In a 5-4 decision Friday, the high court refused to grant the request from the Christian church east of Reno to be subjected to the same COVID-19 restrictions in Nevada that allow casinos, restaurants and others to operate at 50% of capacity. The church argued the hard cap on religious gatherings was an unconstitutional violation of its First Amendment rights. A top ranking member of the Sheriff’s Department is speaking about changes he feels are needed, following the investigation into Assistant Sheriff Rich Miller.On Tuesday, Team 10 confirmed Miller was being accused of inappropriate conduct. Miller is currently using his accumulated time off until his scheduled retirement on March 2nd.Commander Dave Myers, who is running for Sheriff, emphasized women should feel safe to come forward. He used the example of Deputy Richard Fischer, accused by more than a dozen women of sexual misconduct while on duty.“It took after a woman complained… another 13 women to come forward before anything was really done. A mother is grieving the loss of her teenage son, who was stabbed to death Monday morning in Palm Beach Gardens.Jovanni Sierra celebrated his birthday a day early. First, he and his friends played paintball and then they had pizza. He was about to turn 13. Sierra's mom, Karen Abreu recorded video of him with his friends, singing "Happy Birthday" to him, eating pizza. “I could just see it, that night he was so happy. I never thought in my wildest dream that I would get the news I got yesterday,” Abreu said.Jovanni went over to stay at his friend, Dane Bancroft’s house. They’ve known each other for years. “I had told him, are you sure baby? I want you to come home. I want to sing happy birthday, give you a hug and a kiss for your birthday tomorrow,” she said. “He’s like mom, 'It’s OK. I’m going to have fun, please, I love you,’ and that’s the last words he said to me."Palm Beach Gardens police say Dane’s older brother had his friend, 17-year-old Corey Johnson, over that night too. Johnson told police he waited until everyone was asleep around 4 a.m. to kill Jovanni, Dane and Dane’s mother, Elaine. Johnson was allegedly inspired by his Muslim faith, and violent jihadist videos, which encourage killing non-believers, he told police. Dane and Elaine were hurt. Jovanni was killed in a brutal knife attack. Karen says any rumors her son made fun of Johnson are wrong. “I don’t feel like my son is one to make fun of anybody. A Philadelphia police officer who was seen on video pulling down the masks of protesters and spraying chemical irritants in their faces was charged Wednesday with simple assault, reckless endangerment, official oppression, and possession of an instrument of crime, the Philadelphia Inquirer and CNN report.Officer Richard P. Nicoletti, 35, turned himself in on Wednesday.The charges against Nicoletti stem from a June 1 Black Lives Matter protest, when demonstrators blocked I-676 in Philadelphia. Bystander video showed Nicoletti — who was acting as part of the Philadelphia Police SWAT team — approaching three protesters who were kneeling and sitting on the ground.The video shows Nicoletti pull down the demonstrators' masks and spray pepper spray in their faces. He also shoved one of the protesters. The District Attorney's statement claimed Nicoletti sprayed the protesters "without provocation."None of the demonstrators were arrested.According to CNN, the Philadelphia Police Department reviewed the bystander video and opened an investigation on June 24.The officer's lawyer, Fortunato Perri Jr., said Nicoletti was simply following orders."His unit was ordered by commanders to clear the highway with the approved use of tear gas and pepper spray," Perri said, according ot the Inquirer. "The city's leadership was given the opportunity to apologize for approving the use of force, but Nicoletti finds himself fired and charged with crimes." 1460
