SAN DIEGO (CNS) - A judge took under submission today a motion by the federal government to dismiss a lawsuit filed by the cities of Imperial Beach and Chula Vista and the Port of San Diego, alleging that the International Boundary and Water Commission is violating the Clean Water Act by not doing more to prevent Tijuana sewage from flowing into San Diego area waters.The federal government maintains that the IBWC isn't legally responsible for the sewage flowing into U.S. waters from Mexico.But the plaintiffs claim that since the IBWC oversees a flood control channel that redirects the Tijuana River on its way to the Pacific Ocean, as well as water- capture basins in five canyons along the border, the agency is responsible for the sewage that gets through those systems.RELATED: Imperial Beach businesses hurt by sewage & runoff related closuresImperial Beach Mayor Serge Dedina, who has led the fight to against the IBWC since his city was hit with millions of gallons of raw sewage in February 2017, said it was heartening to hear U.S. District Judge Jeffrey Miller say he might go to the South Bay to see first-hand how the situation is being handled.Dedina said the plaintiffs got a fair hearing. SAN DIEGO (CNS) - Authorities Thursday publicly identified a 21-year-old man who was killed when the sports car he was driving crashed off a South Bay freeway connector.Jose Cruz Perez of Logan Heights lost control of the blue Nissan 350Z coupe while trying to merge onto eastbound state Route 54 from northbound Interstate 5 in National City at high speed shortly before 2:30 a.m. Tuesday, according to the San Diego County Medical Examiner's Office.Alerted by a witness who saw Perez's vehicle veer off the connector and plunge down a steep embankment just south of the Sweetwater River, California Highway Patrol officers searched the area but were unable to find the car or driver.About four hours after the accident, a worker at a shipbuilding yard alongside the freeway ramp found the wrecked Nissan in a mud pond with Perez's body partially ejected from the driver's side door, the CHP reported. 910

SAN DIEGO (CNS) - County supervisors Wednesday unanimously approved the .1 million purchase of a nearly seven-acre parcel for a park in the community of Fallbrook.The 6.8-acre property, owned by Barr Ranch LLC, is located south of Fallbrook Road between Morro and Golden roads.Supervisor Jim Desmond, whose district includes Fallbrook, said the town doesn't have enough parks. He added the county will hold meetings with residents to see what kind of amenities residents would like included. He said some early requests include playgrounds and a skate park.Fallbrook currently has three local parks, providing 1 acre per 1,000 residents. That number doesn't meet the General Plan goal of 10 acres of local parkland for that same number of people.Money for the park purchase will come from a community development block grant, according to county documents.
