responsible ways to dispose of masks.Repair and improve waste management systems to reduce losses and spillage. 2840
