SAN DIEGO (CNS) - A Clairemont woman who fired a shot through the front door of her next-door neighbors' apartment after they complained about loud noises and yelling coming from her unit was sentenced today to 16 years in state prison.Brittany Lefler, 37, was convicted in May of four counts of assault with a semiautomatic firearm and one count each of making a criminal threat, shooting at an inhabited dwelling and child endangerment.Superior Court Judge Joan Weber said the defendant's addiction to alcohol led to the terrifying events of Dec. 29, 2016."This is a woman who really tried to kill people,'' the judge said. ``Alcohol led her to that.''Deputy Alternate Public Defender Gilson Gray unsuccessfully argued for a lesser sentence, calling Lefler's actions "significant recklessness'' while stressing that one shot was fired.PREVIOUS REPORT: Topless Clairemont suspect in custody after 8-hour standoffBut Deputy District Attorney Michael Reilly said Lefler pointed a gun in the face of one of her neighbors when he opened the door, saying, "I've got my finger on the trigger.''Reilly said one of the victims grabbed her 11-year-old daughter from behind the door just before Lefler fired the shot.Had Lefler fired a few seconds earlier, she might have been looking at first-degree murder, the judge told the defendant."You gave control of your life to alcohol,'' Weber told Lefler. ``Can you believe you're capable of trying to kill people?''A tearful Lefler apologized to the four victims, who were not in court for the sentencing hearing."I'm truly sorry for putting your whole family in danger,'' she said.Lefler vowed to get help for her alcoholism "so something like this doesn't happen again.''During the trial, Reilly said Lefler had been drinking and was "out of control'' and "verbally abusive'' after Erick Morales called police about 1 a.m.Morales and her roommates told police that Lefler kept banging on the wall and screaming in her apartment on Beadnell Way.When officers responded, Lefler wanted to know who called the police on her, according to body-worn camera evidence.Morales' 19-year-old son said at one point he went outside and asked Lefler to "keep it down,'' but she reached into her boot and pulled out what looked like a gun and he ran back inside."She (Lefler) said, 'C'mon outside, I'll bust a cap in you,''' Henry Molina testified.The witness said he had overheard Lefler telling police that she kept a gun for "things like this.''After he shut the door around 5 a.m., Molina testified that he heard another bang and his mother said, "She's shooting! She's shooting!,'' referring to Lefler.Reilly told the jury that Lefler pointed her gun at everyone in Morales' apartment -- including her boyfriend, 11-year-old daughter and son -- before pulling the trigger."She (Lefler) did it on purpose,'' the prosecutor said. "In a moment of anger and fury, she shot through that front door. Ms. Lefler sent a message with a bullet through that front door. She can't do that!''Gray told the jury that Lefler called 911 multiple times that night, but police did not help her.Lefler was home alone, scared and outnumbered by her complaining neighbors, Gray said. He told the jury that Lefler was ``practicing'' pole dancing inside her residence.Both sides were yelling at each other and Lefler fired the shot accidentally when a door suddenly slammed, according to Gray. 3408

For those in the market to buy, the lower rates come just as San Diego will enter the spring peak homebuying season. Realtor Michelle Silverman said the higher rates could make the market tighter, but that homes still need to be priced appropriately."A seller can't be greedy," said Silverman, of Coldwell Banker. "If you have a greedy seller, the house is going to stay on the market. If the property is priced right, you're going to get multiple offers, maybe even go above list price, and it will move. It will sell."The rate drop comes after the Federal Reserve lowered its key Federal Funds Rate by 0.5 percent earlier this week in an emergency action. SAN DIEGO — A new political ad is pushing a proposition it says will eliminate a "tax penalty" on homeowners whose homes burn down in wildfires.That measure, Proposition 19, would allow homeowners who lose their homes in a wildfire or natural disaster to transfer their property tax base to a replacement home anywhere in the state. That's important because in California, homeowners pay their property tax based on the value of a home when they buy it, under 1978's Prop 13. It only increases incrementally after. Therefore, buying a new home could cause a family's property tax bill to skyrocket. A new ad released by the Yes on 19 campaign, funded largely by the California Association of Realtors and California Firefighters Association, emphasizes that point. "It limits property taxes on wildfire victims, so families can move to a replacement home without a tax penalty," the ad says. Truth be Told, the benefit currently exists in California, but only in the county where a governor-declared disaster happened, or counties that accept transfers, which San Diego County only began doing two years ago. Prop 19 opens it to the whole state. Anurag Mehrotra, a professor of finance in San Diego State University's School of Business, said being unable to transfer the property tax basis does equate to a tax penalty."The person did not light his own house on fire, he was continuing to live there. I lost my house, now I have to buy a more expensive house," he said. "And when I get reassessed I'm basically going to be charged a higher amount." Proposition 19 does more than just allow the transfer for wildfire victims. It also allows up to three property tax base transfers for homeowners 55 and older, and those who are severely disabled. They can use it for any property, anywhere in the state. Another change, however, is that inherited properties are reassessed unless the recipient uses it as his or her primary home. Currently, heirs benefit because the property tax base transfers with the property, making for a big tax break. Under the proposition, there would be an adjustment upward, no matter the situation, if a market value of a home is above million. 2184

  

SAN DIEGO (CNS and KGTV) - The San Diego City Council Tuesday approved a code amendment that prohibits housing discrimination against applicants using Section 8 vouchers or other rent substitutes. The proposed code amendment blocks landlords from rejecting applicants based solely on voucher status, though they would still retain a right, based on other rental criteria, to choose residents who don't use subsidies.Studies have found that prohibiting income-based discrimination leads to increased neighborhood options for residents and decreased segregation.“Hearing from the community was very powerful and I am happy that the Council approved the ordinance to end housing discrimination taking place in San Diego,” said Councilmember Georgette Gómez. “This is one step towards helping increase access to affordable housing for all San Diegans.”Local California governments with such provisions include Berkeley, Corte Madera, East Palo Alto, Foster City, Marin County, San Francisco, Santa Clara County, Santa Monica and Woodland.San Diego's proposed ordinance also establishes a landlord contingency fund for property damage or lost rent related to renters with vouchers.Implementation of the proposal is expected to take two years. Year one focuses on voluntary compliance as well as landlord outreach and education of the potential benefits of renting to Section 8 users, including consistent on-time rent payments, long-term tenancies, flexible leases and background checks.Year two introduces investigation and enforcement services.More than 15,000 low-income households receive Section 8 assistance through the San Diego Housing Commission. That breaks down to 36,478 individuals, 86 percent being people of color.In June, the San Diego City Council's Smart Growth and Land Use Committee advanced the ordinance to the council with no recommendation through a split 2-2 vote. SALTON SEA, Calif. (KGTV) - Four years ago a 10News crew traveled to Bombay Beach on the eastern side of the Salton Sea. This once thriving resort community is littered with abandoned homes and some of the 200 plus residents who still live there struggle to get out. People like the man who would only identify himself as “Bucky.”"We own two houses. We can't replace what we have into them,” says Bucky.  “Basically we're stuck. Me and my wife talked about it a couple of weeks ago I said, 'You know we're gonna die here.'"Bucky is like so many who call the Salton Sea home. They feel forgotten, hopeless, and helpless. In 2003 California Legislators promised to restore the dying sea and its vital ecosystem with almost -billion. But that promise, like so many others since, was broken to the people who live here.But two years ago Governor Jerry Brown allocated a mere -million in an attempt to avoid an enormous environmental disaster. That may seem like a lot of money, but as Senator Ben Hueso, whose district encompasses the Salton Sea explains, “-million is a drop in the bucket” for a problem of this size.        So, four years later our 10News crew decided to return to the Salton Sea to see how residents who live there are managing their lives and what that -million is being used for. We were surprised to find not much has changed. In fact, very little money has been spent, the situation is rapidly getting worse, and the people who live there fear more broken promises.There is no denying the Salton Sea is disappearing."This is the water line previously,” says Tony May who owns several houses near the shoreline in Salton City.May points to the back edge of his yard and down to a dusty beach below where water from the Salton Sea used to lap up on his property.“It was right here as of 1993,” explains May smiling remembering a time when the property was right on the water.Today the water line is no less than 300 yards away and separated by a dusty playa scattered with dead fish and a foul-smelling body of water that once was a prime resort for fishing and waterskiing.  And, it's only getting worse. The sea is shrinking more rapidly now that flows from the Colorado River were officially cut off at the beginning of 2018. Within years thousands of acres of seabed, like that behind Tony May’s home will be exposed. The waterfront property is now only a dream to May, the boat docks are entirely useless, and 300 yards of seabed that used to be 10 feet underwater, are now just a dusty beach. Playa that according to the Salton Sea Authority contains toxic chemicals like selenium, arsenic, and DDT. Tony and many others who live and work here, claim the dust from that dry beach is what's causing their respiratory issues."They can't breathe anymore, they're getting asthma,” says May.  “They never had asthma. I talk to the employees in town and they say the more that sea dries out the more it effects our health."The Salton Sea will never return to its riviera prime. The concern now is not so much saving the sea, but instead averting disaster by creating wetlands to control the dust storms.“Because it's a major problem. It's a very big problem," says Senator Ben Hueso from California’s 40th District and home to the Salton Sea.Senator Hueso has been fighting an uphill battle for this region for almost a decade."What is going to happen should this sea begin to dry up? We're going to see that exacerbate," says Hueso. "Right now Imperial County has cities with the poorest air quality in the country. Highest asthma rates in the country. The price tag of doing nothing to fix the Salton Sea is going to be costlier than actually putting some resource into fixing it."The price tag has always been a problem for the Salton Sea dating back 15 years. State officials promised to restore the Sea in 2003 with .9-billion. That promise, like many others for this region, was broken.In 2016 a mere million was allotted by Governor Brown in his budget, with promises of millions more to come. -million of that money would go towards staff and consultants to fix the Salton Sea. The remaining -million would go to actual construction. But two years later only million has been spent on staff and consultants according to Bruce Wilcox who is Assistant Secretary and an Ecologist with the Salton Sea Policy. Not a dime has been spent on construction of wetlands to mitigate the blowing dust. "This is the old marina.  And probably this is one of the most visually enticing places to see how far the water has receded," says Frank Ruiz with Audobon California looking over a desolate landscape that was once the thriving Salton City Marina.Ruiz’ job is to monitor the migratory birds who travel through the Salton Sea along the Pacific Flyway which stretches from Alaska to Patagonia at the southernmost tip of South America, shared by Argentina and Chile. "We should not wait until the crisis is on top of us. Because then the cost of inaction will be way too high,” adds Ruiz.A study conducted by the Pacific Institute estimates the cost of doing nothing with the Salton Sea could reach as little as -billion if nothing is done and possibly as much as -billion. Ruiz has watched the sea recede for years and says he fears the growth of respiratory issues, not just for those who live in this region but eventually as far away as San Diego. He's also witnessed a massive decline of migratory birds, which play a huge role in the ecology of the region."I think birds and wildlife are good indicators of how good or how bad your environment is. If the birds go, if the wildlife go, we will go next."If that’s true, as Senator Hueso mentioned, that -million absolutely will be a drop in the bucket. 5836
