SAN DIEGO (KGTV) – A car crashed through a parking garage wall and dangled from a building Friday night.Emergency crews responded to the Harbor Club parking structure before 7 p.m.Firefighters say the driver of the White Lexus was a woman in her sixties. They say her foot got stuck under the brake pedal and she was unable to stop.Shortly after the accident authorities were able to pull the car back into the building. The driver was not hurt.A structural engineer was called to the scene and is assessing the damage to the building. 558

SAN DIEGO (KGTV) - A false alarm prompted a brief evacuation at San Diego International Airport Saturday afternoon.Travelers were evacuated just before 1:30 p.m., with photos on social media showing travelers gathering outside Terminal 1 and on the tarmac outside Terminal 1 gates.Video showed a fire alarm sounding through Terminal 1 directing travelers to the closest exit.San Diego airport officials said a fire alarm did sound, however, it was a false alarm — though sure to irritate a few travelers at least.RELATED: 10News Flight TrackerNo injuries were reported. SAN DIEGO (KGTV) --  A federal judge ordered that the Trump administration reinstate the Deferred Action for Childhood Arrival program, also known as DACA. The DACA program - which protects nearly 800,000 undocumented immigrants brought to the United States as children from being deported. While the decision has been made, it won't be an easy road for the people involved. The restart is delayed until August 23, to allow the government time to appeal Judge John Bates' decision.  For Dreamers like Ali Torabi, Friday's win is just the latest in the political tug of war.RELATED: San Diego Dreamers heading to the Capitol“I was preparing for, in the next four days, the complete opposite," Torabi said. He believed he might be deported. "I was actually working on my med school applications, and I was like, ‘I need to get my things together now.’”Torabi is a DACA student from Iran and a 22-year resident of San Diego.  He said Judge Bates' decision is huge for the undocumented immigrants protected by the program. But being in constant limbo can be emotionally draining. "Having this back and forth, where one day we don’t know if we’ll have any protection and were up to be potentially deported or detained, to telling us, well yea we’ll keep the protections...it’s difficult," he said. "I’m not going to lie to you, it’s emotionally difficult.”It isn't over yet. Judge Bates ruling could conflict with another decision on the program -  expected to be ruled on by a federal judge in Texas by as early as next week.The Texas Attorney General calls the program unconstitutional because it came from an executive order.“It invites future presidents to ignore the law, ignore the will of the people, and set their own policies on the second amendment, privacy rights, drug laws, or any other important issues debated in Congress," said Texas Attorney General Ken Paxton. Torabi said he has hope. But getting to the finish line, "It’s exhausting, it really takes a toll on your mental health, on your emotional health, and we’re just getting tired of it.”   2132

  

SAN DIEGO (KGTV) - 10News is learning more about how suspected Poway shooter John Earnest got the weapon. On Thursday, investigators revealed that they believe he got his rifle from a licensed dealer.In federal documents released on Thursday, prosecutors report, “The firearm was manufactured by Smith & Wesson in Princeton, Illinois and shipped to Springfield, Massachusetts where it was assembled. The firearm was ultimately transferred, via Fort Worth, Texas, to a Federal Firearm Licensed (FFL) Dealer in San Diego, California, which sold the firearm to Earnest. Earnest picked up the rifle on April 26, 2019.”That was the day before the shooting.In a press conference on Thursday, Southern District of California U.S. Attorney Shane Harrigan told reporters, “I can say that there is no allegation that the defendant violated federal law when he acquired the rifle that he used in the violent attack on the synagogue.”Questions still remain as to whether state law was violated. Earnest is only 19 years-old.California law requires that adults be over 21 years-old before they can buy a firearm, unless they have a hunting license, are current or former military, or are in law enforcement.Prosecutors wouldn't comment on whether Earnest had a hunting license. “That allegation isn't in the complaint but please understand that as the criminal process moves forward, more information may be available to the public,” added Harrigan.District Attorney Summer Stephan originally said that the rifle had been obtained legally, but when pressed on Wednesday by 10News, she didn't provide a clear answer. “I don't want to [comment any further] because it's a pending case,” she said.At Thursday’s press conference, a reporter asked the federal prosecution about when Earnest purchased his 60 rounds of ammunition. Harrigan replied, “We’re limited to the allegations in the complaint. I hope you understand. I think more information may be forthcoming.” 1962

  

SAN DIEGO (KGTV) - A "Day of Service" around Mission Bay will honor Maruta Gardner, the woman killed by a drunken driver while she was painting over graffiti in Mission Beach and Pacific Beach.Half a dozen service projects will take place around the bay all day Friday, Nov. 3."She was just a firecracker," said Dawn Reilly, one of the organizers with Beautiful MB. "She would liven everybody up and boost your morale and make you feel like you could accomplish anything if you just got together and did it."RELATED: Mission Bay activist killed in road rage crashFrom 10 a.m. until 12 p.m., volunteers will clean up the bike path from Rose Creek to Crown Point.The PB Street Guardians will help people do clean up and graffiti patrol around the Pacific Beach Business District from 11 a.m. until 1 p.m. and from 4 p.m.- 6 p.m.From 2 p.m.-4 p.m., the Mission Beach Town Council will lead volunteers on a clean up and graffiti patrol around MB.Volunteers can also spend time at a senior center near the bay all day if they want a non-physical option.Volunteers can also help paint utility boxes along Mission Boulevard.Full details on the activities, as well as links to register, can be found here.Organizers will also unveil a large mural on a wall at Mission Bay High School to memorialize Gardner. It was painted by local artist Israel Cervantes."It not only honors Maruta's spirit, but it also has the potential to inspire future leaders to make a difference in their community," said John Vallas, the Executive Director of Beautiful MB.Gardner was a principal at Mission Bay High for several years. Having the mural there not only memorializes her, but it can also help teach the next generation about what Gardner did and how to make a difference where you live."That's just as important what we're teaching every single day," said MBHS Principal Ernest Remillard.Several student groups will take part in the volunteer activities as well.Organizers chose November 3rd because that's the day the City Council declared as "Maruta Gardner Day" in 2015.Gardner was killed in February of 2016 by a drunk driver. She was removing graffiti at the South end of Mission Boulevard at North Jetty Road when she was hit.Jonathan Garcia pleaded guilty to a charge of gross vehicular manslaughter and was sentenced to 11 years in prison.Rather than focus on the crime, volunteers hope this day of service helps people remember how inspiring Gardner was to everyone who met her."She was amazing," said Remillard. "She was so proud and honored of her time here at Mission Bay.""I'm wowed by how many people were inspired by her," Reilly added.
