NEW YORK -- A suspended NYPD officer is now facing criminal charges after using an apparent chokehold during a now-viral arrest in Queens last Sunday.Officer David Afanador has been charged with attempted aggravated strangulation and strangulation in the second degree, Queens District Attorney Melinda Katz said Thursday.The 39-year-old cop, who has a history of complaints against him, was arrested and booked at his own Queens precinct just after 9 a.m. Thursday, according to police.If convicted, Afanador faces up to seven years in prison, the DA's office said.DA Katz acknowledged that body-camera footage shows the officers being cursed at and badgered before the incident. Nintendo has filed a lawsuit against an Arizona man after the video game giant claims he operated two websites "built almost entirely on the brazen and mass-scale infringement of Nintendo's intellectual property rights," according to court documents.The lawsuit, filed July 19 in Arizona U.S. District Court, claims Jacob Mathias and his company, Mathias Designs, L.L.C, operated 'LoveROMs.com' and 'LoveRetro.co' — websites lawyers for Nintendo say "are among the most open and notorious online hubs for pirated video games."The company claims Mathias posted thousands of Nintendo games on the sites that were downloadable as files — known as "ROMs" — and playable on phones or computers through software referred to as emulators. In court documents, the company's lawyers said Mathias uploaded an instructional video to YouTube explaining how to download and run the games.Nintendo estimates its titles were illegally downloaded from the sites by more than 60 million people.The company is seeking 0,000 for each infringement of its copyrighted work and up to ,000,000 for each infringement of the Nintendo trademark. NEW YORK (AP and KGTV) — Sears is closing 80 more stores, including six locations in San Diego, as it teeters on the brink of liquidation.The iconic retailer, once the nation's largest department store chain, set a deadline of Friday for bids for its remaining stores to avert closing down completely.Sears has not received any bids as of Friday afternoon.The retailer that began out as a mail order catalog in the 1880s has been in a slow death spiral, hobbled by the Great Recession and then overwhelmed by rivals both down the street and across the internet.The 80 stores are due to close by March. That's in addition to 182 stores already slated for closure, including 142 by the end of 2108 and 40 by February. The company filed for Chapter 11 bankruptcy protection in October , saying at the time it would close more than 20 percent of all stores, keeping open only its 500 most profitable locations.Sears Holdings Corp., which also runs Kmart, joins the list of retail brands taken over by hedge funds that collapsed under the weight of debt forced upon them.Under hedge fund manager Eddie Lampert, Sears has bought time by spinning off stores and putting on the block the brands that had grown synonymous with the company, such as Craftsman. Newly released dash cam video shows a drunk driver talking with police officers just minutes before he got back into his car, drove off and then collided head-on with a woman, killing them both.The incident happened December 30, 2017.Testing would later determined that Desten Houge's blood alcohol level was nearly three times the legal limit.The video show the aftermath of a single car accident, where Houge lost control and then ended up in the ditch. That accident happened around 4 p.m.Pittsfield Township Sgt. Matthew Hornbeck can be seen talking with Houge and then helping him up after he fell down.Hornbeck would call a tow truck to get the 32-year-old Houge's car out of the ditch. The driver discovered the rear sway bar was busted, but the car was still drivable.Hornbeck and another police officer would clear the scene, but they did not give Houge a field sobriety test.Roughly an hour later and another 1,000 feet down Michigan Avenue, witnesses reported seeing Houge's car fishtailing, then crossing the center line, slamming into another vehicle driven by 55-year-old Lake Jacobson, who died four days later of injuries suffered in the crash.In police reports obtained by Scripps station WXYZ in Detroit, witnesses describe being surprised by the speed Houge was driving, considering he was losing control.Another witness, who swerved to miss Houge, said they saw car parts flying before the collision.The reports cite car condition and a possible collision with a pothole as a factor in the crash. However, those reports were from before Houge's autopsy came back, establishing he had a BAC of .24, as well as THC in his system.Both Hornbeck and the other officer who helped Houge before the fatal accident said they did not notice any signs of impairment.WXYZ was unable to reach Pittsfield Township Police for comment.
