CARLSBAD (KGTV) -- A slope in Carlsbad is moving, affecting a senior community on top of it. The question of who is responsible for paying to fix it has the City of Carlsbad battling with those who live in Camino Hills.“It’s been a tremendously stressful experience for everyone,” said Mike Perry, who has lived in Camino Hills since 2001. Joe Matthews has called the Camino Hills community his home for about 19 years. “We have lunch out here, sometimes dinner,” Matthews said, as he showed Team 10 the front patio area where he relaxes with his wife. “The grandkids come visit.”“It’s a really wonderful community,” Mathews added. What he did not know was something was going on beneath the surface. “It came as a real surprise,” Matthews said. According to court documents filed by the Camino Hills Homeowners Association in 2018, the City of Carlsbad noticed damage to the pavement and sidewalk right by Camino Hills Drive back in 2007. In January 2009, a geotechnical firm placed devices in the slope to track the movement. There was more slope movement detected during the El Ni?o rainstorms from 2016 and 2017.To fix the issue, it could cost anywhere from 0,000 to about million, according to Elizabeth French. French represents the Camino Hills Homeowners Association. She said the city did not fix the problem properly in the first place. “The city actually knew that there was an ancient landslide at this location and rather than make the developer make a more expensive repair, they allowed the developer to put in a subsurface buttress made of soil, but in recognition that that wasn’t the best repair,” French said. She said when this community was being built, the City of Carlsbad entered an agreement with the developer of Camino Hills. In the indemnity agreement, French said it required the developer to fix any problems for up to 10 years after the community was built. Camino Hills was built in the mid-1980s and the developer is now out of business. French said the city is now asking the residents of Camino Hills to foot the bill.“There’s nothing in this association’s government documents alerting any of the prospective purchasers that there’s this enormous liability out there, that they could be tasked with addressing down the road and that kind of notice is required in the law,” French said.Joanne Stout’s modular home is right by Camino Hills Drive. “This is it. This is where I’m going to be until they carry me out of here,” Stout said. However, if residents are forced to pay for street repairs, she would have to sell.“I would be one of the ones that would have to leave and that would make me very sad,” Stout said.Nobody with the City of Carlsbad would agree to an on-camera interview. CARLSBAD, Calif. (KGTV -- It's an historic gem in Carlsbad. Some of Hollywood's biggest stars of the 1930's would gather for a here for a relaxing get away from Los Angeles. A vacation home to Leo Carrillo from the TV show "The Cisco Kid." Once a massive ranch, now transformed into an 1800 acre city park in Carlsbad. Mick Calarco, Project Manager with the City of Carlsad calls the park a "manifestation of Carrillo's childhood dreams." Million- dollar homes now surround the park, but it was once a sprawling and working ranch with livestock and wild animals. Peacocks still roam the property, original descendants of the birds Carrillo bought for the ranch."You can truly lose yourself out here," said Calarco. The old adobe buildings have been beautifully restored to their original splendor. Carrillo bought the property in 1937. His famous friends, including Clark Gable would often visit the ranch. In every building you can see Carrillo's vision for preserving early ranch architecture. Adobe was a central theme in Leo's remembrance of of his childhood ranches. After Carrillo's daughter, Tony, left the estate, the buildings began to fall apart. The City of Carlsbad acquired the remaining 10.5-acre ranch in 1977. It now serves as a park to educate and advocate for ranch preservation and restoration. The park is open daily 9 A.M.- 5 p.m. 1359

  

CARSLBAD, Calif. (KGTV) -- If there's anyone in Carlsbad that knows food, it Cheri Poulos. Poulos is the founder of Carlsbad Food Tours, a tour that gives locals and tourists a taste of the city. Poulos has a blog where she writes about the best places to eat in the city. The food lover offers two different types of tours, one called the Taste of Carlsbad and one called the Indulgence Food tour. Private tours are also available. 10News went along with Poulos for one of the food tours. The first stop was at Gregorio's Italian Kitchen, known for giving back to the community. At one point, the restaurant donated all of their proceeds to the Boys and Girls Club. From Gregorio's the tour continued to Caldo Pomodoro, home to what some call the best garlic bread in the county. Portraits of Caldo Pomodoro's owners hang over the entrance of the restaurant. The restaurant's founders are a borther and sister duo, Fran and Gina. Fran was a Hollywood hairdresser and pictures of his clients adorn the walls of the restaurant. Fran has since passed away, his sister Gina now runs the restuarant. The tour also includes some stops at several sweet spots, including a gourmet donut shop called, The Goods. The Goods is the sister restaurant of Cafe Topes, a staple in town known for their cinnamon rolls. Both locations are run by the Barille family. The tour then continues to Gelato Love, a family-run gelato shop. The shop is owned by Paola Richard and her cousin, Christina. Gelato Love is the only shop in the entire country that doesn't use any added sugar, only sugar from the fruit itself. The tour also stops at other local favorites like Vigilucci's Gourmet Market, Witch Creek Winery and Humble Olive Oils. The tour operates daily, seven days a week. CARLSBAD, Calif. (KGTV) - The family of an 18-year-old man shot and killed in Carlsbad last July says they’re upset with the sentence handed down for the man who supplied the gun in the shooting.Connor Mangseth is described by family as someone who lived life to the fullest, inspiring those around him to do the same. His mother said he would befriend anyone, no matter their background, and that’s what led to his death this year. On July 23, Connor went to the home of a friend and 19-year-old Gerardo Gonzales, another friend, was also present. Gonzalez was already facing felony charges for another crime and was out on bail.RELATED: Teen girl, young man arrested in Carlsbad shooting deathGerardo had a gun, which he gave to a 16-year-old female who was also with them. She said she thought it was empty when she pulled the trigger, but there was a bullet inside, which struck and killed Connor. Connor’s sister said it’s what happened next that deserves justice.“The worst part is the things that happened after that. It was that Gerardo Gonzales and this minor left to go hide the gun, they created a false story involving two other gunman and they spent 20 minutes doing this instead of anyone calling 911 or getting help,” said Sabrina Mangseth.Gerardo was charged with Accessory After the Fact and Child Endangerment. The Mangseth family said they are angry at the court system for how they handled these charges. Connor’s mother, Maureen, said they got silence from the District Attorney’s office, then she got a call saying Gerardo had taken a plea deal, something she was not told about ahead of time. She said she feels like the prosecutor was trying to rush the case rather than find justice, adding that to her knowledge, investigators have not completed their investigation and have more evidence to review.Sabrina started an online petition to bring awareness to the lack of communication during the case, gathering more than 6,000 signatures. A description in the petition describes Connor’s passion for life and the family’s desire for the court to take back the plea deal and wait to make any decisions until all evidence has been gathered.Ultimately, a second prosecutor was brought in to handle the case, but the guilty plea remained. Wednesday, Gerardo was sentenced to probation and up to one year in jail. Maureen said it doesn’t look likely that he’ll serve jail time. Sabrina did add that the second prosecutor did a better job of communicating with their family.“Gerardo Gonzales himself, in the trial, said Connor was my best friend and for him to do that to his best friend, I can’t even imagine what he would do to a stranger, someone else,” said Sabrina, worried about the lack of punishment for Gerardo.When asked for a response to the sentencing and plea deal, a spokesperson for the District Attorney’s office said: “This is obviously a tragic case and we have been in very close contact with the victim's family in recent weeks as we continue to seek justice for their loss. Two defendants were charged in connection with this murder. The defendant who is not the actual killer pleaded guilty to both counts he was charged with, including Accessory After the Fact and Child Endangerment, with an agreement from the People that there would be no opposition to a local jail sentence. The second defendant, a minor, remains charged with murder."The 16-year-old who pulled the trigger is facing murder charges and is next expected in court Nov. 9, 2020. 3495
