(KGTV) - The California Justice Department does not verify the validity of hunting licenses for people under 21 who are applying to buy firearms, instead saying that’s the responsibility of individual gun shops. That information could shed light on how Poway synagogue shooting suspect John Earnest was able to buy his gun at 19 with an invalid hunting license. Earnest picked up the AR-15 style weapon from San Diego Guns on April 26, the day before the alleged attack. His hunting license was not going to become valid until July 1, 2019, according to state Fish and Wildlife. A woman who answered the phone at San Diego Guns Friday said the store would have no comment. Earlier this week, a different employee told 10News, “We did everything properly. We did everything we needed.” Senate Bill 1100 went into effect this year, requiring anyone under 21 buying a rifle to be law enforcement, military, or have a valid, state-issued hunting license. The Justice Department, however, says gun shops must verify the hunting license before they allow the customer to fill out the state online application. That application leads to a 10-day background check that checks a variety of categories - hunting licenses not listed. "Dealers are currently responsible for determining whether an exemption would apply under Senate Bill 1100 at the point of purchase. The 10-day waiting period, among other things, is to check if an individual is prohibited by state or federal law from owning or possessing a firearm," a DOJ spokesperson said in a statement. Earnest is accused of killing Chabad of Poway worshipper Lori Kaye and injuring three others in the April 27 attack. “He was not 21, so I knew from the beginning there is something fishy here with that gun,” said Israel Dahan, whose daughter Noya was hit by shrapnel and will soon have surgery on her upper cheek. “To be honest with you, what’s the difference? (KGTV) -- The California Department of Education on Monday released guidance for the safe reopening of all state schools.State Superintendent of Public Instruction Tony Thurmond and other CDE leaders unveiled a guidance document that will serve as a road map of recommendations for schools as they work with local public health officials on steps to reopen.All schools in the state closed in March due to stay-at-home orders protecting against the spread of COVID-19. Reopening dates have not yet been set.The document addresses topics such as face coverings, physical distancing, symptom screenings and distance learning.Some of the suggestions include:Students should use cloth face coverings, especially in circumstances when physical distancing cannot be maintained. Face coverings should be worn while waiting to enter the school campus; while on school grounds (except when eating or drinking); while leaving school; while on a school bus.In classrooms, desks are to be a minimum of 6 feet apart and desks should be arranged in a way that minimizes face-to-face contact.All staff should wear face coverings. Teachers could use face shields, which enable students to see their faces and to avoid potential barriers to phonological instruction.The CDE also laid out suggested scheduling models, including:Two-day rotation: Students report to school on two designated days based on grade level for in-person instruction.Alternate week rotation: Half of the student population attends in-person learning opportunities four full days per week while the other half is engaged in distance learning opportunities.Looping structure: Students and teachers will remain together for multiple grade levels (TK-8).Staggered scheduling: Start and dismissal times would be staggered based on grade level.Click here to view the department's full guidelinesThurmond said, “We have to prepare for the likelihood that we will have to return to distance learning.”Jean Marie Arce, whose son will be a sophomore at Hilltop High School in Chula Vista, told 10News she is concerned for working and single parents when it comes to dealing with in-class learning versus distance learning for their children.“It’s so much easier for him just to be in school than trying to do the online thing,” Arce said.Arce also had concerns on how physical distancing would work once students are allowed to return to campus.“These classrooms are 20-plus kids. (KGTV) -- The National Transportation Safety Board ruled Tuesday that the lack of adequate oversight by Truth Aquatics Inc. led to a boat fire that killed 34 people off Santa Cruz Island last year.San Diegan Nicole Quitasol and four of her family members were among the 34 killed in the September 2019 blaze.The NTSB said Tuesday that the fire aboard the Conception diving boat is one of the deadliest maritime tragedies in the United States.“The message is clean up your act, follow your procedures,” said board chairman Robert Sumwalt while speaking about Truth Aquatics Inc.The investigation revealed the 33 passengers and one crewmember killed were in the bunkroom and unable to escape before being overcome with smoke.Investigators told the NTSB some of the victims had on shoes, indicating that they were awake and trying to get out at the time of the fire.Smoke inhalation was listed as the cause of death for all victims.All 34 were two decks below the area where five crewmembers were asleep in the upper deck. The five crewmembers survived.The NTSB agreed on 18 key findings in the investigation, including that the lack of required roving night watchmen and lack of smoke detectors in the salon area of the boat delayed the detection of the fire by crew members, leading to the high number of fatalities.While the fire's exact cause was not determined, the NTSB said it could have possibly been caused by charging electronics and lithium-ion batteries.As a result of its investigation, the NTSB made ten new safety recommendations for the U.S. Coast Guard and others in the industry. Some of the recommendations including a requirement that all newly constructed vessels with overnight accommodations have smoke detectors in all accommodation spaces and that the vessels provide a secondary means of escape into a different space than the primary exit so that a single fire should not affect both escape hatches.“The recommendations that we’ve issued today if implemented that’s the key, if implemented, would reduce the risk of future passenger vessel fires going undetected it would ensure that escape routes exit to different spaces improving the chances for survival for passengers and crew,” said Sumwalt. 2229
