SAN DIEGO (CNS) - A bicyclist riding with a group of cyclists was seriously injured Saturday when he was struck by a motorcycle in Pacific Beach, police said.The collision happened at 3:14 p.m. Saturday at the intersection of Ingraham Street and Reed Avenue, according to Officer John Buttle of the San Diego Police Department.A 23-year-old man riding a 2017 Harley Davidson Sportster was southbound in the 4200 block of Ingraham as a group of cyclists were eastbound in the 1500 block of Reed Avenue, Buttle said.The cyclists entered the intersection and the motorcycle struck one of them, a 49-year-old man, the officer said.The motorcyclist suffered road rash to his right leg, Buttle said. The bicyclist suffered a broken left femur and broken ribs. Medics took the cyclist to a hospital.Officers from the SDPD traffic division were investigating the collision, Buttle said.Ingraham was closed in both directions at Thomas and Oliver avenues and was expected to last a couple of hours, the SDPD said. 1012

SALT LAKE CITY — A Colorado photographer says he watched the infamous monolith in southeast Utah fall to the ground and says he knows exactly how and why it disappeared last weekend.The mystery monolith captured world-wide attention and intrigue after its discovery in a remote area southwest of Moab, on a 4x4 road near the Canyonlands Needles District. The silvery metallic structure has even inspired copycats to be erected on the other side of the world.How it ended up in a secret spot a half a mile off the road is still a mystery, but photographer Ross Bernards is shedding light on how it vanished-- and what the group who took it said to him as they hauled it away in pieces.Ross Bernards goes on adventures for his career."I'm an adventure and outdoor lifestyle photographer, that's what I do for a living," he said. "So, my job depends on me finding unique and cool places."The photographer, who is based in Colorado, explained that he's also a certified canyoneering guide. Bernards said he's worked with outdoor brands like Kelty, Sierra Designs, and Utah-based Ogden Made.He often finds himself in some of the most remote places in Utah, and said eastern Utah is his "happy place."When a middle-of-nowhere spot in his happy place found itself in the middle of an international monolith mystery last week, Bernards decided to check it out in person.He said he wanted to go out to the monolith before it disappeared, or before the masses found out."I wanted to go out there and try light painting with my drone," Bernards said.Just a couple of days after reading an article on the metal formation, Bernards realized the coordinates were posted online. Realizing time was of the essence, he and three friends make the several-hour trek on Friday.They arrived after dark, and Bernards explained they ended up with the monolith all to themselves.The four of them took pictures of the monolith in the moonlight. About an hour later, Bernards described what he saw after he said four other visitors walked up."Two of them stand back, two of them walk forward and walk up to the monolith and start pushing on it a little bit," he recounted. "And then one of them turns to my friends who are a little bit further up the canyon next to it-- where I was a little further back-- and said, 'Hope you got your photos.'"After that, Bernards said the two gave the monolith a couple of big pushes, and it began to lean over."That's when the rest of them came up, and all four of them pushed it over to the one side, and then pushed it back to another side," he remembered. "And it just fell straight onto the ground."Just like that, Bernards watched the monolith that captivated and mystified people across the globe, topple over."Right after it had fallen over and made a loud 'thud,' one of them said, 'This is why you don't leave trash in the desert,'" Bernards said.He explained the group began to break the monolith down into pieces to throw in a wheelbarrow."As they were loading it up and walking away, they just said, 'Leave no trace,' and left," he said.Bernards explained that he and his friends camped out overnight, and even cleaned up some of the rivets left behind from the fall of the monolith.Fast forward to the next morning-- the message from the monolith demolishers on his mind-- Bernards would find he was hardly the only person who set out to see the strange metal sculpture in person.He took pictures that show several vehicles lined up and parked on the roadway, with more driving down toward the area."You could see the road from the dust just coming up, and you could just see car-after-car coming and going," Bernards said. "I mean, we probably saw 70 or 80 different cars there."He said there were several people in each car, some with dogs wandering off-leash.Bernards talked about how he saw people walking everywhere on the land, some even hiking up the wrong canyon in search of the monolith.Not to mention, the people had swarmed an area miles up a high clearance, 4x4 road. Bernards described seeing minivans and sedans trying to navigate the road.He expressed a worry that this would lead to search and rescue calls, and place an undue burden on local authorities as well as the Bureau of Land Management."It made me understand exactly why these people did it," he said. "One of the reasons that we didn't stop them, is we all agreed with them."Bernards said he's been called out by people saying that he was part of the problem, and he said he completely understands.Bernards said that he practices the "leave no trace" principle and expressed that his job is to visit off-the-beaten-path places, responsibly.He also explained he has a lot of experience with cross-desert navigation and 4-wheel driving.Still, he said he felt guilty afterward about making the trip.After seeing the number of people who showed up, Bernards said the monolith didn't need to be out there."Leave the art to places where art should be and let mother nature have her space for art," he said.And for anyone who is buying into the conspiracy theories about how and why around the mystery metal monument and its sudden disappearance, Bernards can at least set the record straight."Aliens were not involved in any way, shape, or form in this thing. They had nothing to do with it. Nor was it some secret government project. None of that had anything to do with it" Bernards said, with a smile and chuckle. If your car starts to swap ends, or spin, that’s “not a fun way to discover that you need different tires,” says Matt Edmonds, executive vice president of online retailer Tire Rack.Ask your new neighbors, or an expert at a tire store, what the locals use to stay safe on the roads. Or you can use an online tire guide and user reviews to choose new tires.2. You hit a pothole, nail or curbWhile you’re checking your tires’ pressure — which you should do at least once each month — run your hand over the tread surface to see if there are any nails stuck in the tire or cuts in the tread or sidewall, Bennett says.If you find a nail, don’t pull it out or you might wind up with a flat tire. Instead, drive to a tire repair shop and get them to pull out the nail and, if necessary, patch it.Often, tires are damaged by running over a pothole or rubbing against a curb while parking, Edmonds says. Look for bubbles or bulges that could indicate a developing problem and result in a high-speed blowout. Damage on the inside of the tire is harder to spot and might require a trip to a tire store for an expert’s inspection.3. Your tires are losing tractionTires that have lost all or most of their tread can feel fine while driving in dry conditions. But once rain or snow hits, they lose traction and braking distances increase, Bennett says.To measure tread depth, insert a quarter into the tread in the center of the tire with George Washington’s head pointing toward the tire. If the tread obscures the top of his head, your tires are in good shape.If the top of Washington’s head is even with the tread, the tires are still safe to drive on, but it’s time to start shopping for new ones, Bennett says.4. You hear tire noise, feel vibration or ‘pulling’These are all indicators that something is wrong either with your tires or, in some cases, with the alignment of your front wheels. As the tread wears, tires can become noisy, according to Edmonds.Tires that wear unevenly can cause a vibration through the car, which is commonly felt through the steering wheel. The car is pulling when it doesn’t track straight, slowly wandering either left or right. This is often caused by misaligned front wheels.5. You bought your tires more than six years agoRubber dries out over time, and even if there’s still plenty of tread, the sidewalls can crack.The date the tires were manufactured is printed on the sidewall and is usually preceded by DOT for the Department of Transportation. The first two numbers stand for the week in the year it was made, and the other two are for the year. For example, if your tire has “1109” printed on it, then it was manufactured in the 11th week of 2009.Edmonds says that tires should not be in continual service for more than six years or, if a car was garaged for extended periods, 10 years from the manufacturer date.Tire care basicsTires are expensive, but if you maintain them correctly, most tires provide reliable service for up to 60,000 miles. Here’s how to keep your tires in good condition so you can drive safely:Buy a tire gauge and pump. Tire gauges typically cost less than . And instead of inflating at crowded gas stations, buy a battery-operated inflation pump for less than and do it at home.Locate your tire pressure level. The correct tire pressure level is usually listed on the yellow sticker often found in the driver’s side door jam.Check your tire pressure at least once a month. To get an accurate reading, check your tires in the morning before you drive anywhere. Tires heat up when you drive on them, and this throws off the inflation amount.Don’t forget your spare tire. Inflate your spare tire if you have one. Many cars now are sold without a spare but have an inflation pump and a can of tire sealant that will, in an emergency, both inflate and seal the leak in your tire.Check your temperature. For every 10 degrees the outside temperature drops, a tire’s pressure will decrease by one pound per square inch. SAN DIEGO (CNS) - A class-action lawsuit has been filed against Legoland and its parent company for allegedly not providing refunds after the Carlsbad theme park was closed to the public due to the COVID-19 pandemic.The suit was filed Monday in San Diego federal court on behalf of Los Angeles County resident Joyce Case against Merlin Entertainments Limited, which operates Legoland, Tussauds Hollywood, Tussauds San Francisco, the San Francisco Dungeon and Legoland Florida.The suit alleges Case purchased tickets to Legoland for a March 21 trip and ended up "one of the many consumers stuck with tickets to a canceled event who has been unable to obtain a refund," according to the complaint.Legoland representatives could not immediately be reached for comment.RELATED:San Diego Zoo hopes to reopen in 'coming weeks' under new limitsSan Diego cleared to reopen zoos, gyms, bars and wineries, day campsSan Diego theme parks aim for July 1 reopeningThe suit seeks refunds for all customers who paid for tickets, memberships and vacation packages that have since been canceled due to COVID- 19, and damages to compensate customers "for the loss of use of their money during a time when cash is at a premium for the many families targeted by Defendants that are struggling to get by."The complaint states that the terms and conditions of agreements to purchase tickets to Legoland and other Merlin Entertainments Parks hold that if events are canceled, refunds must be paid."Closing of these venues, and cancellation of these events, should have meant that ticketholders were promptly refunded their money -- money that in many cases was very much needed for other purposes," the complaint states. "But that did not happen for customers, who bought tickets, memberships, and vacation packages for Defendants' attractions. Instead, Defendants failed to honor and perform their duties, responsibilities, and obligations under their uniform standardized agreements with their customers, thereby breaching their contracts, but nonetheless pocketed their customers' money and converted it for their own use."A similar class-action lawsuit was filed against SeaWorld last month in San Diego federal court. In that suit, SeaWorld is accused of continuing to charge monthly membership fees to customers during the park's closure. 2329

  

SAN DIEGO (CNS) - A complaint was filed Friday on behalf of an asylum-seeking Honduran family -- which includes a newborn U.S. citizen born in Chula Vista -- that was sent across the border to Mexico to await asylum proceedings two days after the child's birth.All four family members, including the newborn who lacks legal immigration status in Mexico, were ordered across the border by Border Patrol agents, according to the joint administrative complaint filed by the American Civil Liberties Union and Jewish Family Service.The organizations have asked the U.S. Department of Homeland Security Office of Inspector General to conduct an investigation into the family's case. They say the family should have been allowed a legally required non-refoulement interview regarding the family's fears of being sent to Mexico.Reached for comment, a CBP spokesperson said, "As a matter of policy, CBP does not comment on pending litigation. However, lack of comment should not be construed as agreement or stipulation with any of the allegations."The complaint alleges the family -- father, pregnant mother and 9-year- old son -- fled Honduras about a year ago and turned themselves in at the U.S.-Mexico border in San Diego on June 27, one day before the mother gave birth to her son. As she was giving birth at Scripps Mercy Hospital in Chula Vista, her husband and son were not told which hospital she was taken to and were ordered back across the border, according to the complaint.After giving birth on June 28, the mother was "interrogated" by Border Patrol agents, according to the complaint, which says the woman asked the whereabouts of her husband and older son but was not given any information by the agents.The ACLU and Jewish Family Service allege the family should have been provided a non-refoulement interview, with both father and mother expressing fears about being returned to Mexico, but instead the mother and newborn were forced across the border on June 30.The complaint also alleges the family tried to enter the United States in March near the U.S-Mexico border in Texas and stated fears over being turned back to Mexico, but were also turned away without being provided a non-refoulement interview. They were told to return weeks later for an immigration hearing, but COVID-19 led to a postponement of their court date.While forced to wait in Mexico, the complaint alleges the family was "accosted and detained by a group of armed men who attempted to extort them."The family is now staying in a rented room in Tijuana, "and neither the newborn, nor his mother, has received any medical care since the birth," in contradiction of guidance from Scripps Mercy Hospital to have follow-up visits with doctors, according to the ACLU and Jewish Family Service."This family should have been granted release into the U.S. to await their asylum proceedings, as the Department of Homeland Security has done with more than 23,500 individuals -- all in family units -- over the past 1.5 years across the San Diego border region," said Luis M. Gonzalez, supervising immigration attorney with Jewish Family Service. "We urge Homeland Security to grant this family entry into the U.S. immediately to keep the family together and allow for adequate care for the U.S. citizen newborn child and for the mother's postpartum medical care."The complaint alleges that not providing the family with a non-refoulement interview violates U.S. law and Department of Homeland Security policies. The organizations demand the family be paroled together in the United States while they await asylum proceedings."This case reflects many of the lived horrors of both the so-called `Migrant Protection Protocols' and Border Patrol impunity," said Mitra Ebadolahi, an ACLU senior staff attorney. "No family should have to endure what this family has experienced. Together with Jewish Family Service, we are demanding a full investigation. The agency must be held to account for its disregard of basic human rights and its policy and legal transgressions." 4050
