SAN DIEGO (KGTV) - Sunday morning's rain caused crashes on roadways, damage to construction zones and danger in Sunset Cliffs.One of those crashes had Cristal Ramirez in the passenger seat. "I was supposed to drive for brunch but my friend picked us up and I was glad because I didn't want to drive in the rain," she said.She said as they took the connector from the 163 to the I-8 West they started sliding, "I think we were driving a little too fast because of the rain." Ramirez said they grazed the guardrail. The tires were out of alignment, making it necessary to call for a tow truck."We were like what the heck this is wild!" She said.The group didn't let the accident ruin their afternoon, they continued on in Ramirez's car to Sunset Cliffs.The danger still lurking behind yellow caution tape, draped along the edge of one part of the cliff. From where she and her two friends stood, you could see the cliff carved away underneath the seemingly solid edge."I didn't think about it, I was like 'Oh we're close to the edge.' and we started playing around and I was like, 'Oh we probably shouldn't be playing this close to the edge," Ramirez said when she realized the danger.South of Sunset Cliffs, another problem at the Silver Strand State Beach exit off SR 75. The rain caused metal plates covering trenches in a construction area to bend inward.Crews rushed out to reinforce the plates to make them safe, adding wood supports. An engineer told 10News the construction should be finished by next week, if the weather doesn't delay the work. 1559

Come January 30, the mall will roll out its 'secured parking plan' aimed at keeping non-shoppers from parking on the property.Customers can park free for the first two hours and then pay per additional hour, with a daily maximum of . While the parking stations have been in place for months, some mall employees say they were blindsided to learn they too might have to pay for parking. Mall officials say employers have the option of purchasing parking passes for employees. If not purchased by the employer, individual employees may purchase the passes themselves.“It’s another bill to put on top of the rest," said one employee, who asked to remain anonymous for fear of being fired. His employer will not be purchasing parking passes for employees. The anonymous employee says they were told daily passes will cost and monthly passes will cost .“Personally it’s 0 out of my budget each year to go to work, and that’s on top of car payment and insurance," said the employee.He's concerned for mall employees who only make minimum wage and cannot afford the extra cost. While the mall is offering subsidized public transit passes, the concerned employee says that's not an option for everyone. He wishes there had been more transparency about the policy in the months leading up to January 30 roll-out. SAN DIEGO (KGTV) - The federal watchdog agency that aims to protect consumers from unfair, deceptive, or abusive practices is suing a San Diego-based company.On Tuesday, the Consumer Financial Protection Bureau (CFPB) sued Encore Capital Group and its subsidiaries, claiming they violated the terms of a 2015 legal agreement.The CFPB claims, “Since September 2015, Encore and its subsidiaries violated the consent order by suing consumers without possessing required documentation, using law firms and an internal legal department to engage in collection efforts without providing required disclosures, and failing to provide consumers with required loan documentation after consumers requested it.”The lawsuit says after the effective date of the consent order, “Encore filed more than 100 lawsuits to collect consumer debts after the applicable statutes of limitations had expired."The lawsuit also claims Encore failed to disclose that consumers might incur international-transaction fees.In response to the lawsuit, the company's Executive Vice President, General Counsel, and Chief Administrative Officer Greg Call said Encore is built on a foundation of treating their consumers fairly and respectfully."We are disappointed that the CFPB has chosen to file this lawsuit on outdated issues, but we will continue to engage with the CFPB and work to ensure that we maintain policies and practices that fully comply with all applicable legal requirements. We believe that there will be no material operational impact as a result of the suit," said Call. "We fully corrected the issues underlying the allegations in this lawsuit years ago and are unaware of any unresolved consumer impact."DEBT COLLECTION LAWSUITSPart of the complaint talked about debt-collection lawsuits.In July Team 10 discovered a 157% increase in the number of rule 3.740 collections lawsuits filed in San Diego County court from 2015 to 2019. SAN DIEGO (KGTV) -- The California Department of Motor Vehicles is reminding residents about the looming REAL ID deadline. Starting October 1, 2020, U.S. residents will need a REAL ID to fly domestically or enter secure federal facilities and military bases. The new ID is the result of the 9/11 Commission's recommendation to establish standards for identity verification and security features. In California, a gold bear and star indicates REAL ID compliance. The DMV is also reminding residents about requirements to obtain a REAL ID. SAN DIEGO (KGTV) - The California Restaurant Association has a grim forecast for the restaurant industry as communities across the state begin to see more and more restaurant closures.When the coronavirus pandemic started, the CRA projected that 20 to 30 percent of restaurants could close their doors for good because of the pandemic. That projection is looking to be on the higher end now, according to Jot Condie, the CRA's president and CEO."With this second shutdown, it's likely to be closer to 30 percent," Condie said. "A lot of restaurants that we're learning are closed, are doing it quietly. There are no signs posted, no banners saying we're closed for good."He said while many variables are at play, even when restaurants can reopen completely, many restaurant owners will not be out of the woods yet."After the opening, you'll see a sort of shaking out of the industry in those first 18 months," Condie said.Condie said the restaurants most at risk are fine dining and independently owned.He also said the impact will likely vary in various parts of the state. Condie believes that San Diego County and Southern California's restaurant industry may fare better than the rest of the state because of better weather throughout the year. The weather will be a significant factor for restaurants that can offer outdoor dining and expanded outdoor dining."Where the weather cooperates almost all year, you're likely not to see the challenges of survival that you will see in, for example, San Francisco or the Bay Area," he said. 1546
