A summer night at Cedar Point in northern Ohio in late June of 2015 was nearly over after one more ride for Theron Dannemiller, when the safety gates on the Raptor roller coaster got in his way."They started to shut on me," Dannemiller said. "I'm hurt and I look down and I can see the gash...you can see inside my leg."Dannemiller said something sharp on the gate caused a gruesome cut on the front of his shin that didn't heal for a year and now leaves a nasty scar."Most people are not aware that there is no tracking system for these injuries," Tracy Mehan, the Nationwide Children's Hospital Manager of Translational Research said. "We are able to get a feel for what's happening, but it's just an estimate."The comprehensive data she pulled together is little more than a best guess because no one tracks many of the bumps, bruises and even broken bones from amusement park rides. No one, at least, who is willing to share that information."There are people keeping track of the incidents and the injuries, but it's the amusement parks themselves,"  Jarrett Northup, a law partner at Jeffries, Kube, Forrest and Monteleone Co., said.Northup said in personal injury lawsuits, privately owned amusement parks hold all the cards because the injury data belongs to parks themselves. "It's probably data that the corporation feels can be used against them," Northup said.Cedar Point, for instance, has its own private police department and its own paramedics, so information about who they treat and what for isn't public."Having that information readily available to the public would make it easier to hold the amusement parks accountable," Northup said.There is some park injury information that becomes public when it's reported to the state.The Ohio Department of Agriculture requires stationary amusement parks, like Cedar Point or Kings Island near Cincinnati, to disclose an incident within 24 hours if it led to an overnight hospital stay. But even then, accountability is a challenge.Reports from the last five years documented many issues that had nothing to do with how the rides operate, like dizziness, elevated heart levels and heart attacks. It also shows that even parks struggle to figure out if an incident needs to be reported because they lose track of the injured person after they go to the hospital."If they go to the hospital and don't report that it was an injury due to an amusement ride, we don't see any of that," Mehan said. "So this is just the tip of the iceberg."In 2013, there's a record of when the state saw the iceberg below the water.In that report, the Department of Agriculture fined Kings Island 0 for not reporting an injury in 2013 until months later. Kings Island told the state they didn't know the injury created a long hospital stay, requiring a report, until the person who got hurt contacted them months after it happened. The park eventually paid the fine, costing them the price of 12 daily admission tickets.Scripps station WEWS in Cleveland looked for what the state isn't capturing.Those private police departments and paramedics can't transport injured riders to the hospital, so they have to call local ambulances. Just in 2017, the Sandusky EMS call log shows five trips in six months to Cedar Point for injuries like a broken leg while getting on a ride, a dislocated knee from a waterslide and one child who fell off an inner tube and hit his head.None of those incidents created any report to the state.Cedar Point and Kings Island, both owned by parent company Cedar Fair, issued the following statement: 3641

A new rule change will allow parents to get their children vaccinated at pharmacies in all 50 states.“Her pediatrician wanted her to have a pneumonia vaccine because of what’s going on with COVID. Unfortunately, the pediatrician doesn’t stock it, it’s expensive to order,” said Theresa Tolle, who owns a pharmacy in Florida.She was recalling a story involving one of her customers who needed to get her daughter a vaccine.“The Health Department didn’t have it and the mom was losing her mind. Calling everywhere and nobody, no pharmacy can give it because of the laws in our state,” said Tolle.It’s a story a lot of parents can relate to, especially around back-to-school time. Because of the laws in Florida and many states, Tolle, who is licensed to administer vaccines to adults, wasn’t able to do the same for this young girl.“Ultimately, what I ended up doing is ordering it for mom, ran it through her insurance, she picked it up, had it taken to the pediatrician to administer,” said Tolle.For many busy parents, making an additional appointment and taking time off to get their kids a shot can be a headache.But the Department of Health and Human Services just made a rule change that might make things easier. It allows for pharmacies in every state to administer vaccines to kids aged three to 18.According to the Centers for Disease Control and Prevention, after kids turn three, they should still get major immunizations like second doses of the measles, mumps, rubella, polio, tetanus, diphtheria and others. And don’t forget to add an annual flu shot.“As long as it increases vaccination rates, I think it’s fantastic,” said Dr. Malcolm Anderson.Anderson works in the Pediatric ICU at the Rocky Mountain Hospital for Children in Colorado. He’s very supportive of the rule change.“In the pediatric ICU, we only see the children that don’t get vaccinated and then when they get one of the illnesses they would have been protected against. That’s when we see them. So, I think anything that would help them get one of those bad illnesses would be amazing and help the parent avoid the stress and hardship of going through an ICU admission and seeing their kid very ill,” said Anderson.Before the rule change, 30 states had restrictions on vaccines being administered by pharmacies. Three states, including Florida, did not allow it at all.But now, pharmacies in all states can give flu shots to kids and adults.“This fall, they are heavily trying to promote flu shots to try and help protect all patients, all ages,” said Tolle.“If you’re at the pharmacy refilling your meds every three months or every month, then it’s nice to be like, oh, you’re offering flu shots here, I’m already getting my meds,” said Anderson.Theresa says she thinks that the rule change could also get the country ready for mass distribution of a COVID-19 vaccine.“Just COVID vaccine coming. We know little about that right now, but this order in theory would prepare pharmacists to be able to do that,” said Tolle.Until a COVID-19 vaccine comes, Tolle says she’s just happy to be able to give kids the immunizations they need to stay healthy. 3137

A Michigan State University trustee who pledged support for victims of sex abuse has opposed them repeatedly in courtrooms as a lawyer, an investigation by Scripps station WXYZ in Detroit has found.Trustee Dan Kelly was elected to the board of trustees in 2016 as the Larry Nassar sex abuse scandal erupted.  His university bio touts 25 years experience as an attorney representing school districts.  In at least seven cases reviewed by WXYZ, Kelly represented districts accused of failing to protect students from sex abuse.Kelly has represented districts like Roseville, Dundee and, at least four times, Warren Consolidated Schools in sex abuse civil cases.Former Warren gym teacher James Kearly pleaded no contest to fourth-degree criminal sexual conduct charges involving three young girls.  In 2004, Kearly and Warren Schools were sued by the victims’ parents, alleging the district ignored more than a decade’s worth of Kearly’s documented fondling.As abuse allegations stacked up, according to testimony, the district moved Kearly to a school that taught younger students in the hopes that he would be less attracted to underdeveloped elementary school girls.While there, three second grade girls said Kearly molested them.“He touched my privates, Mr. K,” testified one of his young victims. “Sometimes in the office and sometimes in the gym.”During trial, Kelly told jurors the district couldn’t be held responsible for Kearly’s actions and, while there was no excuse for what he did, “the touching was always on the outside of the clothing… was very brief and…there’s very strong evidence that (the girls) didn’t know that it was inappropriate when it occurred.”WXYZ shared Kelly’s words with Morgan McCaul, one of Larry Nassar’s victims.“That’s gross.  What you just read is gross,” she said. “When this is a leader and essentially the architect of campus climate, I don’t know how you can send your kids to Michigan State University and feel safe.”The jury in the Kearly case returned a .1 million verdict in favor of the victims.In 2006, Kelly defended a district accused of ignoring allegations that teacher Roderick Reese molested 11 elementary school girls. As is common in sex abuse cases, the plaintiffs filed their lawsuits as Jane Does. But Kelly filed a motion to have the young girls' names made public, saying that the case had already been tried in the press. WXYZ spoke with a parent of one of Reese’s victims, who was 12 when Kelly wanted her name unsealed.“It was kind of like, who’s on trial here?” the father said, who asked that we conceal his identity to protect his daughter. “It’s not my kid or the other parent’s children.”The judge denied Kelly’s motion. The case settled for an undisclosed amount and, in a criminal trial, the teacher was convicted of child molestation. 12 years later, the father of Reese’s victim hasn’t forgotten what Dan Kelly tried to do in court.“I was totally stunned,” he recalled. “Why would he want to do this to these children? They didn’t do anything wrong.”In a January trustees meeting, Kelly apologized to Nassar’s abuse survivors and said, until recently, he had viewed the Nassar scandal through the eyes of a lawyer.“In the back of my mind,” Kelly said, “I thought that this would be resolved in the litigation process.”Attorney Mick Grewal represents more than 80 of Nassar’s victims.“I think he viewed them as the opposition, not survivors,” Grewal said. “It’s clear to me that he’s not the right guy. It’s actually clear to me that everyone on the board is not the right guy or woman.”Dan Kelly declined an on-camera interview, but by phone said he believes he can be the best advocate for victims of Nassar’s abuse. Those that have faced with him in court aren’t so sure.“I don’t think he’s out to protect the victims, myself,” said the father whose daughter Kelly tried to name in court. “And being a defense lawyer, why would he?
