BAKERSFIELD, California — A Kern County, California judge decided Thursday to set free a man who's been on death row for 26 years.Vicente Benavides, 68, was freed from San Quentin Prison Thursday afternoon.The judge said all Benavides' charges were changed to not guilty.  His defense attorney told KERO television station that Benavides will not have to return to Kern County.On Tuesday, District Attorney Lisa Green made the announcement that her office would not file charges against Benavides, saying the case would be nearly impossible to retry in court. She said it would be very difficult to convince a jury beyond a reasonable doubt of Benavides' guilt.According to a decision released by the California Supreme Court last month, the convictions of Vicente Benavides in 1993 "were based on false evidence and that he received ineffective assistance of counsel."The decision also says that "false evidence was introduced at trial and that petitioner's convictions of substantive sexual offenses, special-circumstance findings, and judgment of death must be vacated."Benavides was convicted in 1993 of first-degree murder, rape, and other charges. He was sentenced to life. He was serving his term on death row in San Quentin. It was asked that his murder conviction be reduced to second-degree murder. That was also thrown out. The judgment has been vacated entirely. Benavides' defense attorney says his client's case is extremely rare, saying only two similar cases have occurred since the death penalty was reinstated in the 1970's.The California Supreme Court cited multiple doctors who evaluated 21-month-old Consuelo Verdugo in November 1991 when she died. The baby was taken from the Delano Regional Medical Center to Kern Medical Center then eventually the UCLA Medical Center where she died November 25, 1991.Multiple reports were made by doctors who said based on the inability to insert a catheter, bruising found near Consuelo's genitalia and other factors, they believed she had been sexually assaulted. 2101

His first government collapsed in less than three weeks in 1996, and while he took power again in 1998, this only last 13 months before a disagreement within the ruling coalition sparked new elections.Vajpayee was returned to the premiership in 1999 after his BJP-led coalition secured a comfortable majority in the wake of a two-month long war with Pakistan over control of Kashmir.In late 2001, India's parliament was hit by a terrorist attack which Delhi blamed on Pakistan, while in 2002, riots in Gujarat claimed the lives of hundreds of Muslims.Despite India's contentious seven-decade relationship with Pakistan, Vajpayee is credited with being the only Indian leader to make significant progress in peace talks with the country's nuclear-armed neighbor.Even as he pursued a nuclear agreement with Pakistan, Vajpayee remained a defiant defender of India's security policy, an approach which eventually paid off. Economic sanctions imposed after the country's first atomic test were finally lifted in 2000 when Bill Clinton visited the country, the first US President to do so in 22 years. Vajpayee also improved relations with Beijing, officially recognizing Tibet as part of China.A talented orator, one of Vajpayee's most remembered speeches was a hugely critical one, bemoaning India's lack of progress after five decades of independence."Our country is counted amongst the poorest in the world," he said. "We can't make primary education a necessity. We are still expecting that girls should be educated. BAKERSFIELD, Calif. (AP) — Authorities say a woman stole ,000 worth of quarters and her getaway car was a baby stroller.Bakersfield police officers noticed the woman Friday struggling to push the stroller but quickly realized there was no baby inside, according to the Bakersfield Californian .Police discovered the quarters, which 29-year-old Darrin Fritz had allegedly just stolen from a home, the newspaper reported. Fritz allegedly tried to flee from the officers.She was arrested on suspicion of burglary, possession of stolen property, possession of burglary tools, possession of methamphetamine, resisting arrest and two outstanding misdemeanor warrants.A post on Twitter from the Bakersfield Police Department shows thousands of quarters in evidence bags.It was not immediately clear if Fritz had an attorney who could speak on her behalf. 857
