WASHINGTON (AP) — The Supreme Court has refused to take up an appeal from South Dakota's only death row inmate, who was sentenced to death after he pleaded guilty to taking part in a torture killing 20 years ago. The court did not comment Monday in leaving in place the death sentence for Briley Piper, an Alaska man who was one of three people convicted in the killing of Chester Allen Poage of Spearfish, South Dakota. One has been executed and the other is serving a life sentence in prison. Prosecutors said the three men were high on methamphetamine and LSD when they decided to burglarize Poage's home. The policy is laid out in a memo signed by Defense Secretary Mark Esper obtained by The Associated Press. It was described by officials as a creative way to bar the flag’s display without openly contradicting or angering President Donald Trump, who has defended people’s rights to display it. "The flags we fly must accord with the military imperatives of good order and discipline, treating all our people with dignity and respect, and rejecting divisive symbols," the memo reads. The memo lists the types of flags that may be displayed at military installations, such as the U.S. and state banners and the POW/MIA flag.
