SAN DIEGO (KGTV) -- The register sex offender accused of kidnapping and raping a three-year-old Oak Park girl pleaded not guilty to five felony counts Wednesday. Francisco "Freddy" Diaz now faces up to life in prison if convicted. Diaz is being held without bail. The young girl’s father, Silvester Soltero, says he was working on his car when his neighbor broke into a bedroom window, grabbing his sleeping daughter.Soltero says Diaz’ mother brought his daughter home, but she wasn’t wearing any pants. Soltero said when he asked his daughter what happened, she told him the man touched her private parts.RELATED: Man arrested after three-year-old says she was kidnapped and touchedWhen the father asked who the man was, Soltero said his daughter pointed to Diaz. When the father approached Diaz, Soltero said he became hostile, even threatening to kill him if he snitched.The two men then started fighting when Diaz reportedly tried to poke Soltero in the eye with a fork. After he ran off, San Diego Police caught Diaz a short distance away. After his arrest, Soltero learned his neighbor was a registered sex offender.“They should have told me, they should have told me I was living next to a pedophile, If I had known I wouldn’t have brought my daughter around here, there’s no way in hell," he said.Diaz was convicted in 2006 for molesting three girls on the playground near Oak Park Elementary School, right across the street from his mother’s house. Diaz was sentenced to eight years in prison, in part because he already had a criminal history. In 2000, Diaz was convicted of assault with a deadly weapon and making a terrorist threat.San Diego Police say Diaz was in full compliance with the terms of Megan's Law. He is required to check in with police every year and he does so, said Lt. Jason Weeden.Because Diaz' child molestation convictions were misdemeanors, he doesn't have to steer clear of schools and playgrounds. SAN DIEGO (KGTV) -- There are increasing calls for more police oversight. In San Diego, a proposed measure would create a new independent body to investigate alleged misconduct. Both San Diego Mayor Kevin Faulconer and District Attorney Summer Stephan have pledged support for a new body to hold police accountable.Maresa Talbert with San Diegans for Justice said they welcome the support, but there is still some skepticism.“It seems very reactionary after all of this pressure that now they come out and support. This ballot measure is not a new thing. This has been proposed since 2012,” Talbert said.There is currently a Citizens Review Board on Police Practices, but Talbert said it is far from independent. “Their legal council is the city attorney, who represents both the Police Officers Association and the CRB so it represents a true conflict of interest,” Talbert said. The new proposed commission would have the ability to investigate cases. It would also have independent lawyers and subpoena power. The head of the San Diego POA said the support a measure on the ballot to let the people decide what is best for police oversight. “I think if people go into things with an investigative mind trying to find the truth, I think that any of these things can be very effective,” said POA President Jack Schaeffer. Talbert said even if passed, the city council still has to write an ordinance and some of the language could change. SAN DIEGO (KGTV) -- Three people were injured following a pursuit in Otay Mesa Monday afternoon.According to the San Diego County Sheriff’s Department, deputies pulled the truck over around 2 p.m. for an unspecified traffic infraction.The driver, later identified as Christian Eduardo Saldana Medina, 26, stopped and cooperated with deputies.While deputies were checking records, Medina sped away at a “high rate of speed.” Deputies chased Medina for less than two miles before the truck ran into a tractor trailer at the corner of Pacific Rim Court and Camino Maquiladora.All three people inside the truck at the time of the crash were taken to the hospital, one by helicopter.Medina was arrested for felony evading and felony evading with injuries. A passenger, Edgar Quintana Valenzuela, 38, was arrested for possession of a controlled substance and possession of paraphernalia.  895

SAN DIEGO (KGTV) – The San Diego Unified School District on Thursday released new information on the next phases of its plan to reopen schools for in-person learning.The first phase of the district’s plan, which began Oct. 13, included appointment-based, in-person instruction for elementary school students identified as having “the greatest needs.”The district is looking to expand Phase 1 to include grade 6-12 students and children in infant/toddler and early-learning programs.In a news release issued Thursday morning, the district outlined details on Phases 2-4. Officials noted that the timing of the phases will depend on the state's data/tier assignment update on Tuesday, Oct. 27.Expansion of Phase 1Expansion of Phase 1 appointment-based program for secondary students grades 6-12 and educators.Expansion of Phase 1 appointment-based program for infant/toddler and early-learning programs and educators.Phase 2Elementary (PreK to 5th grade) students would return to campus four days a week. Fridays would be set aside for “live” online check-ins and independent asynchronous learning.Secondary (6th to 12th grade) students would return to campus two days a week.
