SAN DIEGO (KGTV) - A man fell to his death from state Route 125 in the Bonita area Tuesday morning after a crash in which his car struck and killed a deer on the freeway.Friends told 10News the victim was Martin Lapisch, 44, a Chula Vista resident who is survived by his wife, Linda, and 15-month-old son Kenneth. He was a German immigrant who became a U.S. citizen in 2003, friends said.“He was a new dad with big dreams, whose life was cut short after a terrible, early morning accident," said a close friend of the victim. “He was a loving father, husband, brother and an awesome friend. He always helped people in need and never asked anything in return," said Lapisch's friend Peter Kritzko.Friends and family gathered together after the incident at Lapisch's home and spoke with 10News but asked not to be identified at this time.California Highway Patrol Sgt. Steve Jio said they received reports just before 4:45 a.m. of a car that hit a deer and then stalled on northbound SR-125 just before the transition to state Route 54.Jio said responding officers and fire crews arrived to find the car in the No. 2 lane abandoned with the dead deer in front of it. 1207

SAN DIEGO (KGTV) — A man who is accused of falling asleep drunk with a lit cigarette, starting a Rancho Bernardo fire that killed his two children in 2017, has been sentenced to nearly 13 years in prison.Henry Lopez was convicted last September of involuntary manslaughter, child endangerment, and recklessly starting the fire that killed 7-year-old Isabella and 10-year-old Cristos.Wednesday, victim impact statements were read aloud — including a statement by Lopez — before the judge sentenced Lopez to 12 years and eight months behind bars.“[The] defendant has completely and utterly failed to accept the consequences of his actions. These horrible deaths were completely avoidable. The defendants actions caused a lot of pain. Christo’s and Isabella should both be with us today," the judge said during sentencing.RELATED: Rancho Bernardo mom opens up about children killed in fireThe fire sparked on Oct. 28, 2017 at the North County condominium. Prosecutors say Lopez fell asleep with a lit cigarette that likely made contact with a defective cell phone, sparking the blaze. Lopez woke up to find his home on fire and tried to escape but passed out from the smoke, fire investigators said. His two children died in the blaze. Investigators say Cristos was burned to death and Isabella passed out from smoke inhalation and never woke up.Throughout the sentencing hearing Wednesday, heated moments erupted from Lopez's ex-wife and even one of the jurors."I told you if you continued on this path of reckless behavior something bad was going to happen. And guess what, it did," Nikia Lopez said. "Those kids are gone. You took my children." 1651

SAN DIEGO (KGTV) -- A project for improving trails and restoring habitat with native vegetation at Sunset Cliffs Natural Park has some residents concerned. “They’re destroying where I grew up," resident Mike White told 10News. "They’re destroying my play ground, you know?” 286

SAN DIEGO (KGTV) — A judge has issued a temporary restraining order against the City of San Diego, barring them from removing pepper trees in Kensington. The trees are more than 100 years old, planted when the neighborhood was first marketed as a housing development in the early 1910s. While the neighborhood was once filled with them, resident Maggie McCann estimates there are only about 33 left.“I think they are pretty looking,” said McCann. “They’re part of the fabric of the neighborhood.”McCann was one of the residents who filed the TRO against the city. She said she has been working for more than a year to designate the remaining pepper trees as “Heritage Trees” and “Parkway Resource Trees” under the City’s Conserve-a-Tree program. When she heard a pepper tree on the 4500 block of Edgeware Road had been cut down on Monday, she rushed to process the TRO.“We don’t know why these trees are being cut down,” said McCann.McCann suggested it may be related to a plan to bury SDGE utility lines in the neighborhood, but the City of San Diego denies that claim. In a statement to 10News, a city spokesperson said the tree that was cut down Monday had been “evaluated more than a year ago as part of a project to repair a damaged and uneven sidewalk caused by the tree’s growth. Noticeable decay and deteriorating tree structure were also observed during the evaluation and the adjacent property owner was notified at that time.”On Tuesday, the remnants of the trunk remained on Edgeware Rd. Decay could be seen in the interior part of the tree, though much of the large trunk appeared to be healthy.“The tree really didn’t need to be removed,” argued McCann. But the city said their decision was more about damage to the sidewalk than whether the tree could have survived a few more decades.“In this instance, the imperative to make the sidewalk safer for residents was weighed against the city’s desire to preserve neighborhood trees and continue to grow our urban canopy. Due to the tree’s damaging impact to the adjacent sidewalk and its decaying state, the decision was made to remove it in order to preserve public safety,” wrote the city spokesperson.A resident on the block said the sidewalk had been recently replaced. The new pavement had been cut around the tree and was undamaged.Several other pepper trees in Kensington have been marked for removal. On Tuesday, McCann walked the streets, posting copies of the TRO on the trees. The fate of those trees remains unknown. A city spokesperson said, “the city looks forward to working with the community and Council office on this matter.” A court hearing on the TRO is scheduled for Feb. 7. 2661

Police say 49-year-old Lusean Arline was arrested November 4th in connection with the alleged October 27th sexual assault at the Balboa Nursing & Rehab Center on Fourth Ave.Prosecutors say Arline entered the nursing home, possibly through an unlocked door, around 3 that morning and was found completely nude on top of the victim in her bed.
