SAN DIEGO (CNS) - A man stabbed his housemate to death in Chula Vista two years ago, then stuffed the victim's body into a barrel that he and another man dumped into San Diego Bay, a prosecutor alleged Tuesday, while defense attorneys maintained that the evidence against their clients was entirely circumstantial. Timothy John Cook, 54, is charged with the Sept. 30, 2017, murder of Omar Medina, 28, and co-defendant Derrick Spurgeon, 40, is charged with being an accessory for allegedly driving the boat used to dump the victim's body, which was located 12 days later inside the barrel, which had been weighed down by a makeshift anchor made of wire and cinderblocks. Medical examiners said Medina had been stabbed more than 60 times in the chest, back, neck and head. RELATED: Man whose body was found in a barrel had been stabbed 66 times; suspect pleads not guiltyDeputy District Attorney Cherie Somerville said in her opening statement that Medina and Cook both worked at a scaffolding business for Cook's younger brother and were living together at a home in Chula Vista. In a text exchange with his brother, Cook expressed annoyance with Medina over his drinking and sloppy household behavior, leading Cook to eventually kick him out of the house, according to the prosecutor. Sommerville also noted that Medina had recently come into a substantial amount of money via an ,000 settlement he received in a lawsuit. Medina's family never heard from him after Sept. 30, and filed a missing person's report soon afterward with Chula Vista police. Medina's unlocked car was found about a week later on Oaklawn Avenue, not far from the home he shared with Cook on McIntosh Street. Numerous belongings, including his computer and guitar were inside the vehicle. Defense attorney Kara Oien countered in her opening statement that there was no hard physical evidence tying Cook to Medina's death, and told jurors the district attorney was relying on circumstantial evidence to come to a false conclusion that her client killed Medina. The attorney said the prosecution lacked a murder weapon and witnesses to the murder, which allegedly occurred during the daytime hours of Sept. 30 at the Chula Vista home. Oien said Cook's agitation over Medina's sloppiness was far from indicative of a motive to kill and that Cook would have tried to get closer to Medina if he really wanted his settlement money, rather than kicking him out of their house. Surveillance footage allegedly captures the men in a green Ford F-150 owned by Cook's half-brother, which is seen towing Spurgeon's boat from El Cajon to the bay. Somerville alleged that a barrel matching the one containing Medina's body can be seen in the bed of the pickup in the footage. She also said a search of the McIntosh Street home yielded additional indications that Cook was covering up the murder, such as removal of his home's kitchen sink and stripping down Medina's room, which was located in an attached building on the property. Oien said Cook was merely fixing up the home, and that he had an agreement with his landlord to make occasional repairs in exchange for lower rent. Spurgeon's attorney, Roland Haddad, said there was no evidence that his client had any knowledge of assisting Cook of disposing Medina's body, if Cook even committed the murder at all. The men exchanged phone calls on Oct. 11, but Haddad said there was no evidence regarding what discussions they had over the phone, nor what was said on the alleged boat ride when Medina's body was dumped into the water. 4056

SAN DIEGO (CNS) - An 18-year-old man was shot twice in the stomach during an armed robbery early Thursday morning in a Mission Beach parking lot, police said.Two 18-year-old men were in a car leaving a party at the Bahia Resort Hotel, 998 West Mission Bay Drive, when they were approached by two men on foot in a public parking lot on Gleason Road at around 12:30 a.m.One of the men on foot pulled out a gun and pointed it at the pair in the car while demanding items from them, San Diego Police Department Officer Robert Heims said. The victims got out of the car and the man with the gun stole a chain necklace from one of the victims.The other victim tackled the gunman and was shot twice in the stomach, the officer said.The suspects fled in an unknown vehicle and the victim who had his necklace stolen drove the gunshot victim to a hospital for treatment of his wounds, Heims said. The gunshot victim underwent surgery, but an update on his status was not immediately available.A detailed description of the suspects was not immediately available. 1061

  

SAN DIEGO (CNS) - A man accused of opening fire inside a Poway synagogue, killing a woman and injuring three other people, pleaded not guilty today to more than 100 federal hate crime charges alleging he acted out of hatred toward the Jewish and Muslim communities.John T. Earnest, 19, is accused not only of the synagogue shooting but also of an earlier arson fire at an Escondido mosque. He is being charged by both federal and state prosecutors and faces a possible death sentence in both cases. Neither office has made a decision regarding whether they will pursue the death penalty.Earnest, of Rancho Penasquitos, is accused of carrying out the shooting at Chabad of Poway on April 27 -- the last day of Passover -- killing Lori Gilbert Kaye, 60, who was shot twice in the synagogue's foyer and died at a hospital.The congregation's rabbi, Yisroel Goldstein, 57, lost an index finger in the shooting. Two other people -- Almog Peretz, 34, and his 8-year-old niece, Noya Dahan -- were also injured.Earnest is also accused of setting a March 24 fire at an Escondido mosque -- a crime to which Earnest allegedly confessed in an online manifesto he posted prior to the synagogue shooting.Following his initial appearance Tuesday afternoon, he's slated to return to court May 28 for a preliminary hearing. He remains held without bail.He was charged last Thursday with 109 federal hate crimes: -- 54 counts of obstruction of free exercise of religious beliefs using a dangerous weapon, resulting in death, bodily injury and attempts to kill; -- 54 counts of hate crimes stemming from the synagogue shooting in violation of the Matthew Shepard and James Byrd Jr. Hate Crimes Prevention Act; and -- one count of damage to religious property by use of fire.Each of the 54 hate crime and obstruction of free exercise of religious beliefs counts apply to a person who was inside the synagogue during the shooting, Brewer said. Among those people, 12 of the congregants present were children, he said.Earnest is due back in federal court May 28.Earnest is also charged in state court with murder, attempted murder and arson. His next court hearing in the state's case is a readiness conference set for May 30.Kaye, a longtime member of Chabad of Poway, was at the temple with her physician husband and daughter the day of the shooting to honor her mother, who recently died. The rabbi, Goldstein, lost his right index finger in the shooting. Peretz was shot in a leg while shepherding children to safety. His niece was struck by shrapnel in her face and leg.An off-duty Border Patrol agent working as a security guard was inside the temple when the shooting began, and he opened fire as the suspect fled, San Diego County Sheriff Bill Gore said. The agent did not strike Earnest, but did hit the suspect's car, authorities said.Police said Earnest called 911 at around 11:30 a.m. and said he had been involved in the shooting and was armed.According to the federal complaint, Earnest told a dispatcher, ``I just shot up a synagogue. I'm just trying to defend my nation from the Jewish people ... They're destroying our people ... I opened fire at a synagogue. I think I killed some people.'' He allegedly added that he shot up the synagogue ``because the Jewish people are destroying the white race.''A San Diego police officer who had been en route to the synagogue spotted the suspect's vehicle and pulled him over at 17051 W. Bernardo Drive, less than two miles west of the synagogue, Deputy District Attorney Leonard Trinh said.Earnest got out of his vehicle with his hands up and was taken into custody without further incident, according to police.In the ``open letter'' that authorities say Earnest posted online shortly before the shooting, the author espouses flagrant anti-Semitic sentiments and a need to protect the ``European race.'' He wrote that he spent four weeks planning the attack, citing his ``disgust'' for Jews and a desire to kill them, and expressed admiration for the Australian white nationalist who attacked two mosques in Christchurch, New Zealand, in March, killing 50 people.The writer also claims responsibility for the March 24 fire set at the Dar-ul-Arqam Mosque, also known as Islamic Center of Escondido. The 3:15 a.m. fire was quickly extinguished by people inside the mosque. SAN DIEGO (CNS) - Authorities put out a call Tuesday for any additional alleged victims of a mortuary services worker accused of looting a recently deceased Spring Valley man's home, carrying away valuables with a gurney and a body bag.Sammy Willie Gates, 49, allegedly ransacked the 60-year-old man's house late on the night of Aug. 31, about 11 hours after deputies conducting a welfare check found the resident dead of natural causes, according to sheriff's officials.On Sept. 2, one of the victim's relatives reported discovering items, including a firearm and safe, missing from the residence, Sgt. Karen Bloch said. Two days later, the family reported that reviews of surveillance camera footage had revealed that the home of the victim, whose name has not been released, had been burglarized.The video clips showed a man -- later identified by investigators as Gates, owner of independently operated Mortuary Transportation Services -- arriving at the man's house in a white utility van, the sergeant said.Gates allegedly entered the home and exited shortly thereafter with two bags filled with stolen property, then returned with a gurney and an empty body bag that he used to haul away more property.On Sept. 9, detectives from the Rancho San Diego Sheriff's Station served a search warrant at Gates' El Cajon-area home, where the deceased man's safe and gun allegedly were recovered, along with 16 additional firearms, many believed to be war relics dating back to the early 1900s."Two additional safes, multiple personal identifying documents, jewelry, watches, war medals, comic books and several thousand dollars in collectable coins were also recovered from Gates' residence," the sergeant alleged.
