SAN DIEGO (KGTV)- A trip to a dog park in Ocean Beach ended in a hospital visit for one San Diego couple.“I want her to go to jail, she assaulted my husband, and I’m angry about it,” said Ash O’Brien.O'Brien said she and her husband were at Dusty Rhodes Dog Park in Ocean Beach Thursday afternoon with their three-month-old puppy. They sat at a picnic table and began enjoying a meal when a woman reportedly confronted them for not wearing facial coverings and eating at the park where there is a no food policy.The confrontation ended with O’Brien’s husband being pepper-sprayed by the woman.“If we knew there was a no food policy, we wouldn’t have brought it into the park,” said O’Brien. “The lady who maced him automatically started saying stuff about us not wearing a mask when we were social distancing; there was no one near us.”O’Brien said that after exchanging words, the woman walked away from the picnic table but returned after a few minutes and did the unexpected.“She just came up without saying anything and just stuck the mace can right in front of my face,” said O’Brien.“My husband, being a good guy, walked in front of her and was like ‘hey calm down please don’t do this’ and then she grabbed him and just starting macing him, she used the entire can on him.”“We drove to the hospital, he got treated and everything,” said O’Brien.O’Brien said the pepper spray got on her arms and started to burn, while her husband was sprayed in the face.A witness captured part of the incident on camera and told ABC 10News she was shocked at what she was seeing. She recorded the woman’s license plate number.The couple filed a police report with the San Diego Police Department. The department confirmed they took a misdemeanor battery report but could not immediately provide further details.O’Brien was thankful none of the dogs at the park were injured by the pepper spray and wants the woman to be held accountable for the incident.“People don’t need to be getting assaulted for not wearing a mask in a public outdoor area,” she said. 2055

SAN DIEGO (KGTV) - Vandals damaged a park in Sabre Springs Thursday night, dumping sand into toilets and scrawling inappropriate graffiti on the walls. Trash cans were emptied out and piles of wood chips were dumped along the entrance to the South Creek Neighborhood Park. The clogged toilets and sinks caused minor flooding in the bathrooms. Some of the plumbing was also damaged, according to the San Diego Police Department. City crews cleaned up the mess by the afternoon. Police were still searching for the culprits Friday. 537

SAN DIEGO (KGTV)-- A San Diego mother says working from home during the coronavirus pandemic cost her her job. She claims she was fired because her kids were making noises in the background of her teleconference calls."We're letting you go," Drisana Rios said. That was what her Human Resources representative told her in a call earlier this month. She said she thought the call was supposed to help resolve her workplace problems. Instead, by the end of the call, she says she was fired.Rios says it all began in mid-March when her bosses at an out-of-state insurance firm told her to work from home and telecommute via conference calls. This was in response to the state's COVID-19 lockdown orders.Rios says all parents working from home received an email from the company's regional boss that read, "thank you for the incredible effort you are putting forth through these difficult times." She says it also said that they would avoid layoffs during the pandemic.Like many parents, Rios was unable to find childcare for her four-year-old daughter and one-year-old son. Despite juggling parenting and working from home, Rios claims she was able to complete all her tasks. She adds that her clients never complained about her kids being in the background of her conference calls. The only complaints, she says, came from her male, direct superior."I said, 'Do you want me to lock my kids in the room? My one-year-old in the room? Do you want me to do that?' And… he responded and said, 'Figure it out.'" Rios said.She says she tried to arrange calls to be during her children's afternoon naptimes but claims her boss continued to ignore and demean her."He would purposely overlap schedules," Rios said.Rios then reached out to her HR department and asked how she should deal with the harassment she says she was experiencing-- a move she says that backfired a week later."She was shamed for having children, so she first elevated it to Human Resources," Daphne Delvaux, Sr. trial attorney at Gruenberg Law, said. "Human Resources took the side of the abusive manager, and terminated her for complaining."Rios has since filed a lawsuit against both her direct boss and the company for Gender discrimination, Retaliation, Gender harassment, Failure to prevent gender discrimination, Negligent supervision, Intentional infliction of emotional distress, and Wrongful termination in violation of public policy.In her complaint, Rios claims her HR representative told her that the company was "...experiencing a reduced revenue due to COVID-19 and they were laying [the] plaintiff off as a result of the pandemic." But Rios believes this was retaliation."The fact that they tried to cover it up because I went to HR, it's obvious what they did," Rios said.ABC 10News reached out to the company headquarters for comment on this lawsuit. SAN DIEGO (KGTV) – Two bystanders were hurt in a shooting Saturday evening in Paradise Hills.San Diego Police said two Hispanic men were shooting at each other around 5:30 p.m. in the 2300 block of Reo Dr. 10News spoke to witness Jauhn Hinkle, who was waiting to get his hair cut at the Fade Factory across the street. “Small caliber pops started going off across the street. I saw a muzzle flash,” he said. Hinkle said the fight began near the corner of Reo Drive and Cumberland Street. It escalated, as the two began to yell obscenities. Then one of the men started to chase the other while shooting at him. Hinkle recalled seeing five or six shots, all of which seemed to miss the intended target. Instead, two innocent bystanders were hurt. A bullet hit a 15-year-old boy in the thigh, and shrapnel hit a 48-year-old woman in the leg, police said.Hinkle ran toward the woman, who took cover in the La Palapa Market. “I asked where she was shot. She didn't know because of adrenaline and shock. She was on the phone screaming,” Hinkle said. The woman was transported to the hospital from the scene. The 15-year-old boy was transported to a different hospital, at a later time, San Diego Police said. Both suffered non-life threatening injuries.Hinkle said it is disappointing to see his neighborhood be the scene of a violent crime.  “Project Reo is doing an excellent job. Shout out to them," Hinkle said. "We want this place to pick up. and I think it is, so it's not reflective of what this neighborhood is like.”The shooters ran away. SAN DIEGO (KGTV) - Video captured shots ringing out, apparently pelting cars in a Rolando neighborhood, including the vehicles of a family already impacted by the pandemic.A shattered windshield is what Ondria Aviles found when she went to her Dodge Journey, parked outside her home along Marraco Drive on Monday night."Just couldn't believe that had happened," said Aviles.Her husband came out and found the driver side window of his truck - also parked on the street - was also shattered."My husband had a BB pellet hole in his window," said Aviles.Turns the moments their vehicles were vandalized were captured by neighbor Ryan Dick's surveillance camera. Just before 7:30 that night, a red sedan was recorded driving through when three shots rang out in a span of three seconds. The final two shots sounded near Aviles' vehicles.According to posts on the Nextdoor app, at least four other cars and homes were struck in a several-mile stretch. "Couldn't imagine if they missed and hit someone, a young child. We have three kids," said Aviles.Along with her outrage, there is frustration. The bill for the window damage will be a hardship. Because of the pandemic, she's been furloughed for several months. Her husband's work hours reduced."This is the worst time this could happen, in our current situation," said Aviles.That mystery car is believed to be a maroon Lexus IS.
