SAN DIEGO (CNS) - The county's flu death toll inched closer to 70 last week, while lab-confirmed flu cases continued to decline, the county's Health and Human Services announced today.The county received one report of a flu-related death last week, a 74-year-old North County man who had additional medical issues. County health officials did not disclose whether he had received this flu season's vaccine. The county's flu death toll now sits at 68.The county confirmed 86 flu cases last week, down from 114 cases during the prior week. Confirmed flu cases have declined for six consecutive weeks since reaching a season-high of 692 in mid-March. County health officials have now confirmed 9,373 flu cases to date this season."Flu activity in the region continues to wane, but it is still elevated for this time of year,'' said Dr. Wilma Wooten, the county's public health officer.While flu season appears to be wrapping up, county health officials and the Centers for Disease Control and Prevention still strongly advise the annual flu vaccination for everyone 6 months and older, especially in demographics with a heightened risk of serious complications, such as pregnant women, people older than 65 and people with chronic conditions.Flu shots are available at doctors' offices, retail pharmacies, community clinics and the county's public health centers. SAN DIEGO (CNS) - Parole was granted Wednesday for the man who killed a 20-year-old college student and pizza deliveryman in 1995 when he was a 14-year-old gang member.Tony Hicks, now 37, was the first youth in California to be tried as an adult under a law adopted in 1995 that allowed juveniles as young as 14 to be tried as adults for murder. He pleaded guilty to first-degree murder in the death of Tariq Khamisa and was sentenced to 25 years to life in prison. He has served 23 years behind bars.Wednesday's decision, made by the state parole board, now goes to the governor's office for possible approval.Gov. Jerry Brown recently signed Senate Bill 1391, which eliminates the ability to try a defendant under the age of 16 as an adult for any violent crime. Those convicted under the new law will be held in locked juvenile facilities instead of adult prisons."If this law (SB 1391) had been in effect in 1995, Tony (Hicks) would have been prosecuted in Juvenile Court and paroled many years ago,'' said Azim Khamisa, the victim's father. ``The other two individuals involved in the crime were sentenced in Juvenile Court. Tony made a mistake. He has atoned for it in many ways. He has paid his debt to society. It is time for him to be it in many ways. He has paid his debt to society. SAN DIEGO (CNS) - Testimony wrapped up Friday in the trial of a North Carolina man accused of raping and murdering a 79-year-old woman in her Normal Heights home more than three decades ago.Kevin Thomas Ford, 63, is charged with murder and a special- circumstance allegation of murder during a rape in connection with the May 20, 1987, death of Grace Hayden.Ford is accused of strangling the victim. SAN DIEGO (CNS) - San Diego-based medical technology company Phamatech and its CEO have agreed to pay more than million to resolve allegations that they submitted false claims to Medicare and received government reimbursements for unnecessary lab testing, the U.S. Attorney's Office said Friday.Prosecutors allege the company paid kickbacks to a medical clinic, which in return ordered Phamatech lab testing for its patients enrolled in Medicare.Over the course of about two years, Phamatech, which manufactures diagnostic devices and provides lab testing services such as drug and alcohol tests, paid a per-specimen fee to Imperial Valley Wellness in exchange for referrals of urine samples from Medicare beneficiaries, according to the U.S. Attorney's Office.Many of the samples referred to Phamatech were not necessary and thus ineligible for Medicare reimbursement, prosecutors said.The company, along with its CEO and founder Tuan Pham, agreed to pay ,043,484 to settle allegations that Phamatech violated the federal Anti- Kickback Statute and the False Claims Act.The U.S. Attorney's Office said the allegations were originally brought in a lawsuit filed by former Phamatech employee John Polanco, who will receive 7,392 from the settlement proceeds. 1273

SAN DIEGO (CNS) - Testimony wrapped up Wednesday in the murder trial of two men accused in the stabbing death of a Chula Vista music producer whose body was found in a drum floating in San Diego Bay.Timothy John Cook, 54, is charged with the Sept. 30, 2017, murder of his housemate Omar Medina, 28. Somerville alleged that a barrel matching the one containing Medina's body can be seen in the bed of the pickup in the footage.She also said a search of the McIntosh Street home yielded additional indications that Cook was covering up the murder, such as removal of his home's kitchen sink and stripping down Medina's room, which was located in an attached building on the property.Oien said Cook was merely fixing up the home, and that he had an agreement with his landlord to make occasional repairs in exchange for lower rent.Spurgeon's attorney, Roland Haddad, said there was no evidence that his client had any knowledge that he was assisting Cook in disposing a body, if Cook even committed the murder at all. The men exchanged phone calls on Oct. 11, but Haddad said there was no evidence regarding what discussions they had over the phone, nor what was said on the alleged boat ride when Medina's body was dumped into the water. 4095
