SAN DIEGO (CNS) - Mayor Kevin Faulconer today signed an emergency executive order that allows restaurants throughout the city to operate outside effective immediately.Notable parts of the order include allowing restaurants to establish sidewalk cafes and use private parking lots for dining.Restaurants must still comply with county and state ordinances, including following ADA requirements for sidewalk cafes. Businesses also can’t have live music or allow customers to vape.Indoor dining will be closed for at least the next three weeks after the county remained on the state's monitoring list for three consecutive days, leading all indoor operations to be halted at a variety of businesses, including restaurants, where county health officials say many of the recent outbreaks occurred.RELATED: San Diego to close some businesses as COVID-19 cases spikeLast month, Faulconer proposed waiving fees and permits to allow businesses to expand into parking lots, sidewalks and on-street parking spaces, a move intended to maximize social distancing for employees and customers by stretching operations into outdoor spaces.In a statement announcing the executive order, Faulconer said, "Given that the state's new shutdown order has an immediate impact on local businesses, this action will provide relief while the city is finalizing a new ordinance for council approval that will cut fees and streamline permits to make it easier for businesses to operate outdoors."The San Diego City Council is expected to consider an ordinance regarding the permit regulations at a meeting next week.“It will reduce fees, it will wave and streamline permits,” said Faulconer. “It will allow for outdoor dining plazas, and it will allow businesses, in addition to operating in parking lots and sidewalks, to safely expand operations into on-street parking.”“It’s really a lifesaver for these businesses,” said Benjamin Nicholls, the Executive Director of the Hillcrest Business Association. “I’m hearing relief, I’m hearing that the mayor turned out to be the partner that the restaurant community wanted him to be.”Nicholls has been pushing the city also to allow dining in parking lanes. Vaus plans to use funding from the CARES Act to purchase the tables.Vaus added that no permits will be required to use the tables on sidewalks or in private parking lots and that they are expected to be distributed this week.Once restaurants are finished using them, the tables will be moved to local parks in Poway.“I think this is kind of a no brainer win-win type of situation I would love to see more picnic tables in our parks eventually, and so that's a great thing. SAN DIEGO (CNS) - A would-be carjacker who didn't know how to drive a stick shift was foiled when he tried to steal a car with a manual transmission in San Diego's Fox Canyon neighborhood, police said today.Two teenagers were sitting in the car around 10:45 p.m. Thursday in a hilly residential area near Auburn Drive and Wightman Street when a young man approached the window and demanded the victims' phones, San Diego police Officer Robert Heims said. The man then demanded the victims, an 18-year-old man and 17-year-old boy, get out of the car."They got out and the suspect got in and tried to drive away,'" Heims said. SAN DIEGO (CNS) - A UC San Diego epidemiologist was named today to Time magazine's 2018 list of the 50 most influential people in health care.Dr. Steffanie Strathdee, associate dean of global health sciences at UCSD's School of Medicine, was recognized for her successful efforts last year to keep her husband, psychiatry professor Tom Patterson, from dying due to a drug-resistant bacterial infection the World Health Organization classifies as the world's deadliest.Strathdee urged the team of scientists and doctors to use an experimental treatment for the infection using bacteriophages -- small viruses that act as parasites to bacteria by infecting and neutralizing them."It's a great honor to be recognized for my efforts to bring phage therapy into the 21st century in North America, but it all started with my single-minded desire to save my husband's life, and it truly reflects a team effort," Strathdee said.The magazine's list honors people who "have changed the state of healthcare in America this year, and bear watching for what they do next."Patterson was the first American patient with a systemic infection to receive bacteriophage treatment, according to Robert "Chip" Schooley, the lead doctor on Patterson's treatment team. UCSD Health doctors have since treated five more patients with bacteriophages. SAN DIEGO (CNS) - In a ruling stemming from a lawsuit brought the city attorneys of San Diego and two other cities and the state, a federal judge today granted a preliminary injunction against ride-hailing companies Uber and Lyft, requiring them to classify their drivers as employees rather than independent contractors in accordance with a new state law.San Francisco-based Judge Ethan P. Schulman ruled in favor of California Attorney General Xavier Becerra, and the city attorneys of San Diego, Los Angeles and San Francisco in their lawsuit alleging Uber and Lyft have misclassified their drivers, preventing them from receiving ``the compensation and benefits they have earned through the dignity of their labor.''The suit alleges the companies are violating Assembly Bill 5, which went into effect Jan. 1 and seeks to ensure ``gig workers'' misclassified as independent contractors are afforded certain labor protections, such as the right to minimum wage, sick leave, unemployment insurance and workers' compensation benefits.Both companies issued statements indicating they would appeal the ruling, which is scheduled to go into effect in 10 days.Schulman wrote in his ruling that ``both the Legislature and our Supreme Court have found that the misclassification of workers as `independent contractors' deprives them of the panoply of basic rights and protections to which employees are entitled under California law, including minimum wage, workers' compensation, unemployment insurance, paid sick leave and paid family leave.''The judge said that under the ``ABC test'' used to determine whether a worker is an employee or an independent contractor, the companies would not be able to argue their drivers are independent contractors as they perform work that is within the company's usual course of business.Schulman recognized that the injunction could have major impacts for the companies, as well as some drivers who prefer to remain independent, and wrote that ``if the injunction the People seek will have far-reaching effects, they have only been exacerbated by Defendants' prolonged and brazen refusal to comply with California law.''The campaign for Proposition 22, a proposed ballot initiative sponsored by Uber and Lyft that would allow rideshare drivers to work as independent contractors, decried the ruling.``We need to pass Prop 22 more than ever,'' said Jan Krueger, a retiree who drives with Lyft in Sacramento. ``Sacramento politicians and special interests keep pushing these disastrous laws and lawsuits that would take away the ability of app-based drivers to choose when and how they work, even though by a 4:1 margin drivers want and need to work independently.We'll take our case to the voters to protect the ability of app-based drivers to work as independent contractors, while providing historic new benefits like an earnings guarantee, health benefits and more.''San Diego City Attorney Mara W. SAN DIEGO (CNS) - A vehicle struck and killed a pedestrian Friday on Interstate 5 at the southern end of Balboa Park.The traffic fatality occurred shortly before 9 a.m. on the northbound side of the freeway, near state Route 163 in downtown San Diego, according to the California Highway Patrol.It was unclear why the pedestrian, who died at the scene, was on the interstate, CHP public-affairs Officer Salvador Castro said.The fatality left three northbound lanes blocked in the area and tangled traffic for miles through late morning. 544
