SHANGHAI: In a fresh sign of China¡¯s financial strength, a leap in the shares of Industrial & Commercial Bank of China Monday made it the world¡¯s biggest bank by market capitalisation, overtaking US giant Citigroup. ICBC¡¯s Shanghai-listed A shares surged 2.68% to 5.75 yuan, giving it a market capitalisation of 4bn, according to Reuters calculations. China has offered Spain a pair of pandas during the ongoing visit of King Juan Carlos, as a goodwill gesture to promote ties between the two countries, the foreign ministry said Thursday. "This is a very good gift for Spain," foreign ministry spokesman Qin Gang said. "We hope the Spanish people will love them. As envoys of the Chinese people, we hope that the gift of the pair of pandas will increase the friendly relations between the two countries and peoples." China has a long history of giving its national animal, the endangered panda, to other nations as a gesture of goodwill. Officials at the Spanish embassy in Beijing said the pandas were not a gift, but were being loaned in an arrangement financed by a private Spanish company that runs the Madrid Zoo. King Juan Carlos is currently on a visit to China. Queen Sofia is scheduled to visit the nation's panda breeding centre in southwestern China's Sichuan province on Friday, the final day of a five-day visit.

A brand-new labor contract law comes into force from the New Year's Day that is expected to markedly propel rights for billions of Chinese workers."The government that is making the most concerted effort to protect workers rights is China," said Auret van Heerden, Geneva-based head of Fair Labor Association, which monitors work conditions in 60 countries.That "goes against the conventional wisdom that China is leading the race to the bottom," the Bloomberg News quoted Heerden as saying on Tuesday.The Labor Contract Law aims to improve job security for workers, making open-ended terms of employment for those employees who have completed two fixed terms with the same employer. The legislation limits overtime, sets minimum wages and guarantees one month's pay for each year worked for sacked employees. It is the first time that China's top legislature, the National People's Congress Standing Committee, has ruled on open-ended work contracts and severance pay for fired workers.The new law will make it more difficult for companies to hire temporary workers, a practice favored by exporters to cope with fluctuations in orders.One side-effect of the legislation will be higher labor costs for all employers in China. It is estimated that some labor-intensive businesses will have to raise their selling prices, or move to other places with lower cost.Olympus Corp., the world's No.4 digital camera maker, and Yue Yuen Industrial (Holdings) Ltd., the biggest maker of shoes for brands such as Nike Inc., are among companies shifting some production to Vietnam to cut costs.According to Chinese press reports, some companies have been terminating contracts and asking employees to resign ahead of the introduction of the law.Huawei Technologies Co., China's largest maker of telecommunications equipment, offered 7,000 workers new contracts with benefits if they terminated their old agreements, spokesman Ross Gan said.Some employees accepted, while others chose not to sign and left, he said, without providing details. The move wasn't aimed at evading legislation, Gan said in an email to the Bloomberg News.

The national workers' union on Wednesday pledged to work closely with authorities to issue a detailed regulation on the Labor Contract Law as soon as possible, to assist its application starting January 1."We'll actively promote and participate in the legislation and relevant legal interpretations to make the law more applicable, especially by making suggestions on some hotly debated issues," Liu Jichen, head of the legal affairs department of the All China Federation of Trade Unions, said at a press briefing.Liu did not elaborate or disclose a timetable, but the Outlook Weekly, a magazine under the official Xinhua News Agency, reported on Monday that an implementation regulation of the Labor Contract Law was expected by the end of the year. It also reported that a judiciary interpretation, drafted by the Supreme People's Court, would also be adopted soon to regulate loophole jumping.The Labor Contract Law, passed in June after 18 months of heated debate and public consultation, is considered the most significant change in the country's labor rules in more than a decade. It targets bosses and officials who exploited workers by establishing standards for labor contracts, use of temporary workers and severance pay.However, business lobbies worry that stricter contract requirements could increase costs and give them less flexibility in hiring and firing.The country's leading telecom equipment-maker Huawei Technologies in October encouraged some 7,000 veteran employees to resign and rehired them immediately afterward.The Labor Contract Law stipulates that an employee who has worked for a company for more than 10 years is entitled to sign an open-ended labor contract.However, the legislative affairs commission of the Standing Committee of the National People's Congress, the country's top legislature, made it clear on Saturday that such sidestepping is useless, because although the contracts end, employment relations still exist.At yesterday's conference, Liu said Huawei's dodge is only one of the three tactics the union discovered violating or circumventing the current Labor Contract Law. Firms would also fire employees and rehire them soon afterward as dispatch workers. The other strategy uses mass layoffs.For example, United States retailing giant Wal-Mart fired about 100 employees at its sourcing center in China last October, claiming the layoff was part of its global restructuring."The cause of these problems is that a small number of enterprises is trying to evade responsibility to optimize profits," Liu said. "We've begun intervening to stop such activities."
