SAN DIEGO (KGTV)- Many Americans say cell phone are their lifelines. But what happens when yours breaks? Whether for convenience or for price, third-party repair shops are the choice for many customers. Unfortunately, some Apple users with the latest phones say they're not able to go to third-party shops. Four years ago, Christopher McQueen said he found the perfect niche business. “People are always breaking their phones, late at night,” McQueen said.He is the owner of Mobile Cell Doctors. Any brand, any phone, any version. He will come to you and fix your phone.“To be able to fix your phone in 10 minutes, versus a 3-hour fiasco at Apple, it was a need that was definitely there,” McQueen said. He said he can fix any hardware problems, except on the most recent iPhone models - iPhone 8, 8 Plus and X.Just recently, iPhone 8 user Lucas Peckham went to McQueen to get his broken screen replaced. His choices were 0 with McQueen or 9 at the Apple Store. He chose the cheaper, more convenient option.Peckham said everything was flawless until one morning, he woke up to a phone with a frozen screen. He could not swipe, touch, type, or do anything with his device. Peckham said it happened after his phone automatically updated overnight, installing the Apple 11.3 Software.McQueen said he was suddenly inundated with calls from all of his previous iPhone 8 customers. “It’s been a nightmare,” McQueen said. He said he had fixed about 100 iPhone 8’s in the last six months. He suggested to his customers, to do what they hoped to avoid by going to him in the first place - go to the Apple Store. But Peckham said, when he showed Apple the problem, he was told, because he previously used a third-party repairman, they could not repair it. Instead, he had to replace it with a brand new screen for 0 - or buy a whole new phone. “I totally felt screwed,” Peckham said. With no other option, Peckham said he gave in, spending six hours at the Apple Store, and paying up the 0. “It was basically a way for Apple to create kind of a monopoly on the iPhone screen,” Peckham said. Last month, California became the 18th state to introduce a “Right to Repair” Bill, which would require electronics manufacturers to make repair information and parts available to owners and third-party repair shops.McQueen hopes this legislation passes, so mom-and-pop business owners like him also get to have a piece of the pie. “I would love to fix those,” McQueen said. “But until they release the software to run the phones that would allow third-parties to work on those devices, we can’t fix them.”10News spoke to Apple, who said they do work with Authorized third-party dealers that are not Apple Stores. SAN DIEGO (KGTV)- Residents in a South San Diego Apartment complex worked together to fight a fire that started in the patio.At around 10:45 Sunday morning, San Diego City Fire Rescue teams responded to the 1700 block of Oro Vista Road. Heavy smoke was billowing from the patio of a downstairs apartment. "I called 911 automatically, and that's when the person who lives upstairs came running out,” Alexa Delgado said.Delgado had just arrived at the Oro Vista Villas to visit her mother when she saw the flames. "It started popping, and the fire started coming out,” she said. It was in that moment of chaos that she found herself and several neighbors step up to help. One neighbor pulled the smoke alarm, others smashed fire extinguisher boxes and started spraying down the patio, and she protected the neighbor's pet birds, all before the fire department arrived. Engine 30’s Fire Captain, John Wilson said what the residents did in the first minutes of the fire helped suppress the flames. "There was an alarm that was going off upon our arrival, so the smoke detectors did their jobs and got everyone out safely,” Captain Wilson said. Delgado says what happened today was a true testament to the word “community.”“A bunch of neighbors helping and asking if anyone living there, went upstairs to see if anyone was in there and helping out."Fire investigators are still looking into what exactly caused the patio fire.  No one was inside the home when the flames ignited. SAN DIEGO, Calif. (KGTV) - Five years since it was last open to the public, the iconic "Plunge" swimming pool is finally set to welcome San Diegans at Belmont Park."Oh, we're so excited. It's highly anticipated," said Belmont Park spokesperson Michelle McKee.The pool was one of the original attractions when the amusement park opened in 1925. However, it had run into hard times in recent years and has been closed for much of the last decade. One management company went bankrupt. The next came up with a renovation plan, only to discover dangerous, corroding conditions inside, leading to the pool's closure in 2014. Work finally began in earnest in 2017, tearing out much of the Plunge infrastructure, while trying to maintain a link to its historic nature."It was a wonderful pool," McKee said. "We wanted to maintain the structure of some of those elements, so that remains here in the pool."A signature element, a large mural by the renowned artist Wyland, had to be removed. In its place is a new, bright, open look. Windows surround the pool, giving swimmers a view of the ocean. A retractable roof will help control the climate inside the glass space.The high-end gym company "Fit" is building a club on the upper floors. Fit will manage the pool. Members will have access to the pool. The public can purchase day passes. With a dynamic pricing plan, adult passes will begin at .Some San Diegans who have been to the plunge in the past worry that the price point will drive out locals and turn the Plunge into a tourist haven."I feel like when it's not tourist seaon, like summer when there's not many tourists, it's just going to be there. SAN DIEGO (KGTV)- Santa Ana winds are once again sweeping through the county. Fire crews and the city are on high alert after recent brush fires around San Diego. They are urging the community to take action. This comes after flames sparked in a canyon in the Talmadge area last Tuesday. Neighbors had to evacuate as the fire came within 200 feet of homes. “We do know that where that fire started, there was a homeless encampment,” says Fire Chief Colin Stowell. “It’s important for those who see an active encampment to report it.” Check 10News Pinpoint Weather ConditionsThe next day crews responded to another brush fire in City Heights. The blaze scorched an acre of land. It’s not uncommon for homes to sit within feet of canyon-like areas. The city says they work to clear the brush in these spaces, but they also face some challenges. “Unfortunately, because of the number of open spaces and what we call the wildland-urban interface properties that but up against open space or canyons, they can only really get out there every three years,” says Stowell. The city says it's continually investing in new fire equipment. In June, the city added eight new fire engines and two brush engines. 10News learned a new helicopter will be deployed soon. 1262

SAN DIEGO (KGVT) - For many students across California, school is either back in session or will start soon in a virtual setting.With uncertainty about what the school year will look like for all children, the parents of students identified as needing special education services are raising serious concerns about their child’s access to necessary supports and resources."Right now, school is virtual," said Sally Sachrison. "It’s been quite a challenge".Sachrison's 12-year-old son just started the 7th grade. That's an achievement, but the emotions she's feeling are not the typical excitement of going back to school."It's just overwhelming because distance learning doesn't always work for everybody, and I feel like they have abandoned our kids that really the special services," Sachrison said.Her son has Down syndrome and is autistic. His unique needs can’t be met over a computer, Sachrison said.“The conflict is that my son needs like a special education teacher, he needs a speech pathologist, he needs an occupational therapist, and these are specialized, trained professionals," she explained.Sachrison said she’s already noticed her child regressing just since schools moved to remote learning in mid-March to prevent the spread of COVID-19. By May, he was slurring his speech and having trouble with other tasks, she described.Regression and lack of services are a concern heard by attorney's and advocates from parents across the state."How do you take a parent and say hey we're going to train you to do occupational therapy even though you're not licensed to do it?” said Nicole Shelton, the executive director of Advocacy Associates Inc. "You don't have that background and still have that done virtually."Advocacy Associates Inc. is an origination that helps families of students with specials needs get the services to which they are entitled by law.In California, once a child is found eligible for special education, the family will participate in the process by attending an individualized education program or IEP.It's both a process and a written document.Shelton explained the IEP team, which includes representatives from the school and district, meets once every three years to conduct an assessment to ensure the student still qualifies. The team must also meet annually to review progress on goals, create new goals, and see what accommodations the student needs.She said parents are concerned that won't happen."I think it's important for parents to be requesting IEP meetings right now," Shelton said.There are also concerns about services not being provided and compensating students if they've regressed because they weren't provided with appropriate services and support."I think parents absolutely need the first step to be asking for that emergency IEP," she said. "We need to talk about services, and we need to talk about accommodation."In Sachrison's case, the district told 10News, "Providing equitable educational experiences to all students including students with disabilities is a key priority for us and we want the service you receive to reflect that principle. Due to the current school closure emergency that prevents in-person instruction, student Individualized Education Plans will be implemented through distance learning to the greatest extent practical via online resources and other means. The IEP will be provided by means of ‘distance learning’, as determined by your child's teachers, in light of the emergency circumstances."A district spokesperson explained, “‘Distance learning’ means instruction in which the pupil and instructor are in different locations. ‘Distance learning’ may include, but is not limited to, all of the following: (1) Interaction, instruction, and check-ins between teachers and pupils through the use of a computer or communications technology. (2) Video or audio instruction in which the primary mode of communication between the pupil and certificated employee is online interaction, instructional television, video, tele-courses, or other instruction that relies on computer or communications technology. (3) The use of print materials incorporating assignments that are the subject of written or oral feedback. This applies to the special education and related services in the IEP to the greatest extent possible in light of the emergency circumstances. Under current public health and CDE guidelines we cannot provide services either at the school, or in person, for more than 10 days due to the qualifying state of emergency. The parent will be notified as to the specific means by which the student's IEP will be provided, given the emergency circumstances present at that time. The IEP will be provided by alternative means as necessitated during the period of emergency conditions only."The district said IEP meetings are being scheduled to take place virtually and it is dependent upon the IEP team to determine whether new goals will be developed on an individual basis.When asked how the district plans to handle learning regression from the spring and forward and whether the state has provided any guidance a spokesperson explained, "When ‘regular’ school hours resume there will certainly be a need to discuss each students' services since distance learning falls short of providing optimal outcomes. At that time students with disabilities, in addition to ALL students in the general education setting, will have to undergo some form of instructional/educational recuperation. Our district is currently considering multiple options to meet this need."A spokesperson for the California Department of Education said students who are receiving special education services through their school district have an IEP and the services and/or accommodations they receive are listed in that IEP."The federal government has not waived the federal requirements under the Individuals with Disabilities Education Act (IDEA) and local educational agencies (LEA) should adhere to IDEA requirements. In the upcoming school year, local educational agencies in consultation with their local health agency may offer in-person instruction, distance learning, or a combination of both.
