A growing group of Republicans want Attorney General Jeff Sessions to be the party's choice in the Alabama Senate race, but ethics experts say Sessions either would have to have to leave the Department of Justice or continually disavow campaigns to put him in the seat if he wants to run for the office and avoid legal trouble.This week Senate Majority Leader Mitch McConnell of Kentucky and Senate Majority Whip John Cornyn of Texas both said they would support Sessions as a write-in candidate over Republican candidate Roy Moore, who has been accused of pursuing sexual relationships with teenagers when he was in his 30s.Moore denies the allegations, and says he has no plans leave the race. If he remains silent, he could be in violation of the Hatch Act, a 1939 law restricting the ability of most federal employees to engage in political campaign activities.Walter Shaub, a former director of the US Office of Government Ethics who's now at the nonprofit Campaign Legal Center, told CNN that the federal Office of Special Counsel has issued an advisory opinion on write-in candidates, which specifies:"(S)uch a candidacy is permissible only if spontaneous and accomplished without an employee's knowledge. You acknowledge that you have heard rumors of a write-in effort to elect you to the school board. It would be a violation of the Act if you encouraged this effort or remained silent. The Act imposes on you an affirmative duty to disavow this effort through public announcements and other appropriate means." It remains to be seen whether the OSC considers the comments by McConnell and Cornyn as imposing an "affirmative duty.""There's a question as to whether it's a write-in campaign or a stray comment from one guy," Shaub said following McConnell's comments. "If McConnell keeps talking about it, he's going to create an affirmative duty."Larry Noble, a senior director at the Campaign Legal Center who's a CNN contributor, said Republicans such as McConnell are "putting (Sessions) in a very difficult position" by even suggesting he be a write-in candidate."We are close to the line of his having to disavow," Noble added.For Sessions to be eligible as a write-in candidate, Noble said, he would have to "affirmatively disavow" any campaign or resign from office to avoid violating the Hatch Act.Sessions would likely be asked about his support for the write-in candidacy frequently until the December 12 election. Questions could also be raised about whether he was having private conversations about the effort with the state party and the Republican National Committee, which also would violate the Hatch Act.In response to a request for comment, Sarah Isgur Flores, director of public affairs for the Department of Justice, said, "Our ethics officials will need to evaluate precisely what has been said by others and then review what, if any, affirmative obligations we may have."Samuel Bagenstos, a University of Michigan Law School professor who specializes in constitutional litigation, noted that a few previous attorneys general -- including Dick Thornburgh and Robert Kennedy -- have campaigned for Senate seats, but neither were floated as write-in candidates."It's extremely suboptimal for an attorney general, who is supposed to have some insulation from electoral politics, to be actively running for a political office," Bagenstos said, adding, "And of course there would be lots of possible recusal questions."Aside from ethical considerations, running as a write-in candidate would be a long shot even if Sessions resigned.Few candidates have won Senate seats via write-in campaigns. Sen. A California farm that was tied to an outbreak of E.coli on romaine lettuce is now recalling cauliflower and other lettuce grown at the farm.Adam Bros. Farming Inc. sent out a news release Thursday saying red leaf lettuce, green leaf lettuce and cauliflower harvested November 27-30 has been recalled because it may also be contaminated with E.coli.The farm initiated the voluntary recall with the U.S. Food and Drug Administration on Thursday. The cauliflower was distributed in 10 states: Arizona, California, Illinois, Louisiana, Maryland, North Carolina, New Jersey, New York, Ohio and Pennsylvania. It was also distributed in Tijuana, Mexico and Canada. The additional lettuce recalled was sent to states mostly on the western side of the country. Red and green leaf lettuce was distributed in California, Colorado, Oregon, Texas, Pennsylvania, Washington and Canada. A gathering of supporters of President Donald Trump once again clashed with counter-protesters in Oregon on Monday, as the state continues to deal with political and civil unrest ahead of November's general election.Two people were arrested following Monday's skirmish. According to KGW-TV, Trump supporters initially gathered at Clackamas Community College in Oregon City for the "Oregon for Trump Labor Day Cruise Rally." Supporters of the President adorned their cars with campaign flags and made the short drive to Salem, Oregon. The Associated Press also noted that some participants displayed signs in support of the QAnon conspiracy theory.The vehicle parade made about an hour-long trip from Oregon City to Salem. The AP reports that most vehicles split from the group before arriving in Salem.In Salem, KGW reports that the group of about 150 was met by a group of about 50 Black Lives Matter protesters. At one point, the AP says the right-wing crowd "rushed" the Black Lives Matter protesters and fired paint pellets at them. The BLM protesters dispersed from the scene before police arrived to break up the rally.ABC News reports that among those Trump supporters who traveled to Salem were members of the Proud Boys, a right-wing group known for political violence.Monday's rally bore similarities to an Aug. 29 pro-Trump vehicle rally in Portland. During that rally, Trump supporters were seen on video spraying paint pellets and tear gas at peaceful protesters. Later, one Trump supporter, Aaron "Jay" Danielson, was shot dead by a left-wing counter-protester. A doctor with the Oregon Health Authority is getting attention after she wore clown make-up during a recent video update on the state’s coronavirus cases.Dr. Claire Poché starts out the video update like any other, stating her name, introducing her colleague who joins the video later and then giving an update on Oregon’s COVID-19 numbers.“As of today there have been 38,160 cases in Oregon, with 390 cases being reported today. Sadly, we are also reporting 3 deaths today, bringing the statewide total of COVID related deaths to 608,” Dr. Poché said in an October 14 video, while visually looking like a clown.She is wearing white and red make-up on her face made up to look like a clown, in addition to a polka dot shirt, bright red tie and yellow pants.Dr. Poché does not reference the make-up on her face, or offer an explanation for her look.The video cuts to another doctor with the Oregon Health Authority, also wearing a costume, who talks about safe ways to celebrate Halloween with pandemic safety precautions in mind.At this point, viewers might start making the assumption the costume and Dr. Poché’s make-up are part of a coordinated plan for Halloween.About 10 minutes into the video, the two colleagues reference their costumes and talk about their Halloween plans. 1289

A Japanese pilot found to be more than nine times over the legal alcohol limit before a scheduled flight from London Heathrow in October has been sentenced to 10 months in prison, police said Thursday.Katsutoshi Jitsukawa, 42, an employee of flag carrier Japan Airlines, was scheduled to fly from Heathrow to Tokyo on October 28 at 6:50 p.m. local time, but failed a breath test shortly before takeoff.The test showed Jitsukawa had 189 mg of alcohol per 100 ml of blood in his body. The legal limit for pilots is 20 mg, while drivers in England, Wales and Northern Ireland are allowed as much as 80 mg.Alarm was raised after a driver of a crew bus smelled alcohol and called the police, who conducted the test, according to Japanese broadcaster NHK.Jitsukawa said he had drunk two bottles of wine and a pitcher of beer the night before the flight, NHK reported.He was remanded in custody and later pleaded guilty to the charge of performing an aviation function when his ability was impaired through alcohol. Jitsukawa had been scheduled to fly a 244-seater Boeing 777 aircraft.Reacting to the sentencing, Inspector of Aviation Policing Iain Goble, condemned the "serious" offense that could have had "catastrophic" consequences."This conviction reflects he displayed not only total disregard for the safety of all the passengers and staff on his flight, but also the wider public," Goble said.Following Jitsukawa's arrest, Japan Airlines apologized for the incident and said "safety remains our utmost priority," adding it will "implement immediate actions to prevent any future occurrence." 1610
