He is being held at the Sevier County Jail while awaiting extradition to Walker County, Texas.If convicted of the third-degree felony charge, Penny could face up to 10 years in prison and up to a ,000 fine.The indictment claims Penny ordered the removal of documents from the Karolyi Ranch in Walker County, Texas with "the purpose of impairing the ongoing investigation by destroying or hiding the documents," after he learned the investigation was underway, the Walker County District Attorney's office said.Authorities claim the documents were later delivered to Penny at the USAG headquarters in Indianapolis, Indiana. The records are currently missing.The documents would have helped law enforcement investigate Nassar and would have "assisted with the investigation of other offenses that may have occurred at the Karolyi Ranch," the district attorney's office said in a statement. 1370

The funeral for Rayshard Brooks — an Atlanta man who was killed during an altercation with police earlier this month — took place Tuesday in a church with connections to the Civil Rights movement.Brooks' funeral was held at Ebenezer Baptist Church in Atlanta — the same church where Rev. The funeral comes after an hours-long public viewing on Monday afternoon.Brooks was shot and killed in a Wendy's parking lot by former Atlanta Police Officer Garrett Rolfe on June 12. Rolfe's partner, Officer Devin Brosnan, first encountered Brooks after Brooks had fallen asleep in his car while waiting in the restaurant's drive-thru line.Rolfe arrived on the scene a few moments later. The officers subjected Brooks to a field sobriety test, which he failed. He later offered to lock his car and walk home, but Brosnan and Rolfe told Brooks they would be taking him into custody.As the officers attempted to handcuff Brooks, a struggle ensued. Brooks was able to grab Brosnan's stun gun and attempted to flee the scene. As he fled, Brooks appeared to point the stun gun in the direction of the police. That's when Rolfe shot Brooks in the back. Brooks later died in surgery at a local hospital.Fulton County District Attorney Paul Howard says Rolfe kicked Brooks after shooting him but before calling for emergency medical help. He also alleged that Brosnan stood on Brooks' shoulder. Both face charges in connection with Brooks' death, with Rolfe facing murder charges. 1701

  

The Connecticut Supreme Court has vacated Michael Skakel's conviction in a decades-old murder case and ordered a new trial.The ruling is the latest in a long legal battle waged by Skakel, 57, the nephew of Robert and Ethel Kennedy, who was accused of brutally killing a teenaged girl in 1975.He served about half of a 20-year sentence but was freed on bond in 2013, when the courts first ordered a new trial.The court ruled that Skakel's attorney, Michael Sherman, "rendered ineffective assistance" by failing to identify an alibi witness for his client, and that as a result, Skakel was deprived of a fair trial.Prosecutors can choose to retry Skakel, according to the decision, but the defense would now have the benefit of that alibi testimony. The prosecutor's office was not immediately available for comment.Authorities said Skakel was 15 when he killed his neighbor Martha Moxley, also 15. 904

  

The CEOs for auto giants Kia and Hyundai have refused to attend a congressional hearing to explain why hundreds of their vehicles have spontaneously burst into flames.Both carmakers and a spokesman for Democrats on the Senate Committee on Commerce, Science and Transportation have confirmed the companies’ refusal to send representatives to the hearing, which has been scheduled for next week.A Kia spokesman said the company is working with the committee to “analyze all relevant information associated with any fire or other safety-related matters and will take any necessary corrective action in a timely manner.”A Hyundai spokesman said, “Hyundai takes this matter very seriously, and fully appreciates the concerns of the Senate Commerce, Science & Transportation Committee including those of the Chairman and Ranking Member.”It was not immediately clear whether the U.S. Senate committee would postpone or cancel its Nov. 14 hearing on Kia and Hyundai fires.The call for the hearing came six months after Consumer Investigator Jackie Callaway, of WFTS television station in Tampa, Florida, first reported on the unexplained car fires.Since April, the WFTS I-team has exposed hundreds of Kia and Hyundai models manufactured since 2011 that caught fire across the country.“The hearing will focus on motor vehicle safety issues involving vehicle fires,” stated the identical letters – dated Oct. 16 – and sent to Kia Motors America President and CEO Seungkyu “Sean” Yoon and Hyundai Motor America's Kyung Soo “Kenny” Lee.The CEOs were asked to “promptly identify and respond to defects that may pose a fire risk” at the Nov. 14 hearing in front of the Senate Committee on Commerce, Science and Transportation.In September, an Ohio mother spoke out and called for a federal investigation after watching her son burn alive in her 2014 Kia Soul parked at her apartment complex just outside of Cincinnati last year. 1926
