VISTA, Calif. (KGTV) - Several schools in the Vista Unified School District are returning back to virtual learning for two weeks after positive COVID-19 cases were identified.The district reopened for in-person learning at normal capacity, also known as Vista Classic, on October 20th. According to the district’s website, 17 cases have been reported since October 20th.District Superintendent, Dr. Matt Doyle, said Vista Classic and Vista Virtual were designed to work together so that there is the flexibility to move back and forth.Mission Vista High School, Vista High School, Madison Middle School, Roosevelt Middle School, and Rancho Minerva Middle School are also back to Vista Virtual due to positive cases.A class of 28 students and one teacher at T.H.E. Learning Academy Elementary school is also under quarantine after one positive case was reported.Last week the school unanimously approved a plan that would close down some middle and high schools for two weeks when positive cases are reported.The closures would happen if one school has two or more positive cases at the whole time, the entire school would switch back to Vista Virtual for two weeks. If three secondary schools have one positive case each, all three will return to Vista Virtual for two weeks.“I think two is tough; that doesn’t give us a lot of confidence that it won’t close down again,” said Dolly Goulart, a parent of a Mission Vista High School student who has been back to virtual learning.“I do appreciate that they’re doing trying to get classic families back in. They gave families a choice over the summer.”Goulart said her son’s transition back to Vista Virtual went smoothly.“From my perspective, it seemed perfectly seamless. He did fine pivoting back,” said Goulart. “He’s about a week into his two-week virtual pivot.”“We meet regularly with representatives from the S.D. Health and Human Services Department to discuss our health and safety measures and make adjustments as appropriate,” said Dr. Doyle in an email to A.B.C. 10News.Doyle said in just weeks, a high volume COVID-19 testing center would open in Vista Unified.Before school reopened, the district notified parents that they couldn’t guarantee that students would be six feet apart in class.The district’s website stated, “It is important to note that while many health and safety precautions are in place for the Vista Classic learning model, all classrooms will have the normal amount of students enrolled. This means that while we will be following social distancing procedures, student seating arrangements will be less than six feet apart.”There have been mixed reactions to the reopening plan from teachers and parents; some like Goulart are happy with the plan, while others call for revisions.“Why are we allowing kids not to social distance within our classrooms?” asked Keri Avila, the Vista Teachers Association president. “When we talk about keeping businesses open, when we talk about returning to some sort of normal, this takes that all away.”Avila said, in some cases, students are in crowded classrooms without enough safety measures in place.She’s calling on the district to make changes to the current reopening plan so that schools can remain open.“We hope to work with our district to create a system to keep our schools open, not one that keeps pivoting back to virtual,” said Avila.Two positive COVID-19 cases have also been reported at Alta Vista High School, but ABC 10News has not been able to confirm if the school has closed down. 3527

(KGTV) -- The San Diego District Attorney is expected to decide later this week whether there should be a new trial in the case of Kellen Winslow Junior.Tuesday morning, the judge declared a mistrial after the jury said it was deadlocked on eight remaining counts. The counts include kidnapping, forcible rape and forcible oral copulation involving a hitchhiker last year in Encinitas and forcible rape and rape of an unconscious person for an alleged attack on a teenager at a party in Scripps Ranch back in 2003 when she was 17 and Winslow was 19. The other counts the jury deadlocked on are willful cruelty to an elder and battery against an elder. The prosecutor said the jurors were leaning toward conviction. "On each one of the counts, there were a majority of jurors who voted in favor of guilt. They voted 10-2 in favor of guilt on forcible sodomy of Jane Doe 2. They voted 10-2 in favor of guilt for the forcible rape of Jane Doe 4. They voted 10-2 in favor of guilt on the counts of elder abuse and elder battery regarding Jane Doe 5 and then they voted 8-4 in favor of guilt on the rape of an unconscious person for Jane Doe 4 and they voted 7-5 in favor of guilt on the kidnap for rape, forcible oral copulation and and forcible rape of Jane Doe 1," said Prosecutor Dan Owens. Defense attorneys said the deadlocked jury shows there were credibility issues among the accusers. There was no corroborating evidence whatsoever, it's just people's word," said defense attorney Brian Watkins. The case involved 12 counts and the testimony of 5 women."We were always concerned about trying the cases together. Our position was always that these cases would not be able to stand alone. We fought to keep the cases separate. We lost that battle. We took on all these cases at once and we still prevailed to the point that we did not get convicted of everything and we have more litigation to do," said Watkins. Monday afternoon, the jury convicted Winslow of raping a 58-year-old homeless woman in Encinitas last year. Jurors also found the former NFL tight end guilty of indecent exposure and lewd conduct involving two other women. He was acquitted of a second count of lewd conduct involving one of those women. Watkins said they'll appeal the three convictions. "We won't be satisfied until he's exonerated and he's back home with his family," said Watkins. "Right now, he's facing eight years in state prison, life time sex offender registration for the forcible rape of Jane Doe 2. He'd be facing an additional 6 months for each 1 of the misdemeanor counts of indecent exposure and lewd acts committed against Jane Does 3 and 5, for a total of potentially 9 years in prison," said Owens. Sentencing is on hold until a decision is made about a new trial. Winslow's father, Kellen Winslow Senior, a Chargers Hall of Famer attended every day of the trial, but declined to talk to the media. A hearing is scheduled for 10 a.m. Friday on setting a new trial. "Ten jurors did feel very strongly that he had committed forcible sexual offenses against more than one victim, that would lead to a lifetime prison term and that will be another factor we will consider very strongly in determining how to proceed with the case," said Owens. 3618

VISTA (CNS) - A 24-year-old man was behind bars today for reportedly crashing his car into a freeway work zone in the far northern reaches of San Diego County while drunk, injuring himself along with two construction crew members.Ross Rodgers, 24, was headed south on Interstate 15 near Mission Road in the unincorporated Rainbow community about 10:50 p.m.Sunday when his 2008 Toyota Prius veered over traffic cones and entered the closure area, where it hit the back end of a stationary 2008 Ford F-250, according to the California Highway Patrol.A worker behind the wheel of the pickup truck and a second one on foot nearby suffered apparently minor injuries in the wreck.Medics took the two men, ages 30 and 36, to Palomar Medical Center in Escondido for evaluations, CHP Officer Kevin Smale said. Rodgers was arrested on suspicion of drunken driving and transported to the same hospital for treatment of a broken bone in his right foot.Upon his release from medical care, the San Diego resident was booked into the county jail in Vista on suspicion of felony DUI.The crash led to intermittent closures of parts of the freeway in the area until about 5 a.m., Smale said. 1186
