SAN DIEGO (KGTV) — A San Diego veteran is suing 3M Company alleging earplugs he wore while in the military were defective. He’s the latest in a series of lawsuits that have been filed against the company by service members across the country.Kevin Alicie filed a lawsuit on Wednesday claiming he “used Defendant’s dangerously defective Dual-ended Combat Arms? earplugs during tank firing, training firing, other live fire training, vehicle maintenance, and during other training and combat exercises.” According to the lawsuit Alicie wore the earplugs while at Camp Pendleton and was first diagnosed with hearing loss in California. Alicie tells 10News during his military carrier he started having problems with his hearing. He’d hear ringing. He says he didn’t think much about it until the ringing started to become more frequent.“I mentioned it to the doctor when I was doing my final physical, and sure enough when they did that last hearing test they found that there was hearing loss,” Alicie said.The lawsuit says 3M did not inform the military or Alicie that the earplugs were defective and failed to adequately warn that the earplugs did not meet the military’s sound requirements."The biggest defect is they don't do what they are advertised to do,” said Alicie’s attorney John Gomez. “Essentially they are supposed to protect your ears and your hearing in proximity to loud sounds that can cause hearing loss or damage.”Attorney John Gomez says the earplugs were standard issue in certain branches of the military between 2003 and 2015.“Without question, I think tons of users-consumers and potential victims reside right here in San Diego County,” Gomez said.According to a July 2018 press release from the United States Department of Justice, 3M agreed to pay .1 million to resolve allegations that it supplied the United States with defective dual-ended combat arms earplugs.The release says, “the United States alleged that 3M, and its predecessor, Aearo Technologies, Inc., knew the CAEv2 was too short for proper insertion into users’ ears and that the earplugs could loosen imperceptibly and therefore did not perform well for certain individuals. SAN DIEGO (KGTV) -- A San Diego man whose bike was stolen, decided to track the thief himself. But instead of turning him in, he turned the situation into something positive. Rob Greenfield never thought he'd see his bamboo bike again. “I didn’t lock it because I was sitting 20 feet from it and then I heard a noise and I looked back and saw the guy speeding off into the night with it.” When he found the thief, he didn't turn him in. He pulled him in for a hug, forgave him and took his bike back.  “It’s one of a kind bamboo bike but really what makes it special is that I’ve biked across the United States on it doing good deeds," he said. "So I’ve traveled thousands of miles across the country.” The theft made him want to do more good deeds, right here in San Diego. “I decided that rather than turning that into a really negative situation I would turn it into a positive situation," he said. "Knowing the feeling of having a bike stolen I decided I wanted to give bikes to kids who have had their bikes stolen and can’t afford a new one.” Greenfield started a GoFundMe to raise money for bikes. Bikes that he would then donate to the Boys and Girls Club - to kids whose bikes were stolen. He says it's a lesson in kindness that he hopes the thief who took his bike, and the kids who were given bikes, will pass on.“I can crowd out the bad with lots of good. At just 16-years-old, many teens today couldn't think of doing so.Alexa Mendes said she knew she had to cut the cord after recognizing that she was addicted to the likes, shares, and interactions online."It is difficult enough to try and manage our overwhelming lives already filled with extracurriculars, sports teams, clubs, honors societies, difficult classes, insane amounts of homework, the pressures of applying to prestigious universities, and an abundance of other expectations," Mendes writes. "On top of that, we are always thinking about our online profiles."So she curbed her online presence back. In doing so, she learned a lot and turned those lessons into a book: #Unsubscribed: How I am thriving in high school without social media (and you can, too)."It wasn't that difficult. It's something I'm passionate about since it's part of my life and my experience and story to tell," Mendes said.Now, Mendes' message isn't that teens should drop social media entirely. Instead, she hopes her story can help others strike a healthy balance."Over time, I realized that the key wasn’t to abolish my usage completely--it was all about becoming balanced and finding a way to use social media in moderation," she writes. SAN DIEGO (KGTV) - An old airport terminal turned innovation lab hopes to ultimately improve the customer experience at San Diego International Airport (SAN).The second group of innovators has begun the 16-week accelerator program to "field test" and develop their concepts in a real-world airport environment.The Innovation Lab was launched to reduce barriers for innovators to break into the aviation industry. Its goals are to develop concepts that can enhance the passenger experience, improve operational efficiency, increase revenues and/or decrease costs. The 3,500-square-foot space offers a functional mini-terminal area with ticket counters and a bag claim carousel, all without passenger or security concerns to work around."We wanted to provide a location where we could invite innovators in to test their solutions," said Rebecca Bloomfield, spokesperson for SAN. Jon Wisner, Director of Business Development & Partnerships at HOHM Inc., says they've already gotten good feedback on a sleeping pod they hope to bring to airports. "What we are trying to validate is the best usage for the pod - whether it be used for a nap, lactation room, or privacy just in general, meditation, prayer," said Wisner. The pods are currently being tested by airport staff. SAN DIEGO (KGTV) - An oft-deported immigrant who was charged in a DUI, hit-and-run crash that injured a young boy in the South Bay will not be tried for the third time.A judge ruled Friday to dismiss the case against 39-year-old Constantino Banda Acosta. Banda was charged with driving under the influence and fleeing the scene of a hit-and-run on Camino de la Plaza in San Ysidro on May 6, 2017.Investigators said Banda ran a stop sign and crashed his pickup truck into the Lake family’s Honda Accord, as they were heading home from Disneyland.
