San Diego (KGTV) - Thousands of kids across California approved for in-home nursing care are struggling to get the help they desperately need.On Thursday two children filed a class-action lawsuit against the California Department of Health Care Services and its director claiming the state has failed to fulfill its commitment to provide them with sufficient Medi-Cal in-home nursing services.It says, “this class action lawsuit asks the Court to order Defendants to take all steps necessary to arrange for previously-approved, medically necessary in-home shift nursing services for Plaintiffs and Class members.”According to the lawsuit plaintiff, Ivory N. is a seven-year-old and a Medi-Cal beneficiary. It says the child needs 63 hours per week of skilled nursing at home but only receives about 56 hours per week.The non-profit group, Disability Rights California, says more than 4,000 Medi-Cal eligible children have been approved by the state to receive Medi-Cal in-home nursing care, but the state lacks an effective system for arranging for needed nursing."It’s too bad that a lawsuit had to be filed, but they are right to file it because right now that need is not being met,” said California State Assemblyman Brian Maienschein.In 2017 Maienschein tried to get the problem fixed through legislation. He believes the state is not following through on its promises to the kids.“It was a significant victory last year that we were able to get money in the budget, but they are still not following through on the promises they made,” he said.According to a news release from Disability Rights California, “29 percent of authorized Medi-Cal nursing hours go unstaffed.” 1693

SAN DIEGO (KGTV) -- Wednesday afternoon, San Diego tribal leaders announced the closures of county casinos amid the coronavirus outbreak. Tribal government leaders of the Barona Band of Mission Indians, Campo Kemeyaay Nation, Jamul Indian Village, Sycuan Band of the Kumeyaay Nation, and Viejas Band of Kumeyaay Indians all announced that they were closing casinos amid COVID-19. "The Tribes are united in this decision to close for the health and well-being of the community, their guests and approximately 9,000 employees. Despite this closure, it is their hope that they can continue to provide emergency services for their respective communities," officials said. SAN DIEGO (KGTV) -- When professors at San Diego City College weren't prepping for fall semester, they were getting in on a little TikTok action thanks to English professor Christy Ball."I watched a lot of TikTok this summer, I fell in love with all the silliness in America and I really needed it when all the bad news was coming and coming," Ball said.She teamed up with 30 of her colleagues "to let students know we understand this isn't the ideal learning environment but that we believe in them, and we are so committed to their success and we're going to work with them the whole way." Together, they created a 2-minute TikTok-inspired clip with messages like "We're in this together," "You're not alone," and "We are listening."The video's editor and SDCC English professor Kevin Gossett said, "Putting something out like this is a good reminder that we're ready for this. We've been doing months and months of training in so many different ways just for this moment to support you."Gossett said it took a few weeks to edit the video but the hardest part was teaching writers how to TikTok."I did zoom recording sessions where I was walking them step-by-step. SAN DIEGO (KGTV) - Two San Diego area residents are asking the area's top two prosecutors to investigate and prosecute Assemblymember Todd Gloria for alleged violations of the Political Reform Act. According to a letter sent to San Diego County District Attorney Summer Stephan and San Diego City Attorney Mara Elliot, Kathryn Burton and Mat Wahlstrom allege Gloria "repeatedly violated PRA section 85200 by soliciting and receiving multiple contributions to his Assembly 2020 Committee before filing a statement of intent to run for the Assembly in 2020." The letter says, "without filing that statement, the FPPC's manual makes clear, he could not lawfully receive any funds into his Assembly 2020 Committee." The letter goes on to read, "my clients have reason to believe that there is a conspiracy to launder campaign money from an illegal campaign committee controlled by Mr. Gloria to the San Diego County Democratic Party, to a candidate to replace Mr. Gloria in the Assembly, and to several sitting members of the Assembly." According to the California Secretary of State's website, before raising any campaign funds, state candidates file "Statements of Intention" to run for a specific office. Candidates can file Statements of Intention for more than one office. Team 10 obtained Gloria's signed statement of intention, which shows the state received it on August 13, 2019. That's after the campaign committee was opened and filed a Recipient Committee Campaign Statement. Officials with the California Fair Political Practices Commission tell 10News the Assemblymember called FPPC Enforcement earlier this week and self-reported. Enforcement is determining the appropriate action moving forward. Team 10 reached out to Gloria's campaign, but as of this writing has not heard back.In a Tweet sent Wednesday Gloria wrote, "Some news reports have suggested that I am seeking re-election to the Assembly. I want to be very clear: I am not running for the Assembly, I am running for Mayor. My Assembly committee remains open to fulfill my responsibilities as a Member of the State Assembly until the end of my current term. The form filed by my committee yesterday (August 13th) simply corrected and administrative oversight that occurred when the original paperwork was filed months ago." A spokesperson for the District Attorney says they have received the letter but cannot confirm the existence of any potential investigation that may result. A spokesperson for the City Attorney tells 10News their office has received the letter from attorney David Kenney and is reviewing it. The allegations were first reported by La Prensa. 2777
