SAN DIEGO (CNS) - A San Diego federal judge has again denied a Chula Vista church's request to challenge the state's COVID-19-related restrictions on indoor worship services.South Bay United Pentecostal Church, which lost a challenge to the restrictions earlier this year when the case went before the U.S. Supreme Court, filed an amended complaint this summer in its ongoing lawsuit arguing that California's restrictions on indoor services and singing are unconstitutional.U.S. District Judge Cynthia Bashant, who denied the church's request for a preliminary injunction in May, also denied South Bay United's latest request in a written order signed Wednesday.Bashant echoed much of her previous reasoning in denying the church's request, though South Bay United's latest complaint and her ruling took into account the shifting state of the virus locally.South Bay United argued in court papers that the state's "scientific pronouncements" are "largely baseless," as by "all reasonable scientific measurements," the COVID-19 health emergency "has ended."Bashant disagreed with the church's assessment of the current picture, and wrote that limitations to indoor worship attendance do not restrict one's ability to attend religious gatherings, as long as they are held outdoors.The judge wrote that the current COVID-19 situation in San Diego County holds that worship services may be held outdoors, with singing and chanting permitted. Indoor worship is limited to 100 people or 25% of building capacity -- whichever is fewer -- with singing and chanting prohibited.The church has argued that outdoor worship and services held over video-conferencing are "inadequate substitutes" and that the public health orders prohibit the church "from holding the services mandated by scripture."It also argued that California arbitrarily allowed certain sectors considered essential to stay open and conduct indoor operations, while discriminating against religious institutions.Bashant disagreed that public health officials have shown a pattern of discriminatory enforcement of COVID-19 health orders against religious institutions.She wrote that through Aug. 26, the county served 10 cease-and-desist orders or compliance letters to businesses or other entities, three of which were places of worship.Additionally, she wrote that through Aug. 26, 144 citations were issued for health order violations, none of which were to places of worship or people engaged in religious services. 2485

SAN DIEGO (CNS) - A man who was operating a panga boat carrying several undocumented immigrants when it capsized off the coast of southern San Diego County earlier this year, killing two men aboard, was sentenced today to nearly seven years in federal prison.Julio Cesar Murillo-Arce, 42, pleaded guilty earlier this year to federal charges stemming from the Feb. 3 boating accident off the coast of Imperial Beach.He was sentenced to 78 months in prison in connection with the boat fatalities, and an additional five months for violating the terms of his supervised release stemming from a separate maritime alien smuggling conviction last year, according to the U.S. Attorney's Office.According to court papers, Border Patrol agents spotted the boat in the early morning hours of Feb. 3. It began experiencing engine trouble about 150 yards off the coast, prosecutors said, then eventually became inoperable.Prosecutors say Murillo-Arce told the others aboard not to identify him as the boat's captain, then dove into the water.The boat was capsized by a large wave, sending all six occupants into the sea. Four were able to make it to shore, but Ramon Ponce-Rodriguez and Modesto Rodriguez-Ballesteros did not.Ponce-Rodriguez was pronounced dead on arrival at a hospital, while Rodriguez-Ballesteros was initially hospitalized in critical condition and died Feb. 4.The surviving occupants of the boat told investigators that the boat's captain abandoned the vessel and swam away, despite being told some of the people aboard could not swim. SAN DIEGO (CNS) - California State University police chiefs Friday banned the use of the carotid restraint and pledged to implement policing recommendations offered by a 2015 federal task force on the CSU's 23 campuses, which include San Diego State and Cal State San Marcos."As police chiefs of the California State University's 23 campus police departments, we have been galvanized by the many voices across our state and nation demanding accountability, equity and justice," the chiefs said in a joint statement. "We have seen the tragic impact of racism and bigotry, and many in our departments have experienced it personally. We are unitedly determined to take action."CSU Chancellor Timothy White and every CSU campus president supports the pledge to adopt recommendations of The President's Task Force on 21st Century Policing, reported to then-President Barack Obama in May 2015, according to the chiefs."We are determined to lead by example, joining a growing number of American cities that have committed -- collectively and collaboratively -- to address police use-of-force policies," the statement continued. "To that end, and effective immediately, we are prohibiting the use of the carotid control hold by all CSU police officers. SAN DIEGO (CNS) - A UC San Diego epidemiologist was named today to Time magazine's 2018 list of the 50 most influential people in health care.Dr. Steffanie Strathdee, associate dean of global health sciences at UCSD's School of Medicine, was recognized for her successful efforts last year to keep her husband, psychiatry professor Tom Patterson, from dying due to a drug-resistant bacterial infection the World Health Organization classifies as the world's deadliest.Strathdee urged the team of scientists and doctors to use an experimental treatment for the infection using bacteriophages -- small viruses that act as parasites to bacteria by infecting and neutralizing them."It's a great honor to be recognized for my efforts to bring phage therapy into the 21st century in North America, but it all started with my single-minded desire to save my husband's life, and it truly reflects a team effort," Strathdee said.The magazine's list honors people who "have changed the state of healthcare in America this year, and bear watching for what they do next."Patterson was the first American patient with a systemic infection to receive bacteriophage treatment, according to Robert "Chip" Schooley, the lead doctor on Patterson's treatment team.
