SAN DIEGO (KGTV) — By Saturday, many businesses will be shutting their doors all over again as San Diego County deals with a new round of restrictions in the purple tier."The overwhelming majority of folks who are doing it right are forced to be punished because of the individuals who choose not to," said Nathan Fletcher, San Diego County Supervisor. "Where we are now in a situation where we're faced with all bad options."The county's public health officer, Dr. Wilma Wooten, recently requested the state reconsider San Diego County's tier placement and keep the county in the red tier. She argued that data from October revealed the county's increased COVID-19 cases are not because of the sectors that would be impacted the most by moving into the purple tier. The request was not approved."We're going to continue to work to do everything we can with the state to have an approach that's right," said Fletcher.He said it's essential that every jurisdiction across the county does what it can to reduce the spread of COVID-19."We have to come together," he said. "There are limits of what the county can do when it comes to enforcement; we really need the help of the law enforcement agencies."But some say this has gone too far. Many business owners are now choosing to defy the orders and stay open to ensure their business survives, and employees still have a job.El Cajon Mayor Bill Wells said he has taken many calls and emails about the struggles business owners face in his jurisdiction.Some say defying the orders and keeping their doors open means keeping food on their family's table. Wells said having police respond to COVID-19 related complaints won't be a top priority."A lot of us believe the government is overreaching in the situation and so, the county, if this is what the county wants to do, then they're going to have to do the enforcement," said Wells.Fletcher said the only way to get back to a sense of normalcy is to understand how serious this pandemic is and tackle the problem together."There is no functioning economy when you get out of control spread of a pandemic," said Fletcher. "So when you have the mayor of a city and jurisdiction say they're going to ignore and defy public health orders, that sends a signal to people that this is not serious and they don't need to worry about it ... Although he could cast a ballot without issue here in California, African Americans in southern states faced plenty of challenges."There were so many Jim Crow laws to keep blacks from voting in the south, all the civil rights in the south were really diminished," said Johnson.He describes the years leading up to the passage of the Voting Rights Act of 1965, which bans racial discrimination in voting, as a time filled with protest and frustration around the country."It was a chaotic time, it was a time of great distress," he said.For the longtime San Diego pastor, the right to vote isn't something he's ever taken for granted. He says since being able to cast a ballot for himself, he's voted in every single election he could."I think that's where the power is. SAN DIEGO (KGTV) — Border Patrol agents arrested five people in connection with a human smuggling incident, including one man convicted of being a sexual predator.A vehicle traveling through a temporary immigration checkpoint in Potrero failed to stop at about 6:30 a.m. Wednesday, according to U.S. Customs and Border Protection, before agents stopped the vehicle several yards past the checkpoint.Agents say five males in the vehicle were questioned. Three passengers in the vehicle's backseat said they were from Mexico but had no U.S. documentation, according to CBP. The driver and front seat passenger claimed to be from the U.S.The driver and front passenger were arrested on suspicion of smuggling and the three other passengers were arrested for being in the U.S. illegally, CBP said. During a records check at a nearby station, agents learned one passenger, a 39-year-old Mexican national, was convicted in 2012 of kidnapping and rape of a minor in San Diego. He was sentenced to a seven-year prison term and removed from the U.S.“I am proud of the great work agents demonstrated in arresting this known child predator,” said Chief Patrol Agent Douglas Harrison. “Their actions help keep our communities safer.”Both U.S. citizens face human smuggling charges and the previously deported Mexican man faces federal charges. Not a single customer in sight. 90 percent of his workers are from Tijuana and couldn’t get there.He says business has been down 40 percent in the last month. SAN DIEGO (KGTV) – Crowds are already flocking to San Diego beaches for the Fourth of July weekend.On Friday, many people claimed their spots early at Mission Beach and Oceanside.While some were able to keep their distance from one another, many did not have on facial coverings when near other people.“The majority of them are not wearing masks, I would say at this point in time,” said Rich Stropky, Marine Safety Lieutenant for San Diego lifeguards.He said more people are expected to make their way to San Diego Saturday as other Southern California beaches will be closed.Law enforcement agencies across San Diego have said they will focus on education, rather than enforcement when someone violates the public health order.He said the parking lots at Mission Beach were full by noon Friday.“As far as the capacity for our beaches, what has limited capacity in the past is the ability to park,” he said. “How far are people willing to park and still walk to the beach? Are they going to Uber in? Are they going to do drop-offs?”Stropky urged beachgoers to talk to lifeguards if they have any questions and to follow the public health order and original beach rules.“We have our COVID safety guidelines, and we want everyone to adhere to that,” he said. “We have our beach regulations; there’s no glass, there’s no dogs between 9 and 6, there’s no camping.”There’s also a beach hazard statement in effect this weekend.
