SAN DIEGO (KGTV) - Hundreds of criminal cases are being examined and reviewed to make sure prosecutors got the right result. That mission is part of the San Diego County District Attorney’s Conviction Review Unit. The unit has been around for about two and a half years, but there are new visible results of its work.Investigators say Donnell Fulcher shot and killed Roberto Rodriguez shortly after midnight on September 10, 2006.Rodriguez’s pregnant girlfriend was wounded but survived. According to court records, investigators connected Fulcher to the scene in part through DNA evidence found on a glove. Fulcher has always maintained his innocence. “We argued that he was not involved at all,” said his defense attorney, Knut Johnson. “There was also in my view, evidence of some other people who are very likely candidates for people who might have committed this crime.”Because of changes in the way DNA is now analyzed, Fulcher got what most defendants will never see—a chance at a new trial.“The prosecutor’s role is to ensure justice before, during, and after trial. This unit is just another way we can fulfill that mission,” said Bryn Kirvin, the deputy district attorney who leads the conviction review unit. Part of their efforts went into looking at all cases where there could be DNA mixtures, meaning more than one DNA profile in a sample.That’s because guidelines by SWGDAM (Scientific Working Group on DNA Analysis Methods) changed the way they interpreted DNA. “They decided [they wanted] to take a more conservative, a more cautious view when analyzing low-level mixtures,” Kirvin said.According to the District Attorney’s office, approximately 1,525 defendants were tried to jury verdict between 2003 to 2016 for serious or violent crimes. Most did not involve DNA, but in 351 cases, DNA was used at trial.Of those, 254 defendants’ cases involved mixtures. That included Fulcher’s case. Team 10 was in court on October 29th when Fulcher chose to plead guilty to voluntary manslaughter and assault with a firearm, instead of going through another trial.The judge sentence Fulcher to 14 years, but he received credit for time already served. He has since been released.Prosecutors with the unit did not talk specifically about Fulcher, but emphasized their mission of finding justice. “Anything about the case that gives us doubt that we lose our confidence in the conviction, we shouldn’t be afraid to act. We should be running to the courthouse to act,” said Deputy DA Brent Neck who also works with the conviction review unit.In Fulcher’s case, prosecutor Hector Jimenez still believes they got the right individual. “We still believe that we have the right guy, but we lost confidence in the conviction, so we wanted to give the defendant a chance to have a new trial if he wanted,” he told Team 10 on October 29.“He chose to plead guilty instead, so at the end of the day, I believe justice was done.” Anyone can apply to get a conviction reviewed, but there are guidelines.The conviction must have happened in San Diego County Superior Court, the person must still be in custody, and the conviction must be for a violent or serious felony.There must also be some type of credible evidence of innocence. “It doesn’t matter how old the case is. We’re going to be willing to go back and look and make sure that we got it right,” Kirvin said. 3412
SAN DIEGO (KGTV) - Hundreds of people lost power in Liberty Station and Point Loma Friday as a result of what San Diego Gas and Electric identified as an electrical problem.A witness reported an underground explosion and smoke coming from a manhole cover about 2 p.m. at 2230 Truxtun Road at Womble Road. The location is near the Trader Joe’s and Rock Church.1,200 customers lost power about the same time as the manhole report. SDG&E said the problem was electrical but did not provide details. SDG&E restored power about 4 p.m.Students at nearby High Tech High School exited the building away from the emergency location as a precaution.The power outages led some nearby businesses to close. 10News talked with a customer of The Lot movie theater who said the power shut down during a screening of the new Avengers movie. SAN DIEGO (KGTV) - Hundreds of men in high heels strutted through downtown San Diego on Saturday morning to support victims of domestic violence.The 11th annual “Walk a Mile in Her Shoes” event started with the mile walk and ended with a family festival featuring face painting, live music and more.“It is a lighthearted way to bring awareness to domestic violence,” said Heather Frinlay, the Chief Operating Officer of the YWCA of San Diego County. The morning of family fun raised money for programs that provide victims of domestic violence resources like housing, counseling, and legal aid.“This is not a private issue; this is a community issue,” said Frinlay. “We still have one in four women, and now one in seven men experiencing domestic violence in their lifetimes.”San Diego County reported more than 17,000 incidents of domestic violence in 2017. 871

According to a budget released by SANDAG, most of the funds will go towards transportation, not roads. The move has some throughout the county concerned that not enough will go toward roads in need of repair. “I'm pragmatic about it and I do worry about the fact that these tend to suck up all of the money and leave nothing left for highways,” said El Cajon Mayor Bill Wells.The concern comes after SANDAG announced “5 Big Moves.” The project focuses on the future of public transportation. Read all five points of the plan below: Complete CorridorsThe backbone of a complete transportation system that leverages technology, pricing, and connectivity to repurpose how both highways and local roads are used and managed. Complete Corridors would increase safety, capacity, and efficiency; provide dedicated space for high-speed transit and other pooled services; manage demand in real-time; and maximize use of existing roadways. Local roads are designed and operated to equally accommodate all users, including transit, cars, bikes, pedestrians, and commercial vehicles. Features may include dynamically managed curb space, transit amenities, bike facilities, pedestrian refuges, or smart intersection systems. Smart intersection systems would improve safety for all modes through use of sensors and alerts to vehicles and individuals, and could give transit priority treatments that make transit faster and more reliable. Wireless charging at parking facilities, intersections, and/or roadways will support future induction charging for zero-emission vehicles. Complete Corridors will provide connections to the Mobility Hubs network and infrastructure to support use of shared, on-demand Flexible Fleets. Transit LeapA complete network of high-capacity, high-speed, and high-frequency transit services that incorporates new transit modes and improves existing services. SAN DIEGO (KGTV) — For the first time Tuesday, 12-year-old Kiera Latulippe faced the man who killed her entire family in a drunk driving crash. The Valley Center girl was in the car with her family headed to the Austin, Texas, airport after vacation when the drunk driver hit their car head-on. Her father, Scott; mother, Nancy, and 14-year-old brother, Jackson, all died. Kiera was the only one to survive. On Friday, Guy Brasted was sentenced to 18 years in prison. After the sentencing, Kiera and her uncle and legal guardian, Mark Latulippe, took the stand with an emotional message for Brasted. "It made me miss out on so much, like daddy daughter dances," Kiera said, listing the things she can't do now that her family has been ripped away from her. RELATED: Valley Center remembers family killed in DUI crashOn Tuesday, after the pair returned from the sentencing in Texas, Latulippe told 10News, "it was extremely emotional for her having to look at this again and place herself in that car again." Brasted had a blood alcohol level more than double the legal limit at the time of the crash."My brother, Jackson, and I had something I can never have with someone else, and it kills me to know I will never have that feeling with anyone else. Everyday I think about him," Kiera said.Since the accident happened two years ago, Latulippe has taken his niece into his own care."I can't replace, I'm a fill-in parent for someone who has tragically had everything robbed from her in one moment," Latulippe says.Latulippe is a CHP officer for California Highway Patrol. He says he now shares his story to prevent drunk drivers from getting behind the wheel, not only as an officer but now, as a victim. 1713
