The Supreme Court ruled in favor of Booking.com Tuesday in a landmark trademark case.In an 8-1 decision, the Supreme Court upheld a lower court ruling that determined that Booking.com is not a generic trademark because the term held meaning with consumers.Justice Stephen Breyer, a liberal judge, was the lone dissenting opinion.Other businesses including Cars.com, Dictionary.com, Newspapers.com and Wine.com said the outcome in the case would affect their ability to trademark their names too. 503

The U.S. surpassed 200,000 deaths linked to COVID-19 on Tuesday, according to a database kept by Johns Hopkins University. The deaths — all of which have occurred since February — out-total the number of Americans lost to World War I, the Korean War, the Vietnam War, the War in Afghanistan and the Iraq War combined. The 200,000 deaths are the most of any country around the world. Brazil currently ranks behind the U.S., with about 137,000 deaths.According to Johns Hopkins the U.S. also has among the highest COVID-19 mortality rates in the world. About 61 Americans per 100,000 have died of COVID-19. That ranks sixth in the world and in the company of countries like Spain (65.27) and Mexico (58.24)The U.S. also leads the world with 6.8 million confirmed cases of COVID-19. India (5.5 million), Brazil (4.5 million) and Russia (1.1 million) are the only other countries with at least 1 million confirmed cases of the virus.Johns Hopkins reports that daily confirmed cases of COVID-19 dropped throughout the month of August. However, case rates have ticked up throughout September, and top health experts like Dr. Anthony Fauci are bracing for a difficult winter.Earlier this month, Fauci warned that a wintertime surge could be possible as weather forces Americans indoors and cities begin relaxing COVID-19 lockdown restrictions. Health officials have warned that large indoor gatherings can result in COVID-19 superspreader events. The Institute for Health Metrics and Evaluation at the University of Washington — a model often used by the White House — currently projects that an additional 175,000 Americans will die of the virus by Jan. 1. That projection could drop to as little as 65,000 additional deaths with a universal mask mandate and could increase to as many as 225,000 additional deaths with easing restrictions. 1838

The state of Texas has already had nearly as many voters cast ballots in the 2020 election than in the all of the 2016 election. This year’s election is still five days away.Throughout the country, lines have formed at early voting centers to cast a ballot in next week’s election. According to the US Elections Project maintained by University of Florida professor Michael McDonald, more than 80 million voters have already submitted a ballot. Millions more are expect to vote between now and Election Day.In Texas, the number of early votes equals 95% of the total ballots cast in 2016. Part of what has driven the vote in Texas is for the first time in the 21st century, Texas is considered a battleground in the presidential election. In Travis County, which is where Austin and University of Texas is located, more voters have cast ballots there than in the 2016 election.Who is winning the early vote?According to a CNN poll released on Wednesday, Joe Biden is leading among those who have already voted by a 64-34 margin. Other national polls have similarly showed Biden leading early voting by up to a 2-to-1 margin. The challenge for Trump will be to make-up ground on Election Day. The same CNN poll showed Trump leading 59-36 among those who plan on voting on Election Day. Trump will need a strong Election Day turnout in order to overcome the lead Biden has likely established in early voting. Things like weather, daycare, illnesses, work and other factors that keep people from voting on Election Day could play against Trump on Election Day.While the news out of Texas may be discouraging for Trump, Pennsylvania and Ohio, two other key battleground states, have not seen nearly as much early voting as Texas. In Ohio, the early vote equals 43.8% of the total 2016 vote. In Pennsylvania, the early vote equals 34.3% of the 2016 vote.Similarly to Texas, Georgia, which has been a traditional GOP stronghold in recent decades, is a battleground state in 2020. There, the number of early voters equals 82% of the 2016 count. How votes will be tallied on Election DayEach state will release early voting numbers differently, and with such stark differences in how Trump and Biden voters are casting ballots, the numbers could have significant swings. In Pennsylvania, the early vote is expected to come in last after all ballots counted on Election Day are tallied. That means Pennsylvania will likely show a significant lead for Trump on Election Night, with the former vice president trying to make up ground. Some counties have said they will not even start counting the early vote until the day after the election. In close states that release the early vote first, Biden will likely amass a huge lead that will slowly evaporate throughout the night. For states that will wait to count the early vote, Trump will likely hold a huge initial lead. Election Night projections might take longer this year to account for how various states are counting the vote. 2977

The South Korean government says thousands of BMWs will be banned from the country's roads after some vehicles caught fire. The German automaker is facing a public relations crisis in South Korea over the fires, which it has blamed on a problem with the cars' exhaust systems.BMW recalled more than 100,000 vehicles in South Korea last month and has been carrying out emergency inspections. It expanded the checks to Europe last week.As of late Monday, more than 27,000 of the affected BMWs in South Korea still hadn't been checked, according to the South Korean government."Our citizens are deeply concerned," Transportation Minister Kim Hyun-mee said Tuesday. She ordered local authorities to ban people from driving any of the potentially fire-prone BMWs that haven't been brought in for checks. 805

The Supreme Court on Tuesday rejected a challenge to a controversial Arkansas abortion law blocking medication-induced abortions. The law, passed in 2015, says that any physician who "gives, sells, dispenses, administers, or otherwise provides or proscribes the abortion-inducing drug" shall have to have a contract with a physician who has admitting privileges at a nearby hospital. The order, issued without comment, clears the way for the law to go into effect in mid-July if no other legal action is taken. Planned Parenthood is expected to make another challenge to the law in US district court."The Arkansas restriction, which was enacted supposedly to protect women's health, is medically unnecessary," lawyers for Planned Parenthood argued in court papers. They say it is unconstitutional because it places an undue burden on a patient's right to choose abortion.Medication abortion — available only early in a pregnancy — involves the combination of two pills called mifepristone and misoprostol.Lawyers for Arkansas say the law is a "commonsense requirement" that "merely requires medication abortion providers to have a contractual relationship (to ensure follow-up treatment if needed) with a physician that has admitting privileges.The-CNN-Wire 1263
