SAN DIEGO (KGTV) -- The family of the man killed in a wrong-way crash on Interstate 5 Monday morning says the California Highway Patrol got it wrong. According to them, their brother - Justin Callahan - was a driver, but not the driver who caused the crash. RELATED: Driver killed, 2 hurt in wrong-way crash on I-5On Monday CHP told 10News the following: Just before 2 a.m. Monday, a Volkswagon Jetta was traveling eastbound in the westbound lanes of Inerstate 8 from Sunset Cliffs Boulevard. As CHP officers responded, the Jetta entered the northbound Interstate 5 transition ramp to the westbound I-8 in the wrong direction and collided head-on with a Toyota Camry.An SUV then crashed into the back of the Camry, the CHP said.The driver of the Jetta was 35-year-old Justin Callahan, who was declared dead at the scene. Justin's family says he usually drives home from work at the time and would have been traveling in the opposite direction - from Chula Vista to his home in Ocean Beach. Based on that information, they tell 10News the CHP's report just doesn't add up. "It doesn't make any sense," his brother, Tommy Villafranca, said. "Why would he get back on the freeway and get back the opposite direction?"And if Callahan did turn around and got back on the freeway, the timing doesn't add up, his brother said. He says his work caught on security video leaving at 1:38 a.m. and the crash happened less than 20 minutes later."It takes 21 minutes just to get from his work to Sunset Cliffs Boulevard," Villafranca said. "He’s still got to turn around go back, and that would take even more time, so the timeline is not working at all."The family has created a GoFundMe to help them pay for arrangements necessary to get Callahan back to Wheatland, California and arrange a funeral. "Justin was an artist and an inspiration to the people around him," James O'Callahan wrote on the GoFundMe page. "At this point I am too broken up inside to write anything worth reading. SAN DIEGO (KGTV) - The elderly victim of a brutal home invasion in Clairemont last week is relieved two of the three suspects are in custody. John Slobig, 59 and Terry Jones, 53 are due in court Wednesday afternoon in connection with last Wednesday's home invasion in the 4600 block of Firestone Street.Eighty-seven-year-old Paul Schmidt suffered injuries to his head, arms, and wrist during the attack. "I was very grateful for the work that the police did, " said Schmidt. Schmidt said he's lived in the home for fifty-three years and never felt unsafe. "I know that drugs have been so dominant in our society lately that it's a whole different world that we're living in. Things we used to take for granted, you can't anymore," said Schmidt. Schmidt was installing a ceiling fan when he says three men burst through his front door."All of a sudden, these three guys come in and said this is a robbery and he grabbed scissors and walked up to me and said don't mess with us. I didn't want to die that day, and there was three. I'm one guy, I'm 87, I'm not as tough as I used to be," said Schmidt. He tried to pull one of the intruders by his beard, that's when Schmidt says one of the robbers hit him over the head with a ceiling fan blade."The one guy was higher than a kite; the one they have in custody, he was really a terrible person." Police say the trio ransacked the home and took off in the victim's truck, which was recovered. The suspects have lengthy criminal records. Researchers estimate Americans will spend more than 0 billion in retail this year, which means they need to staff seasonal workers ahead of the shopping rush. Macy’s announced they are looking for 80,000 seasonal workers. The Gap Company will hire 65,000 people. Target plans to add 120,000 seasonal team members this year, up 20% from last year. In San Diego County alone, Target plans to add 1,200 people to their staff this season. “I’m going full time at SDSU, and I knew that I was definitely looking for some work,” Elizabeth Gonzalez said. 10News Gonzalez at the Mission Valley Target’s hiring fair Saturday morning. She is hoping to spend her winter break as a Target sales associate.“I just needed some extra cash just to pay the bills,” Gonzalez said. SAN DIEGO (KGTV) -- The Border Patrol is working to upgrade the fence that sits along the U.S.-Mexico border as more and more people attempt to cut through the barrier, forcing agents to spend time making repairs.According to the agency, an average of 540 cuts are made in the fence per year. Border Patrol says some tools enable crossers to cut through the fence in as little as 20 seconds.The agency added that, since 2016, the number of arrests at the border has seen a sharp increase. In 2016, 26,000 arrests were made. SAN DIEGO (KGTV) - The brand new Continental Apartment complex in Little Italy isn't like its upscale neighbors.It's made up of studios, some smaller than 400 square feet, and offers very little parking. That's why the starting rent is "just" ,550 a month, about 35 percent below market for the trendy area. "The rent is high in San Diego because of simple math - supply and demand," said Jonathan Segal, the architect who designed The Continental.Segal says costly approval delays and fees are contributing to that very supply crunch. The Continental, no exception, was delayed for two years. Segal says he paid almost million in fees for the building. But he's specifically perplexed by how the city charges what are called Developer Impact Fees. The money goes to uses like parks, fire, library and transportation.The city charges as much as ,000 per unit, depending on location, not size. That's why the city fee on developers could be disproportionately impacting rent prices for smaller units. In other words, if a developer takes a building and creates 40 apartments, that developer would have to pay that fee 40 times. Alternatively, if that same developers takes that same building and does just one large unit, that developer only pays the fee once. Now, there's a growing push at City Hall to change how the city calculates the impact fee. This week, a city council committee held a preliminary discussion on the fee's future. One option, endorsed by City Councilman Scott Sherman, is to do it by square foot. That way, building more, smaller units won't increase costs on developers - and ultimately renters or buyers. "If you were to do it by a square foot process, then a developer would come in and say, 'you know what? I can build two units at 0,000, instead of one at 0,000,'" Sherman said. A 2016 report from the housing commission said flat fees create a disincentive for developers to create more, smaller units that could help ease the housing crunch. Segal says changing how the fee is calculated could give him more latitude to offer lower rents. "I may be able to reduce my rent because I want to be more aggressive," he said.
