CHULA VISTA, Calif. (KGTV) - A Chula Vista man is recovering after a painful encounter with a rattlesnake sent him to a hospital for several days.It happened in a quiet Eastlake neighborhood near a canyon. A week ago, along White Pine Ct., just before. 9 p.m., Lino Ayon was visiting a neighbor, inside a garage, when the neighbor pressed the remote. The door went up."As I stepped out, I felt like a pinch in my ankle area. Then I heard a rattle and by the time I said, 'Oh, that's a snake,' it bit me again," said Ayon. His neighbor tracked it down and killed it: a 3-and-a-half-foot rattlesnake. Meanwhile, Ayon quickly started feel the effects of the bites."My body started getting numb, my face and my chin," said Ayon. His left ankle -- where he had been bitten twice -- started to swell with pain. His speech was slurred."In my mind I knew what I wanted to say, but it wasn't coming out right," said Ayon.He was brought to the ER, eventually receiving two doses of antivenin. He was released from the hospital two days later."Very scary, never in a million years did I think I was going to be bitten by a snake," said Ayon. While rattlesnake bites for humans are fairly rare, experts say be on the lookout this time of year. It's birthing season, so there are more rattlers slithering about.Local snake wrangler Tom Mingha tells ABC 10News when the temperatures heat up, rattlesnakes become active at night, when it's cooler. That is when Ayon had his encounter. From now on, he plans to use a flashlight when walking around at night."Just be more cautious, more careful, and watch your surroundings," said Ayon. 1623

CHULA VISTA, Calif. (KGTV) -- The City of Chula Vista is highlighting local businesses that are adapting to serving customers outdoors because of the pandemic. City officials started posting pictures on the city's Facebook and Instagram pages on Monday. Since Monday, they've highlighted barber shops, art galleries, restaurants and yoga studios. The city is calling them ABC, or Accommodating Business Champions. The plan is to feature a different business every day. Itaglo Pasta Bar was one of the businesses featured. Owner and Chef Alejandro Vicens says he was happy to see his business featured by the city. Like so many businesses, Vicens has moved everything outdoors to be able to continue to operate. The city says it plans to continue highlighting business that are moving outdoors. City staff also tells 10News they've been going around the city taking pictures of those that are doing things properly to serve their customers. On Sundays during the month of August, Chula Vista also approved for a portion of Third Avenue to be closed to traffic, so businesses can expand onto the street. 1111

CINCINNATI -- The University of Cincinnati will pay former UC police officer Ray Tensing 4,000 in back pay and legal fees, the university president wrote Thursday.Tensing was the police officer who shot and killed Sam DuBose during a traffic stop in 2015. UC fired Tensing on July 29, 2015. However, the police union contract states that employees charged with a felony may be placed on paid leave until the court case is resolved. Tensing brought a contractual grievance to the university regarding his termination, according to UC President Neville Pinto.UC agreed to pay Tensing 4,230 in back pay and benefits for Tensing and 0,000 for his legal fees to resolve the grievance. In return, Tensing agreed to resign his position as a university law enforcement officer and to never return to employment at UC. "I realize this agreement will be difficult for our community," Neville wrote in a letter announcing the agreement. "I am nevertheless hopeful that we can focus on supporting each other as members of the same Bearcat family — even, perhaps especially, if we don’t agree."The case prompted Black Lives Matter Cincinnati and other groups to organize marches and rallies as the community waited to hear if Tensing would face charges and, later, what jurors would decide. "The tragic loss of Samuel Dubose in July 2015 was a trying time in the life of our University," Pinto wrote Thursday. "Our community came together to mourn, listen, support, heal and hope. That work continues as we strive to live our values into action."Authorities charged Tensing with murder and voluntary manslaughter in DuBose's death. However, two juries were unable to reach a unanimous verdict, prompting a judge to declare two mistrials in the case before the charges were dropped.?After DuBose's death, Hamilton County Prosecutor Joe Deters had dismissed Tensing's reason for stopping DuBose off campus -- a missing front license plate -- calling it a "chicken-crap stop." He also said Tensing "should never have been a police officer."But after the trials, Deters lamented that the jurors would have not voted to convict a police officer, blaming division in the U.S. over race and police issues. He called the case "heartbreaking."The shooting prompted a top-to-bottom review of the University of Cincinnati Police Department. That review brought new training for officers in techniques like de-escalation, changes in their best practices like arming officers with Tasers as a non-lethal option and a turnover in leadership, including the hiring of the department's first female chief

CHULA VISTA, Calif. (CNS) - The family of a 56-year-old man who died earlier this year following an encounter with Chula Vista police announced Monday they are filing a pair of wrongful death lawsuits against the city. The lawsuits seek the names of the officers involved in the March 13 call for service that culminated in Oral Nunis' death. Both lawsuits are being filed in San Diego federal and state courts on behalf of four of Nunis' children, including his daughter Kimone, who called 911 shortly after midnight March 13 after her father began experiencing a mental health issue and attempted to jump out of a second-story window. While addressing reporters at a news conference announcing the lawsuits, Kimone Nunis said responding officers did not speak to her or ask her what was happening with her father when they arrived."That night, I just wanted help. I picked up the phone. I didn't know what I was getting myself into," she said.Attorneys for the family say officers tackled Nunis outside the home and "dogpiled" atop him, placed him in a WRAP restraint device and put a "spit hood" over his head.In a statement released shortly after Nunis' death, the police department said he was restrained to prevent him from hurting himself or others. The department also alleged Nunis was "uncooperative with officers and struggled as they attempted to detain him," resulting in injuries to two of the officers. The federal lawsuit alleges Nunis was unconscious and unresponsive after the altercation, and that those restraints were placed upon him while he was unconscious.Nunis was taken to a hospital, where he was later pronounced dead.Attorney John Burris, who represents the family, said police should have responded by de-escalating the situation."Mr. Nunis was seeking help. The family was seeking help. But instead of getting help, he was met with force," Burris said.A similar lawsuit was filed last month on behalf of Nunis' widow and three other children. Their attorney, Carl Douglas, alleged the city has withheld Nunis' cause of death, while a statement released by the city last month indicated his cause of death has not yet been determined."The City of Chula Vista understands and shares the public's and the family's desire to have all of their questions answered about this incident. However, it is premature and inappropriate to come to any conclusions at this time," according to the city's statement in response to that lawsuit. "The investigation is ongoing, and the true cause of death has not been determined by the Medical Examiner. Because of this, and now the threat of litigation, the City and the Police Department must refrain from commenting further beyond the statements already made. The City and Police Department continue to express our deepest condolences to the family and all of those touched by Mr. Nunis' tragic passing."City officials did not immediately respond to a request for comment regarding the latest filings. In addition to the federal lawsuit alleging wrongful death and violations of Nunis' civil rights, the state lawsuit seeks the release of the officers' names. The complaint states Kimone Nunis submitted a California Public Records Act request in July seeking the names of the involved officers, as well as body camera footage, reports and statements from witnesses and other information police have regarding the case.According to the lawsuit, which alleges the city violated the CPRA, the family was told months later that the information was being withheld "because of ongoing criminal and administrative investigations." 3591
