(AP) -- The California Supreme Court overturned the 2005 death sentence for Scott Peterson in the slaying of his pregnant wife.The court says prosecutors may try again for the same sentence if they wish in the high-profile case. It upheld Peterson's 2004 conviction of murdering his wife Laci Peterson.Laci Peterson was eight months pregnant with their unborn son, and investigators said that on Christmas Eve in 2002, Scott Peterson dumped the bodies from his fishing boat into San Francisco Bay.The court on Monday said the trial judge made several significant errors in jury selection that undermined Peterson's right to an impartial jury at the penalty phase.The court ruled potential jurors for the death penalty phase were improperly dismissed after saying they disagreed with the death penalty but would be willing to impose it."The trial judge made a mistake by kicking those people off the jury, so the only people that sat on the jury were in the death penalty camp," said criminal defense attorney Gretchen von Helms.Prosecutors will now decide whether to retry the sentencing phase.While the sentence was overturned, the court affirmed the murder convictions. "The sentencing was a positive step. The other decision (convictions affirmed) was about what we expected. (AP) — California Democratic Party Chairman Eric Bauman was accused of inappropriate behavior on a campaign bus days before the Nov. 6 election, a Democratic official said Tuesday, a day after Bauman took a leave of absence.Bauman was among those aboard a bus during a statewide get-out-the-vote tour. Two young women on the bus reported alcohol was consumed and inappropriate sex talk occurred on Nov. 1, said David Campos, chairman of the San Francisco Democratic Party.The bus was scheduled to arrive in San Francisco the next day at an event with U.S. House Minority Leader Nancy Pelosi. (AP) — A rookie Sacramento police officer was shot during a domestic violence call and lay wounded for about 45 minutes as the gunman kept officers at bay with bursts of fire, authorities said Thursday. She was finally rescued with an armored vehicle but died at a hospital."We are devastated," Deputy Chief Dave Peletta said. "There are no words to convey the depth of sadness we feel or how heartbroken we are for the family of our young, brave officer."Officer Tara O'Sullivan, 26, was shot Wednesday evening while helping a woman collect her belongings to leave her home. As officers swarmed the area, the gunman continued firing in a standoff that lasted about eight hours before he surrendered.Stephen Nasta, a professor at the John Jay College of Criminal Justice and a former inspector with the New York Police Department, said taking 45 minutes to reach a wounded officer is "unacceptable."If officers couldn't immediately get an armored police vehicle to the scene, he said, they should have commandeered an armored bank vehicle, bus or heavy construction equipment."If there's somebody shot, lying on the ground, you have to do everything you can," Nasta said.If no such vehicle was available, he said he would expect police to use a diversionary tactic such as firing at the home, setting off smoke grenades or breaking a door or window in another part of the home to distract the gunman as other officers rescued the wounded comrade.
