Prosecutors have charged a West Seneca, New York, man with criminally negligent homicide after a dispute over wearing a face covering left an 80-year-old man dead.Donald Lewinski, 65 of West Seneca, was taken into custody Monday following an incident September 26 at Pamp's Red Zone Bar and Grill.According to Erie County District Attorney John Flynn, Lewinski got into a verbal confrontation with Rocco Sapienza - another regular at the bar - after Sapienza noticed Lewinski was not wearing a mask while bringing buckets of beer to a band playing outside.At one point, Flynn said Sapienza got up and confronted Lewinski. That's when Lewinski stood up and pushed Sapienza "hard" with both hands, the D.A. said. Sapienza fell back and hit his head on the ground. Sapienza was taken to Erie County Medical Center in nearby Buffalo, where he was unresponsive for four days. He died on September 30.The cause of death is blunt force trauma to the head, authorities said.The owner of Pamp's Red Zone released this statement:"We are all deeply saddened by the loss of Rocco. DENVER, Colo. — Matthew Dolloff, the man accused of shooting Lee Keltner while acting as a security guard outside of a protest in Denver last Saturday, will be charged with second-degree murder.The Denver District Attorney's Office said formal charges against the 30-year-old Dolloff would be filed Monday.Lee Keltner, 49, was leaving the Denver's Civic Center Park when he and Dolloff got into an alleged altercation that ended with Dolloff shooting Keltner, according to witnesses, video, photos and an arrest affidavit.Keltner was pronounced dead at Denver Health Medical Center.There had been a “Patriot muster” in nearby Civic Center Park and a competing “BLM-Antifa Soup Drive,” as it was branded, in the hours before the incident.Dolloff faces between 16 and 48 years in prison if he is convicted of second-degree murder, the district attorney’s office said.Dolloff was working as a private security guard who was hired by Denver NBC affiliate 9News through Pinkerton, though Pinkerton said in a statement Monday that Dolloff “is not a Pinkerton employee but rather a contractor agent from a long standing [sic] industry vendor” and that it would cooperate with the investigation.9News management said in a new statement Tuesday that it had also asked of Pinkerton that the guards it supplied not be armed. The news outlet also released video shot from a producer's cell phone showing the moments before and after the shooting.“As stated yesterday, 9NEWS does not contract directly with individual security personnel. 9NEWS contracted with Pinkerton and had directed that security guards accompanying our personnel not be armed. JOSHUA TREE, Cali. – Scientists say climate change could kill off California’s iconic Joshua trees completely. “The future for Joshua trees might be a little bleak and we know that,” said University of California Riverside biologist Lynn Sweet, Ph.D. Sweet says these trees, which have been on the planet for more than 2.5 million years, could soon be extinct due to warming weather. Her team of scientists released a new study showing the impacts of climate change on California’s high desert -- saying as the Earth gets hotter and gets less rain, it will be harder for these trees to survive. “Joshua trees need really special conditions in order to germinate and grow,” Sweet said. “And those conditions might happen less and less frequently.” Sweet predicts Joshua trees could be extinct within the next 50 years. “We’re looking at the future of maybe keeping 20 percent of the Joshua trees if we really get our acts together,” she said. “And we’re looking at less than 1 percent of Joshua tree habitat remaining in the park if we don’t do something about climate change.” Some visitors say they are already seeing the change. “The Joshua trees don’t look happy,” tourist Jean Blattner said. “They seem to be in the park area suffering.” Blattner has been visiting Joshua Tree National Park for the past 30 years and says the conditions are getting worse. “They’re not as full; they don’t seem to have the glisten that they used to when the sun shined on them before,” she said. Not everyone, however, everyone is buying it. “Even though it looks a little dry it’s still full of life,” said Nelson Perez, who has lived in Joshua Tree for 20 years. Perez supports science but doesn’t believe that these trees could be completely wiped off the planet by the end of the century. “I don’t think it’s to an extent that a lot of the climate changers beliefs are so I’m kind of in the middle,” he said. Sweet, however, says science supports her findings and encourages people to think about how their carbon footprint impacts the environment. “So, the degree to which the Joshua Tree is in trouble is really up to us,” she said. “If we can make a difference, we can make a difference for these trees.” 2219

Thanks to word of mouth, their business, The Furlough Cheesecake, took off and hasn't slowed down. They even got a boost in business when Ellen DeGeneres surprised the sisters by having them on her show. Ellen gave them ,000 to help with their business. It didn’t stop there. They got another surprise this month from one of the largest companies in the world. “We found ourselves at Walmart, being able to present our cheesecakes for a tasting,” Howard says. The meeting and taste test went well with Walmart. “Their plans are to get us in the stores before the end of the year,” Wright says. “And she told us, ‘This doesn't happen. There are people who have been waiting over year, standing where you're standing, making this presentation.’ And we came with our A game.”Walmart says the cakes will eventually be sold in stores and online. 1179
