SAN DIEGO (KGTV) — Wednesday a preliminary hearing began for a man accused of aiming a loaded gun at off-duty San Diego Police officers at a Mission Valley bar parking lot last November.A San Diego Superior Court Judge listened to testimony from officers in case involving the defendant Jonathan Felix. The incident happened outside of McGreggor’s Bar and Grill on Nov. 7, 2018.Wednesday, officer Jonathan Rodriquez was the first witness on the stand. Rodriguez said he had a few beers after work with coworkers that night. He said Felix was sitting about 20 feet away from the off-duty officers.Once the bar was closing they all walked out into the parking lot.RELATED: San Diego man says off-duty SDPD officers assaulted himRodriguez claims he saw Felix looking into his car or looking at his car. He said after that he and the other officers watched Felix go to his own car.“The defendant got a bicycle out of his car, I thought it was strange and he left,” said Rodrigues. “After he left he came back a second time.”Felix claims he lives nearby and uses the parking lot at that shopping center because parking is limited at his apartment complex. Rodriguez says an off-duty officer then walked over to Felix and had an “innocent conversation." He said Felix asked the officers if they’d like to smoke, but they all denied him. Rodriguez decided he did not feel comfortable being there, and says he left in his own vehicle.After that, surveillance video shows what transpired.Felix is seen having interactions with the other off-duty officers, and then he’s seen holding a gun.The officers began beating Felix, leaving him with a bloody head, several lacerations and bruises. He was arrested that night. Second on the stand was officer Andrew Duncan. He was one of the officers involved in the fight. He claims they walked out of the bar and saw Felix acting strange. Duncan says Felix left and came back saying the other officers threatened to beat him. Duncan went on to testify that's when Felix showed his gun. Then, Duncan said, all 4 officers pointed their gun at Felix then tackled him. They say they were wrestling with him to get the gun away. Tasha Williamson with Building Justice says Felix shouldn't be facing these charges, but that the officers should face assault charges because Felix wasn't doing anything wrong that night. Williamson says the officers were off-duty and should have left Felix alone.Felix is charged with two felony weapons charges for being a felon in possession of a firearm and ammunition. He’s also charged with and a misdemeanor drug charge for being in possession of a controlled substance.Before the preliminary hearing started his lawyer, Alicia Freeze, spoke outside of the courtroom.“Uniquely and I think very creatively, my client is not being charged with brandishing a weapon, he’s not being charged with assault with a deadly weapon, he’s not being charged with a lot of the initial charges he was booked under,” she said.On Jan. 4 the San Diego Police Department issued the following statement: “The San Diego Police Department submitted a criminal case to the District Attorney's Office regarding this incident, in which Mr. Felix pulled a gun on four off-duty police officers. He has been charged with unlawful possession of a firearm, unlawful possession of ammunition, and possession of a controlled substance. Mr. Felix is entitled to the presumption of innocence and the full facts of this case will be litigated as the criminal case proceeds. As in any situation where there are allegations of misconduct, the San Diego Police Department has initiated an internal investigation. If found, any misconduct will be handled accordingly.”At the end of this preliminary hearing a judge will decide if there’s enough evidence for the case to move to trial. If the case goes to trial and Felix is found guilty and convicted, his lawyer says he could be looking at one to two years in prison.Several supporters of Felix showed up to court today and plan to have a press conference following the hearing. 4063

SAN DIEGO (KGTV) — Video posted to Facebook Wednesday showing a violent encounter between a Pacific Beach worker and homeless man has already gained hundreds of shares and comments.You can see someone come out of B-Mo's Sandwich Shop on Garnet Avenue and push a table into a shirtless man's head, then begin throwing his belongings into the street. 10News reached out to the owner of B-Mo's but were told he wasn't available for an interview Thursday.But Pacific Beach locals who saw the video told 10News the video shows San Diego's homelessness issue has reached a boiling point locally."If you look at the video you can tell it's at the point of escalation," said Mike Bremer, who owns a nearby tattoo shop.Bremer says while he might not agree with how things played out, he understands how it could happen. "I don't condone using that kind of violence I'm here to support because something needs to be done," Bremer said.Bremer and other locals said they deal with issues related to the homeless on a near daily basis and it can make doing business difficult. Thursday, two San Diego Police officers arrived at B-Mo's, but wouldn't comment. A spokesperson for SDPD said officers were initially called out when the confrontation happened but the homeless man wasn't cooperative and the other man didn't want any further action taken. Police said Thursday in light of the video evidence they've now opened up a criminal investigation into the incident. It's unclear if anyone will be charged. 1502

SAN DIEGO (KGTV) — UC San Diego Health and three other UC Health medical centers will begin to recruit participants for an antiviral drug being tested to treat the novel coronavirus.The medical system will start "phase II" clinical trials for the antiviral drug remdesivir. SAN DIEGO (KGTV) — Two men are dead and a woman is in critical condition after a car crashed into a Mission Valley bus stop Thursday.A driver collided with the three pedestrians in the 7500 block of Metropolitan Drive around 11 a.m. The driver remained at the scene for San Diego Police.One victim was pronounced dead at the scene. The other male victim was later pronounced dead after being taken to the hospital. Both victims were identified as men in their 40s.A 49-year-old woman was taken to a nearby hospital in critical condition, police say.Police and a friend of the female victim say the three pedestrians were sleeping behind the bus stop with their belongings at the time of the crash. Jessica Nelson said she knew the 49-year-old woman and brought her some clothing and make-up earlier that day. She said she tried to convince her to go eat with friends, but the woman stayed with her husband, according to Nelson.Nelson said the pink bags strewn about the crash sight belonged to the victim, she called Kelly.Nelson said she met Kelly a year and a half ago at the bus stop where the accident took place. She said they are both battling heroin addiction and frequent the methadone clinic nearby.San Diego Police are investigating the crash.10News is monitoring this breaking news. 1301

  

SAN DIEGO (KGTV) — Youth sports leaders are holding a protest in front of the San Diego County Administration Building on Saturday to voice their concerns over the state’s regulations regarding games and competitions.Currently, under California's coronavirus restrictions, youth sports can practice, as long as six feet of social distancing can be maintained. Bob Turner is both Executive Director of Presidio Soccer League and President of the Southern California Youth Soccer Association and said the athletes should be able to play games.He said they have created safety plans, including spacing out the times of games and shortening games to avoid crowds, only allowing one parent for each athlete, and also requiring masks of all referees, parents, and substitute players. Turner said they’ve sent countless letters and filled out petitions to the state, but have not gotten a response. RELATED: County sends plan to resume youth sport practices to Gov. NewsomA spokesperson for San Diego County said the county has also been asked about plans for youth sports. They also asked the state and have not heard about what’s next.“This is small potatoes to them compared to a lot of the other things opening but it is our youth and what’s more important than our kids. We’re destroying these kids with what’s happening through the schools and now we’re taking this away. This is the only outlet some of these kids have,” said Turner.Turner added that he’s heard of some athletes traveling to other states that have more relaxed restrictions so they can play in games and tournaments.Turner said counties in California are planning to all hold protests to voice their concerns. He said any athlete is welcome at their protest Saturday, and hopes the unified voices will be heard by the state.“We need to bring awareness. We feel like nobody’s listening so we just have to get people to listen and do the right thing,” said Turner.The protest will be held at 10 a.m. 1972
