SAN DIEGO (KGTV) -- Isabel Rosales was brutally attacked and nearly killed by her husband in January 2018."It was life or death, my ex husband attacked me in front of my kids," said Rosales.Rosales was married for 16 years. She and her ex-husband moved from Chicago to San Diego for a fresh start. But Rosales says the abuse only got worse."Sexual abuse, verbal abuse, physical abuse, everything," said RosalesShortly after their 16-year anniversary Rosales told her Ex-husband she wanted a divorce. She barely made it out of the family home alive."I was getting ready to go to work and we had been arguing...his behavior had been kind of erratic over the last few weeks. I thought he was agreeing with me when he said it ends here. I thought he was getting his suitcase and leaving. He followed me into the bathroom and he stabbed me. I ran into the kid's room and he stabbed me in front of the kids who were sleeping. I was able to push him out of the way and I ran out of the house. Before I ran out of the house though he attacked me again at the front door. I knew if I didn't make it out of the door it was over and by the grace of God the door opened."Rosales was in the ICU at UCSD for three days with a breathing tube. She says she fought to stay alive for her three children and her mother, who was killed by her boyfriend in 2011."My mother was murdered by her boyfriend in Mexico. And my ex-husband attacked me in a very similar way."Rosales says she had what her mother did not. Help. Hers came in the form of Operation for Hope, a San Diego non-profit that helps provide emergency services to victims of domestic abuse. Rosales was given emergency shelter and money to pay for a divorce attorney."It helped me have a future. It gave me exactly what it promises- HOPE."Rosales has this advice for other survivors."I was ashamed to ask for help. I didn't know services like this exist. I am here to tell you there's great courage in asking for help and taking that first step... I hope and I pray to change one other person's world out there by sharing my story. My heart aches for those who do not make it like my mom, for those who do not know how to get out or where to go, for those that think an abusive relationship is normal. Anything is possible and each and every person is deserving of a beautiful and safe life... I am happy now. These tears are tears of joy."During the pandemic, domestic violence incidents have increased. From January to June 2020, there were 8,495 domestic violence incidents reported to law enforcement in San Diego County, as compared to 8,235 during the same period in 2019; a 3% increase from the prior year according to the San Diego County District Attorney's office. The Victim Assistance Program advocates at the District Attorney's office served 2,940 victims from March-July 2020, as compared to 1,941 in 2019; a 51% increase in those served.Operation for Hope will hold it's biggest fundraiser of the year October 28, 20202. 10News Anchor Vanessa Van Hyfte will be emceeing the live event and silent auction. SAN DIEGO (KGTV) - It took just three months for Tyler Walter to turn from a happy and healthy toddler into a dead one while in the care of the County of San Diego, according to a recent lawsuit."Defendants literally ignored Tyler to death."Those are just two of the claims in the lawsuit filed by Tyler's mother, Lisa Walter, against the County of San Diego and several social workers.Tyler Walter died shortly after being placed with a foster parent. The cause of death listed on his autopsy is blunt head trauma. His body after death, not returned to his mother for burial but cremated, the lawsuit claims.County social workers failed multiple times in their duty to monitor Tyler's living condition and update his mother, and the Juvenile Court, regarding the dramatic change in living conditions of his county-approved caregiver, according to the lawsuit.Tyler was taken from his mother after sheriff's deputies found drugs at the house where she was staying.Tyler's mother was charged with child abuse, possession of a controlled substance, and possession of paraphernalia used for narcotics. According to the San Diego County District Attorney's Office, Walter pled guilty to all charges and is currently going through a drug court program.After Walter's arrest, a social worker told her, "Tyler would be out of Lisa's care for a minimum of six months," the lawsuit stated. The lawsuit explained the social worker said that no matter the circumstances, she never returns any child earlier than six months and voiced only contempt for Walter.Shortly after Tyler's mother was arrested, his 19-year-old cousin became his foster mother in July 2018, the investigators report in Tyler's autopsy stated. 10News is not identifying the family member because she hasn't been accused of anything.Tyler's cousin lived in a home 100 miles away in Long Beach."The placement they put him in was a home daycare center with a 19-year-old and her partner," said Walter's attorney Shawn McMillan.RELATED: Mother claims San Diego County was negligent in death of her child while in Foster CareMcMillan said Walter requested that her son be placed with his grandmother, but social workers didn't let that happen.McMillan explained Walter was trying to reunite with her son and comply with her reunification plan, which included having to participate in regular visitation with him.According to the lawsuit, "Even the Juvenile Court judge, upon learning of the placement, questioned the defendants' decision and expressed concern that Tyler was placed outside of the County of San Diego."The lawsuit states, the defendants used Tyler's "remote placement as a punishment tool – to impose a huge burden on Lisa in order for her to see her own child. Their intent was to make visitation so extremely difficult and burdensome on Lisa, that she would either fail or give up."The lawsuit also accused the county and social workers of failing to provide any means for Tyler to receive or pay for medical care while in his cousin's care.According to Tyler's autopsy, he was in and out of the hospital in the weeks leading up to his death. He was vomiting and wouldn't eat.The lawsuit stated when his caregiver took him to one of his appointments, she was turned away because social workers failed to provide her with, or set up Tyler's medical insurance program. It also claimed his caregiver repeatedly attempted to contact social workers but received no response. "As a matter of law, regulation, procedure, and policy Tyler’s medical insurance was required to be in place and fully functional before Defendants, and each of them, dumped Tyler into nineteen-year-old's care. But defendants failed to do so," the lawsuit stated.Tyler Walter's DeathAccording to the lawsuit, Tyler's cousin and her girlfriend were kicked out of the home where they were living about a week before he died.The lawsuit stated they were homeless and living out of a car in a park in Long Beach."I am not clear under what set of circumstances in what universe that would be an appropriate placement," McMillan said.Tyler Walter died on Sept. 22, 2018.According to his autopsy report, Tyler was fussy and didn't eat much the day he died.Tyler's foster mother and another adult drove Tyler to a park not far from where they were staying. They parked, unbuckled Tyler from his car seat, and one of the adults smoked marijuana, the autopsy stated.The report stated that a short time later, they noticed Tyler was, "slumped completely over with his entire top half folded in half. His back seemed splotchy. [One of the adults] got him out and noticed he was not breathing. She took him to the table and began screaming for help. CPR was performed and when the decedent was turned over, dark fluid and mucus came out of the decedent."The report stated paramedics arrived at the scene and transported Tyler, but he was pronounced dead at the hospital.The official cause of death listed on his autopsy report is blunt head trauma.The autopsy report showed Tyler had a skull fracture, bruises on the left and right side of his forehead, discoloration behind his ear, a bruise on his cheek, and a cut under his chin.The medical examiner listed the manner of death as undetermined.The Long Beach Police Department told 10News the investigation into Tyler's death is ongoing. According to the lawsuit, Tyler's mother was in shock following news of his death. It stated, "Adding further trauma, Lisa was barred from retrieving Tyler’s remains in October of 2018. Importantly, at no point were Lisa's parental rights ever terminated. But the County refused to relinquish Tyler’s body to Lisa. In spite of Lisa's protest, the County gave the body to others."Tyler's funeral was arranged by the very people whose actions led to his death, the lawsuit claimed. "He was promptly cremated. But, Lisa had wanted Tyler to be buried. Lisa was not even consulted by the County as to the disposition of her son's remains," the lawsuit stated.The County of San Diego did not respond to our request for a comment on this story.In a previous story about Tyler Walter's death, a spokesperson wrote, "The safety of children in the County's care is our number one priority. We join in the grieving for this child's passing. SAN DIEGO (KGTV) - Marine biologists and other experts are at Fiesta Island Tuesday morning to try to determine what caused the death of a large whale.The gray whale was discovered by lifeguards on the shore of Blacks Beach Monday at about 11 a.m.The dead whale was eventually towed from the Torrey Pines area to Fiesta Island, arriving at 3:30 p.m.Officials with the National Marine Fisheries were called to Fiesta Island to perform a necropsy.After Tuesday's examination, the whale is expected to be transported to the Miramar Landfill.  552

Duncan Hunter, changed her plea to guilty to one count of conspiracy in a plea deal with the federal government over misused campaign funds Thursday.As part of a plea deal with prosecutors, Margaret Hunter will testify against her husband in his upcoming trial in September. The congressman and his wife both pleaded not guilty in 2018 to federal charges of using 0,000 in campaign funds for personal use and falsifying campaign finance reports. "Defendant agrees to plead guilty to Count One of the Indictment charging her with conspiring with co-defendant Duncan D. Hunter to knowingly and willfully convert Duncan D. Hunter for Congress Campaign Committee funds to personal use by using them to fulfill personal commitments, obligations and expenses would have existed irrespective of Hunter's election campaign and duties as a federal officeholder, in amounts of ,000 and more in a calendar year," the plea deal states.Those expenses include a ,000 family vacation to Italy and a 0 Easter brunch at the Hotel del Coronado.READ THE PLEA AGREEMENT HEREThrough her attorney, Margaret Hunter apologized for her actions through her attorney outside Federal Court on Thursday."I understand that there will be more consequences stemming from my actions, but as demonstrated this morning with the entry of the plea, I have taken the first step in facing those consequences," said Tom McNamara, her attorney, in a prepared statement.According to an affidavit, Hunter allegedly spent the money on expenses like vacations, dental work, tuition, movie tickets, video games and home utilities, among other things.The affidavit goes on to allege that the Hunters lied about the purchases in FEC filings, claiming the money was used for things like dinner with volunteers or campaign contributors, toy drives and teacher/parent events.Rep. Duncan Hunter issued a statement which reads:"I do not have the full details of Margaret’s case, but it's obvious that the Department of Justice (DOJ) went after her to get to me for political reasons. As Margaret’s case concludes, she should be left alone. I am the Congressman, this is my campaign and any further attention on this issue should be directed solely to me. The DOJ’s prosecutorial actions in this case were led by local U.S. Attorneys who attended Hillary Clinton fundraisers in violation of the Hatch Act. The fact remains that this entire matter should have been handled by the Federal Elections Commission (FEC). The DOJ purposely choosing to involve itself in the area where the FEC has primary jurisdiction reveals that their primary agenda was to inflict as much political damage as possible in hopes of picking up a congressional seat. It was politically-motivated at the beginning, it remains politically-motivated now."A trial date was set for September 10, 2019, but that is expected to change following this morning’s court appearance. A conviction would not force Hunter out of office. It takes a two-thirds house vote to do that, meaning 55 Republicans would have to move the same. San Diego Political Analyst John Dadian said he believes Hunter would be expelled if convicted. He added President Trump could pardon him, but it would likely be after the 2020 election. Meanwhile, he said East County Republicans are preparing to file to run if they see an opening.
