SAN DIEGO (KGTV) - An oft-deported immigrant who was charged in a DUI, hit-and-run crash that injured a young boy in the South Bay will not be tried for the third time.A judge ruled Friday to dismiss the case against 39-year-old Constantino Banda Acosta. Banda was charged with driving under the influence and fleeing the scene of a hit-and-run on Camino de la Plaza in San Ysidro on May 6, 2017.Investigators said Banda ran a stop sign and crashed his pickup truck into the Lake family’s Honda Accord, as they were heading home from Disneyland. SAN DIEGO (KGTV) -- America’s Finest City ranked high on a new list of best cities for jobs in 2019, according to WalletHub. San Diego ranked 28th out of 182 cities overall. Chula Vista also made the list, coming in 123rd place. According to the report, the national unemployment rate has fallen to an 18-year low of just 3.7 percent, while hiring also is up. College graduates are also beginning to see the benefits of the strong job market. According to the National Association of Colleges and Employers, employers plan to hire 16.6 percent more members from the class of 2019 compared to the previous year. Though San Diego secured a strong spot on the list, many cities ranked higher. SAN DIEGO (KGTV) -- A woman says she tried to save the life of a man found dead under a bridge this morning. He was released from the hospital just hours before police found his body in Hillcrest. There was something about a man at the hospital that stood out to Megen Murray. "For whatever reason, I don't know why he caught my eye," said Murray. "I just watched the orderly wheel him outside."He was discharged from Scripps Mercy Hospital Wednesday night. He was still wearing a hospital gown when he was found."It was just unnatural to see a man in a hospital gown, in a wheelchair, sitting on the street."Murray says she tried to get the hospital to help, but she says they wouldn't listen. "Yep, he's homeless, he has nowhere to go, we dismissed him, if he wants he can come back in and be seen again but that was it," said Murray.She then took it upon herself to make him comfortable. "I said, 'I have these blankets for you,' and he looked at me and gave me the biggest smile. And then I said, 'I only have  cash on me, so here's .' I told him to put it in his pocket and said 'I'm sorry I cant do more."'The hospital told 10News the man was healthy enough to be released and aware of his surroundings. Seven hours later he was found dead after tumbling from the Washington Street bridge. And it's not the first time a patient was discharged in hospital clothes. A video from Baltimore went viral in January that showed a woman, wobbling and confused, still wearing a gown and surgical mask. Homeless patients are often discharged after being treated with nowhere to go. A new California Senate?bill is trying to change that.?The bill would require hospitals to coordinate with shelters to make sure the patient is cared for after they're released. RELATED: New bill to end homeless "patient dumping""We need to be more compassionate," said Murray. "We have to see these people as people. They're people. It just ripped me to the core. I'm going through my mind with, "what we can do?" I'm glad to know that that bill is out there because it needs to be addressed.A spokesman couldn't comment on specifics for privacy reasons. SAN DIEGO (KGTV) - A San Diego woman says she was the victim of a violent attack inside her hotel room at the high-end Omni La Costa Resort and Spa in Carlsbad.In an exclusive interview with 10News, Jacquee Renna is accusing the front desk staff of handing out her room number and a key without her permission. The hotel is staying tight-lipped with 10News about the apparent security breach, but it's giving details to the courts."I haven't felt safe since then," Renna tells Team 10 Investigative Reporter Jennifer Kastner. "Suddenly, I heard the door kind of jiggle and I thought [room service] was coming to get our plates," she explains. She and her boyfriend were finishing dinner inside their hotel room when she says her ex-husband was able to unlock the door and break through the security latch."I saw the key in his hands so he had the key," she tells us. "He threw me over onto the bed. I could see rage in his face."Court documents claim her ex-husband punched her boyfriend in the face, dragged him at least twenty feet and kicked him in the head. Renna says her ex-husband then ran out to the parking lot, where he apparently slashed her boyfriend's tires, before leaving."[My boyfriend] had bruises and scrapes. I think we were both really in shock," she says. "The Omni has a responsibility to provide safe and secure rooms to their guests," says her attorney, Robert Fitzpatrick. He's helping her sue the hotel chain for negligence.Renna says that after the attack, the hotel manager apologized to her and said the hotel's front desk person had given the key to her ex-husband. Fitzpatrick adds, "Omni should never have given a key to the hotel room and they should have not disclosed the hotel room number."Hotel room attacks are uncommon but have made headlines in Southern California.Earlier this year, Covina police say security video caught a pastor lurking outside a Los Angeles hotel room, touching himself as he watched two girls who were alone inside. Officers report he later forced his way into the room and assaulted an 11-year-old. He was charged, but has pleaded "not guilty".Disturbing 2014 security video out of Kern County captured a front desk worker handing a room key to a man accused of posing as a female guest's boyfriend, before he reportedly fumbled with the room's peep hole, went inside, and sexually assaulted the woman while she was sleeping. He's seen running out with his pants around his ankles. He was convicted and a jury found that the hotel was partially responsible for the assault.It begs the question, who is responsible for making sure hotels in San Diego are keeping guests safe? To get answers, Team10 spoke to the San Diego Hotel-Motel Association, the San Diego Tourism Authority, local hotel negligence attorneys and private security professionals. None of them knew of any local, state or federal authority that has oversight. Hotels are left to police themselves. The Omni Hotel chain denied our request for an interview to discuss the new lawsuit, citing that it doesn't talk about pending litigation. SAN DIEGO (KGTV) - A teacher at a middle school in Vista says a look inside her classroom reveals her concerns about the lack of social distancing.Laura Whitehouse’s classroom at Rancho Minerva Middle school. The history teacher has been at the school for seven years, and for the first time, she is anxious about going to school."It’s frightening. It’s frightening," said Whitehouse.She says her fears stem from the lack of social distancing. Her classes have 34 kids, with two kids sitting at each table right next to each other."Distance between each table is about two feet. They’re just on top of each other," said Whitehouse.Whitehouse says the kids are supposed to wear masks, but she sometimes has to remind them to put their masks on, and to maintain social distance."They want to clump together. They want to go to each other’s desk," said Whitehouse.After a few days of in-person learning, Whitehouse on Tuesday received plexiglass for her desk and a HEPA air purifier, but she worries it’s not close to being enough. She says there’s no cleaning between classes, as new students rotate in."The germs that are accumulating are just crazy," said Whitehouse.Amid her concerns, there have been at least four positive COVID-19 cases in the Vista Unified School District, sparking new rules about what will trigger a school to revert to distance learning.Whitehouse, who has asthma, says the new rules don’t address what’s putting her and her students most at risk."I am afraid for them. I just want them and their families to be healthy," said Whitehouse.She’s hoping for more cleaning, and more hybrid learning to reduce the number of kids in the classroom."The fear is this is just going to continue to get worse," said Whitehouse.The teachers union tells ABC 10News they are preparing an OSHA complaint detailing the classroom conditions. Superintendent of Schools Matt Doyle emailed ABC 10News the following statement:"... We have spent more than 2 million dollars on personal protective equipment for our staff and schools. These include facemasks, face shields, gloves, plexiglass barriers for teachers and students, HEPA air filters, additional outside sinks, electrostatic disinfecting machines, posters, and more. Every teacher has been given these supplies ... We will continue to work proactively with teachers and staff to make sure that they get what they need in their classrooms." 2410
