SAN DIEGO (KGTV) — New details are emerging about the death of a man in San Diego Sheriff’s deputies’ custody. A recently released Medical Examiner’s report says an arrestee’s death last year was a "homicide." The District Attorney's office said last year that none of the deputies involved in the in custody death will face any criminal charges. Oscar Leal died last February 28 after deputies responded to his apartment in Vista and detained him. The Medical Examiner’s homicide classification is not a legal term, but a medical assessment. The DA's office wrote in part of a nine-page summary and statement in December last year: "... His level of methamphetamine intoxication combined with his active resistance combativeness in the duration of the struggle, all contributed to his death ... The deputies involved in his detention acted reasonably under the circumstances in bear no state criminal liability for their actions."The Sheriff Bill Gore wrote in a statement:"I am aware of the Medical Examiner's conclusion regarding the manner of death of Mr. Leal. I respectfully disagree with the classification of the manner of death in this case as a homicide.The pathologist wrote that his death was due to acute methamphetamine toxicity in the setting of agitation, physical altercation, and prone restraint. It was purely due to Mr. Leal's agitation that he was restrained. Peace officers have a duty to restrain those who are agitated and under arrest, as Mr. Leal was. Were it not for Mr. Leal's abuse of methamphetamine he would be alive today. The deputies and nurses on scene rendered immediate aid to Mr. Leal.Mr. Leal brought upon his own death with his choice to use methamphetamine. His manner of death is more accurately classified as an accident."It has not been made clear yet why the medical examiners report took 13 months to be released. 2135

SAN DIEGO (KGTV) -- Police are searching for the suspect who reportedly robbed a Subway in San Diego’s Corridor neighborhood at gunpoint early Sunday morning. According to police, the robbery happened on the 3300 block of University Avenue around 3 a.m. Sunday. Police say the man walked into the shop, pointed a gun at an employee and demanded cash. After the employee handed the suspect an unknown amount of cash, the man fled the scene. The suspect is described as a Hispanic man, five feet, nine inches tall and “very thin.” He was wearing a black hoodie, black mask and black pants, police say. 608

SAN DIEGO (KGTV) -- Over the last year, thousands of San Diegans received incorrect water bills, but as the city recently discovered, thousands of customers received no bills at all.Officials said at a news conference Thursday afternoon that as many as 2,500 customers may have been affected over the last three to six months. In a press release sent to 10News Thursday, the city blamed a backlog of work orders and additional training for staff on a gap between meters and the public utilities department billing system.RELATED: Audit shows City sent thousands of faulty water bills?The city says meters were still collecting usage data, but the information wasn't being generated into a bill.Earlier this year, Mayor Kevin Faulconer asked the department to re-read every meter in the city. The city also promised that payment plans will be made available for customers.The issue comes on the heels of another problem with the department. SAN DIEGO (KGTV) — One person died and two others were injured, and Coast Guard crews rescued 17 others after a mega yacht collided with a fishing vessel off the coast of Imperial Beach Friday night. The 332-foot yacht, Attessa IV, crashed into the 65-foot sportfisher vessel, Prowler, just before 8 p.m. about nine miles off the shore of Imperial Beach, according to the Coast Guard.The collision caused extensive damage to the right side of the Prowler.One man was airlifted to UCSD Hillcrest and died at the hospital, the Coast Guard confirmed. SAN DIEGO (KGTV) — Philadelphia Eagles running back Darren Sproles has announced he will retire from football at the end of the 2019 season, the Eagles announced Saturday.Sproles spent 15 years in the NFL, racking up 3,552 career rushing yards, 4,840 receiving yards, and 55 total touchdowns. He was a three-time Pro Bowl running back and spend six seasons in San Diego with the Chargers before heading to the New Orleans Saints and lastly Philadelphia.The 36-year-old Sproles told reporters he's at peace with his decision to retire.
